  1. I'm just wondering if anyone knows how to cancel an appeal for an I-130 petition that was denied several years ago. Our appeal was filed over 3 years ago but our senator's office said the information they got was that it's still pending and there's no time limit on giving a decision. It seems like it would be easier and faster to just start all over but I don't want to be denied right away because of a pending appeal on an old petition.

  3. Good day guys. We are under AWA. and after 3 yrs and 8 months of waiting, both i129f and i130 denied.

    Guys, they send as denial letter and we have till March 10 to appeal. Hubby will going to take the polygraph test and will gather the paperwork. Guys, please we need your opinions and advise.

    The main question we would like to ask is ,

    Do we need to appeal both i130 and i129f or just one petition? Please guys need your help badly. :help: :help:

  4. You need to find out why you were denied in order to address the issue BEFORE you file again otherwise you may end up in the same place. If they're being that sticky about not talking to you but talking to your husband, looks like he needs to take a lunch break to sort this out or take a day off work...I am SO sorry this is happening to you! How extremely frustrating! you guys are in my prayers.

    I wanted all who read and waits for any developments of our case to know, that we send mails (i mean, not email) with all the proofs and our uscis online status that showed our case is being processed and was sent by that mail to the congressman, senators, ombudsman, governors and USCIS too. Luckily, Office of Senator Pryor replied us today thru email. and this was the contain of the email:

    FYI, your case file is in transit back to Vermont Service Center. I was advised to check back in 10-15 days to see if it has arrived for continued processing. I’ll let you know when I have a more detailed reply.

    Why we cant checked our status online? is this because we used our status online as evedince? thats why they blocked it? What does it mean "case file is in transit back to VSC? Was our case denied as what USCIS Supervisor Costumer Assistance said? We still dont have a copy for that denial even if we requested it 2 times already.

    Any ideas to share. We'll appreciate it. Thank you and More Power...

    Yes, Darnell,i sent message to gogo and he replied. We did all your advised. and my husband got a letter this morning from uscis stated "the system shows the file is here at the vermont service center. as soon as the file is available, it will be requested and a copy of the denial notice will be sent out to you."

    Here's the letter from the USCIS supervisor Costumer Assistance dated April 19,2010: "On behalf of u.s. citizenship and immigration services thank you for your case problem submission worksheet, form dhs-7001 to the dhs cis ombudsman regarding the status of your form i130,uscis records indicate that the California service center denied your form i-130 and form i-129f petitions on dec. 18, 2009. the csc sent you notices explaining the decisions to the address above. please note that uscis is not able to extend the period for you to file an appeal of these decisions.if you have not received the denial notices, you may request a duplicate by calling our national customer service center at ---------- to report non-delivery of the denial notices."

    I (benefiary), called uscis. the first person says our case is still adjudicated, and she asked me if im the petitioner. i told her no im the wife the benifiary. and she told me sorry maam i cant give you the details of the case coz only the petitioner has the right to know it. :unsure::blink: . I told her, channel me to your supervisor, i want to talk to your supervisor. and she told me maam the supervisor will tell you what i told you.so i did told her, i have the right to ask your supervisor, thats what the congressman advised me to do. so she seemed in a hurry to passed it to the supervisor.The supervisor asked me first if i got the AOS package. :rolleyes: i told her, i called coz i want to know the status of my case, since the uscis online status is not accurate in showing the updates. or is not working in the update of the cases.And then she asked me if im the petitioner,and i told no. and she said tell your husband to call us and we'll give him the status. i told her my husband is working from 6 in the morning till 5 in the afternoon, so he cant call uscis coz its close by the time he arrives home.so make it short, i dont have any updates of our status. :(<_<

    I email the Congressman, Senators and Governor Beebe, about our case, and explaining the problem. im still waiting for their reply. and my husband also sent letters to President Obama, Senators, Congressman and Governor as well as Ombudsman and uscis too,together with all the proofs email and phone call from the senator Feb 2,2010 and letters from uscis dated Dec 17 and 28,2009,Feb 1,2009 that our case is still reviewed.Husband sent each of them a copies of proof.

