Regarding your experience with TX DPS on the drivers license, I had the issue with my fiancee coming into the country on K1, we filed AOS but we can't get past the acceptable ID issue until EAD or AOS is approved. So, I called our State Representative Fred Hill's office in Richardson and they went to bat for me with DPS in Austin. In my situation, we have to talk with USCIS and then our US Congressman but I found the congressman's office extremely helpful and willing to take a look at our plight. I also found out that your State Rep in Garland, Joe Driver, is on the Law Enforcement committee and over DPS matters. Your State Rep is your advocate on issues like this. I'd recommend you get in touch with Driver's legislative liaison and tell them your story about the rejection over the 364 days and I bet they will be sympathetic and supportive. Let us know what you find out!

  2. We got our NOA2 on the 19th Dec, and it has been a month now. We learnt that the waiting time for the NVC processing is around 1 month, so my BF called the NVC a few days before but he was put on hold for such a long time that he hang up the phone finally. Then I emailed the NVC inquiry asking about the status of our case a few times with no replies at all. My BF called the NVC again yeterday using the automated voice service and was told that our file is not in the system? Wow, what does that mean? Does that mean our file has been sent out to Guangzhou Consulate China? or does it mean it still hasn't arrived at NVC yet? Is there any possibilities that it got lost? What shall we do now to track our GUZ#?

    Anyway, I don't know whether it happened to any of your guys before for your P2.5, so if you have experienced the same thing, please share it with us. Thanks a lot.

  3. You got your NOA1 at around the same time as me... I haven't received any touches yet either. Calling them doesn't really do much good to be honest.

    They say that the wait time at the moment is a standard 6 months (and that is exactly what they will tell you on the phone), but i'm not really sure how their system is working... They are supposed to approve in the order they receive, but they don't seem to be doing that.

    Just be patient, i'm sure you will hear something soon :thumbs:

    Congratulations for your packet 3 receiving! I was looking at the old posts and wondering how you guys are doing on the visa application and just found out that you already got the Packet 3 received. So good. We got our NOA2 received too on 19th Dec, but one month longer than you due to RFEs. Plus the Consulate in Guangzhou process the case much longer than the Consulate in London. I guess it will take another half a year at least for the interview coming up. How much that I envy you, I think you will get your interview date set up pretty soon.

    I have a question regarding the police check form for the Metropoliton Police check form, there is a question regarding the purpose of requiring the police check info, which states: if you require information held about prosecution, conviction, cautions history tick here,... and if you require information held about other than prosecution, conviction, cautions history, please provide details. I suppose for the K1 visa, it should be just to tick on the former one, or are there any more purposes other than prosecution, conviction and cautions history according the required standard for K1 immigration visa?

    Anybody has done this form? and Is the document valid for 12 months? Please help.

    Hi ,Tick the former ,and it is valid for 12 months for immigration purposes ,allow at least 40 days to receive it ! Andy .

    Jan 11th is my birthday :) , I wish my interview appointment is on that day. I hope my birthday luck will bring lots of good luck to your interview. It seems like beneficiaries from Philipines or Vienam have much shorter waiting process than Chinese :( . I wish mine will be faster.

  7. My fiance (USC) sent his BC, but did not send mine. But, I sent my Japanese passport copy. I wonder if it is ok.

    I suppose it all depends on whether they require it or not. It might be ok for you to go through. I don't think they require the beneficiary's BC at every single case. I think they only require it when it is necessary.

  8. Hi everyone,

    We have just got a notice from the USCIS saying that they just received our RFEs on 14th Dec, however, we have sent the required document almost a month ago. Anyway, our case is resumed for processing now. But does anybody have an idea of how long it will take for the Approval notice for NOA2 after the case is resumed for processing? The message did say that we will be expecting to receive a written decision within the next 60 days. Does that mean it will take another 60 days for it to be approved?