    Now, i was thinking of filing another I-130. In I-130 question D #2.Have you ever filed a petition for this or any other alien? Can we just mark the NO? Can we do thiseven if we haven't receive any copy of the Denial letter even though husband requested a copy of it already?

    Can you give us again an opinions or ideas on what to do. Please :help: :help: us.

  8. what were the RFEs?

    May 18,2009 RFE both i-130 and i-129f about: A# =record of the offense, File #, or Receipt #, and my last name.87 days period permitted. We send all documents and evidence June 21,2009.

    October 5,2009 RFE both i-130 and i-129f about : Divorce paper from the 1st wife.

    We all send this papers in the beginning of the application. We called uscis every month and they said our case is under reviewed. :crying: :crying:

    and all a sudden denied and havent receive a denial letter on what grounds they denied us :( :(

  9. July 23,2007 filed i-130. USCIS send RFE both i-130 and i-129f May 18,2009 and Oct 05,2009. And we send all documents,proofs, evidence to them before the deadlines they give us.Sent both replies dated June 21,2009 and Oct 16,2009. Senator calls and emailed Feb 2,2010 said that our case was under reviewed. Congressman emailed Feb 1,2010 same thing case under reviewed.Very shocking April 19 we received letter from USCIS and it said it was in response to the inquiry by the Ombudsman and that Pamela Ball, a supervisor of the customer assistance office, said USCIS records showed that our case had been denied Dec. 18,2009 and they couldn't extend the period for us to appeal. I called USCIS 2 times and made them give me a supervisor the 2nd time who said we were denied and that sometimes it doesn't update online or on the phone line of uscis which is supposed to give the latest information available. MEANING TO SAY USCIS ONLINE STATUS IS USELESS. IT DIDNT HELP. In the letter it says they sent notices explaining the decisions but I don't know if they mean the NOID's or what.

    Senator, Congressman, Ombudsman and Online status said CASE REVIEWED (Feb,2010). And suddenly got a letter said case denied and that was 4 months ago without denial letter :bonk::unsure: :unsure: :unsure::bonk:

    How does this happend? How's working right and telling the truth?

  10. You should update your timeline.

    So, you sent an I-130 and an I-129F for a K3, yes? And you got an RFE for the I-129F a couple of months later. Did you ever respond to the I-129F RFE? Your timeline also says you got an RFE for the I-130 more than two years after you sent it. Is this correct? Did you ever respond to THAT RFE? Is that why you finally got a denial on the I-130?

    I'm dying to hear about this case. What the heck happened? What were the RFE's for?

    My husband replied RFE and sent all the evidences. You can read my post in K3 furom and IR/CR1. i explained it there clearly. thanks for the replie

  13. Call USCIS & cut off the canned speech before the Misinformation contractor really gets rolling. Request to be escalated to an immigration officer. If the contractor objects (probable), say, "You are required to escalate my call to an IO upon my request." That should do it.

    Alternatively, schedule an InfoPass appointment for yourself. Good luck, si man.

  15. I am sorry guys: I should have state that this is not base on anyone. I just want to be prepared.

    yes you should be prepared of whats coming. like us we're not really prepared about the shocking mail we got yesterday. A letter from the Supervisor of the Customer Assistance Office of USCIS saying our petition I-130 got denied last year Dec 18,2009 and we just received a letter yesterday.And we checked our status online it says IT'S PROCESSED IN CALIFORNIA and called USCIS and they said the petition was still being processed in California. All the 2 yrs and 9 months of waiting, this is all we got? So its better to be prepare on what to do next.

    What are the best things you can share with us. or to someone here who might get denied. what's best thing to do? please give us advises and ideas. :help: :help:

    1 more thing i want to ask. The Supervisor of the Costumer Assistance office of USCIS stated that CSC

    had sent us a letter of denial explaining why we get denied. And the fact was, we didnt receive any letter from CSC explaining why we got denied.We called USCIS this morning but they dont know. we checked our status online still the same REQUEST FOR EVIDENCE.

    My question is: Can we trace the letter where it goes or if they really mailed it or they just make reasons? We did everything,RFE, evidence, letters, we pass everything to them. and we havent receive any reason why we got denied.

    Please give us some advices. We'll appreciate it. Thanks and God Bless...

  17. Yes - contact your Congressman or one of your Senators and ask them to find out for you. You will need to fill out a consent form for them to investigate and most of them have these available on their websites so you can print it out, fill it in and fax it back. Good luck.

  18. I filed a spousal visa for my wife in July of 2007 and got all kind of excuses from uscis about the delay and two RFE's. I wrote to my ombudsman last year and again early this year. We got a letter today from a supervisor of the customer assistance office of uscis saying that our petition was denied on Dec. 18, 2009 and that CSC had sent us a letter of denial explaining why we were denied. I never received a letter of denial or any kind of letter like that. I did receive a letter dated December 17, in response to a service request I had done, saying our case was still being processed but no denial letter at all. I went online to see if it said I was really denied, and checked my case status. It said my case was being processed in CSC and I would get a letter when a decision was made. I thought that was strange that it wasn't updated online so I called the uscis service center. The automated voice asked for our petition number and after I gave it, the voice said our case was being processed in California and that was the most recent update available for our case. Unfortunately, I got a customer service represenative that wouldn't give me any help or even tell me if we were denied or not. She finally said she would do a service request to find out and then told me I should hear something in 45 days. AARRGGGGHHHH!!!!! I don't know what to do now. Does anyone know how I can find out if I'm really denied or not. Why would the letter say I'm denied and the web site and customer service center both say it's being processed still? Has anyone ever heard of this happening before? I'm really confused and could use some advice. Thanks!

    MERRY CHRISTMAS TO ALL OF US HERE!!!

    I was always wondering what happend to my case, its about 1 year and 5 months already of waiting for my NOA2, but still nothing. We always called USCIS ref, and they just said wait 30 days, wait 45 days. The last few months we called the USCIS ref and says were under security name check so we waited. months and months past still the same, just wait. The last time was November of this year we called up USCIS ref and just the same storys just wait 45 days from the day you called. :crying::crying:

    Are there still fellow VJ who are july 2007 filers? Why USCIS keep us apart? They said that they are bringing husband and wive and family together.BUT THEY JUST _ _ _ _ THIER WORD. They're keeping us apart. How could we start living together and make a family, if they're always going this? LIFE IS TOO SHORT they also said that.

    HAYYYYYYY :(:( But i still believe God is with us. Fellow VJers just keep our heads up and pray also.

    I know some of you wife who are waiting for the approval heard gossips of your neighbors why takes your case so long, i also encountered that, and just ignore but deep inside my heart :crying::crying: There's only maybe one to be blame of this. USCIS didnt work seriously of their job.

    Just hope USCIS will going to change their attitude of working this coming year just to be FAIR.

  21. It's October now and we are closer to 8 mos from filling our 1-130 and still case PENDING. It's so frustrating and depressing that until now we haven't receive our NOA2 yet. Soooo... unfair while we see others filed April, May, June got approved already without expedite. Wonder how Vermont approve everyone's case, I'd like to believe now they approving it at RANDOM not by FIFO -first in first out. And here we are, the waiting continues like eternity. How long can we stay apart from our spouses, ohhh, sick & tired here to just talk in the computer everyday, I hate the waiting....It's about time, VSC PLSSS APPROVE US & those that have been waiting for long time. :bonk::crying: :crying:

    Yes its true, its very frustrating. And really hard to be apart from our husband or wife.