  9. I'm wondering if anyone can share their wisdom on my situation. Surely there are others who have approached the K1 and had to overcome some similar things. I realize there are some questions which will come up in the Guangzhou interview about my divorce so I'm going to get real and share our background with you guys. Thanks for your help!

    In July 2006 my ex wife moved like 2000 miles from me and established her residence and told me she wanted a divorce. I got an attorney and started the process because she was committed to getting the divorce. I also found out she had a relationship going on with someone at her work so I gave her the divorce with no contest. It took us several months to agree how to divide up our stuff and to sell our house. At the time, was a full-time student in college and therefore didn't have much income to report in '06.

    In November, a friend encouraged me to put my profile on one of these online dating sites kind of like eHarmony..he said i needed to look forward....haha...so I did and ended up meeting June. We wrote each other through January and then started talking over webcam. Our relationship grew strong as we spent HOURS talking about our shared interests, faith, travels abroad and our family backgrounds.

    My uncontested divorce was final early February and I decided to fly to China for '07 Spring Festival and visit June and her family to see if she was for real. So, we actually met AFTER my divorce was final and we spent one month together. We decided to move forward with our relationship. In June, we engaged and filed our K1 knowing we would be engaged for about a year while we wait. Seemed like a reasonable time to get to know each other better. During the summer I worked in the U.S. then returned to China in August for a 3 month stay with her. I've been in China for a couple months now and I'm supposed to return to the U.S. in December to return to work (for a company based in China). I'm in good shape financially but my visa attorney suggested that I have my father fill out an affidavit of support as a co-sponsor.

    I've read posts on VJ that lead me to believe my fiancee will have to explain how we met and answer hard questions about my divorce. Can anyone tell me how we can reduce our risk of screwing up our case?

    Will my student status in '06 be a liability? Will the co-sponsor affidavit of support be sufficient evidence of support?

    Any other observations on our situation are appreciated!

  10. Hey everyone, we submitted our petition on 18th June, but still waiting for our NOA2 approval, and there is no touch at all up till now. Anybody have an idea what happened?

    what is the average waiting time for the NOA2 now? I have been checking the sources on VJ and many filers who submitted their petition within similar time frame already got their NOA2 approved. What do you guys suggest we do? Shall we make phone calls to the filing center now?

  11. If your fiancee moves to China to work (legally of course) and you were to get married there, you can apply for DCF I think (waiting for the Gods of Chinese filing to refute). However, foreign income DOES NOT COUNT at all. You would indeed need a cosponsor.

It seems like it would not be very good for my Fiance to find a job in China for the K1, but I am thinking about if he can find a suitable job as the foreign expatriate in China, maybe we will consider getting married in China and change the visa application type to K3, then we will wait together and live in China until the K3 is approved. For K3 visa, will the foreign income count? Can we change the visa type during the waiting process without doing the I-129F approval again? Or do we have to start it all over again? What is DCF please?

  12. Hi everyone from VJ! I came to the forum often to read posts by different memebers and found this website to be extremely useful. Like everyone, we are all struggling with the long waiting time which seems to be a toruring process. My Fiancee filed the petition in the middle of June and it has been over two months now, but we still don't get anything (apart from NOA1). He is coming over to China at the end of Sep, and this is his second visit to me. We got engaged in April, but filed the petition in June only because he just graduated from his university at the beginning of this year, and has to find a job before we start the process. Now it seems like we can't endure the waiting process any more and if he comes to China, it would make the waiting process shorter, in addition, he is crazy about China and learning Chinese. During the time he is here, he can find teaching job in the language school, but I am not sure whether that will affect our visa application process. Since the salary in China is much lower than that of the US and also if he stays, that means he lost the job and have to start all over again when we go to the States. Will the Visa Officer deny the visa because of this? What about my Fiancee has something like Afidavit from his dad for financial support for us? Is anybody in similar situation to us?

    Yes we are in the same situation as you guys. Still no anything from them, not even a touch. We are the filers on 17th June, and were told to wait on the NOV2 till the end of October too. I guess what we can do now is just to wait......