    I have 4 neighbor friends who just applied K3 and K1, just this April 2008, and they're lucky got APPROVED

    and INTERVIEW will be on Oct. 20, 2008, while im still here hanging and waiting for so long :crying::crying:

    It's been 1 year, 2 months and 15 days :huh: of waiting for our Approval. We've already wrote letters to the Arkansas Congressman and Senator and also to the US President begging to help us get approval, but still the same no actions. :help::help:

    We really dont know why they take us so long to get us approve. dont know what's their reason. But still

    we're POSITIVE that one of this days, week we will get our aprroval like GOGO did. ;)

    We're always praying that may the LORD JESUS CHRIST hear our prayers and NOVENAS. And wish

    all of us 2007 FILERS get our approval so soon coz we deserve to get APPROVAL and be with our love one by this time instead. Wish the USCIS will realize how long we sacrifice from being apart with our husband or wife. And hope they will realize and bare in their minds that they should give approval for the 2007 FILERS before giving approval for the 2008 FILERS ;) . Wow really!? that's good! we'll be checking in on Oct.15 @ 11AM...how did u book ur room at Cherry Blossoms? i filled up their reservation form on their website & they sent me a Confirmation form which i have to fill-up, sign & mail fax back to them. But i don't have a fax machine here at home. they were asking for the back-to-back copy of my credit card & a copy of my passport too. did u do this too or you'll just walk-in?

    Another problem i have is that, we will be arriving in Manila from Bacolod at 8am, & but their check-in time is at 11am...i'm planning to start our Medical on Oct.15 @ 1pm sana...so what do u think sis? :)

    Good Day!!! i have a phone number of the Cherry Blossoms since everytime my hubby come to PI, cherry blossoms is the best to stay since Robinson Mall is just adjuscent to it. Here's the number (632) 524-7631 to 36. Just call directly to their number and ask for a lower price. The price in the website is much higher, coz you contacted an agent of them.So i advice call them directly and get a reservation.IF you have relatives in manila, you can ask them to call cherry blossom for reservation for you (to save datong in calling long distance :lol: Thats what i did everytime my hubby comes here.

    I also advise, mas malapit sa Swagman hotel, dahil tatawig ka lang US Embassy na at mura din.Tatawid ka lang sa kalsa na na yon US Embassy. pagsa Cherry blossoms kasi, dami pang kanto dadaan mo.kung magtaxi man eh, gastos na ;) . para makatipid, i suggest Swagman Hotel.

    In my case, my husband already made a letter from the senator and he was given a form

    to fill up stating the problem and their willing to help. So my husband will mail the form

    again which comes from their senator.

    I was wondered why some of the July filers haven’t got approve. We did everything right.

    Anyone knows what magic they used to get approval right away. Anyway, we're still thinking

    positive ;) that some of this day we will be soon get our NOA2.

  24. I know exactly how you feel brucelene.

    I really think July filers got lost somehow.

    It doesn't make sense that people are receiving approvals already who have sent their petitions this year(2008) yet there are lots of us still waiting more than 8 months.

    It really seems backwards, sort of like the processing times that just moved back in time from august 2007 to july 2007.

    Well we need to stay positive, thats all i can say.

    Hopefully the help we seek from our congressman and senator will help.

    In our case, everytime my husband called in RFE TRICK, our I-130 got touched, it means they're still

    touching or working on the July filers. Calling the RFE trick helps also in our case. but what we

    wanted to happend is the APPROVAL OF I-130 not only the touch :angry::angry: but we're still thankful of it.Hope

    they will reallize that its my husband birthday this April 4. so hope this will just a b-day gift from them by approving our application ;):)(F)

    How about you guys (July filers), maybe it will help by calling the USCIS. who knows by calling you will be touch and got approval ;) . Nothing will lost if you try to call. Just talk to the person in the phone in a nice way and gentle way.

    Hell of a long time to be waiting for a NOA2.I thought my wait was long,I filed mine september,i didn't get an NOA1,until february 1st,i am still waiting for an NOA2.

    Did you call up USCIS and ask them whats the hold up?

    Yes my husband made a call last March 13, thats why we got touched on the 14th of March. and until now to development yet. Since USCIS says in the petition is already out in their Processing Timeframe ,call them right and let them know. My husband will call today and hope he will have good news. And he did wrote thier Senators too this week. wish brings good news for our petition. We did every possible ways to make it faster. And hope the USCIS will do same for us. JULY FILERS.
