Yes but I meant about the esta question
My consular officer asked me all about my records and he was confused as he thought I had to declare that whilst applying for each esta
The similar situation I meant was that the person who contacted me was given a waiver for smashing a window when he was 19 even though it was over 36 years ago

Hello my experience was similar so after keeping my passport and getting a refusal at the embassy I had to apply for a waiver
I eventually passed but I've found that you will be denied and apply for a waiver unfortunately
There's a similar person I talked to thats going through something very similar and they were denied so they're going through the waiver process now

I'm filing with a lawyer to make sure it goes through which he said it should do as it's a mistake by the london embassy who should have passed it there and then really

I've just been told on the form that came back with the waiver that I'm eligible for a waiver and I should contact uscis to proceed
I've asked for court documents and a character reference from my employer
Weve got a lawyer in the states and he said it seems like a formality so I'm hopeful

So my offence has been classed as moral turpitude which while its sounds bad on first look is a catch all term for a lot of things from murder etc to drug offences and everything inbetween so I have to apply for a waiver and the best way is to use a lawyer
Now whilst I have a lot of time for respect and manners and treating everyone as you would wish to be treated back yourself morals are a different thing altogether
For instance as a lot of us on here are going through the immigration process legally how do you feel about joe biden pardoning illegal immigrants and setting them up?
For balance I might add if somebody could find anything moral about trump or any other politician please tell me

Ok as I'm going through this in a similar way at the moment I'll say what I've found out so far
Getting past the embassy and into the u.s. is going to be the hard part with no live trace no matter how innocent and how long ago the incidents were
Basically you're going to need a lawyer because of something called moral turpitude this sounds if you google it really bad but from what I'm seeing they can apply to anything they see fit if they're that way out
My offence is possession of cannabis ( £7.50 street value!!! ) and that was the reason I was refused and have to apply for a waiver to uscis
the offence happened 25 years ago and was spent but they have decided to make me appeal for this

Hello everyone as you can see by the title you know what this post is going to be about
I was refused but it said I may be eligible for a waiver and I'm wondering what my next steps should or could be?
Basically I was refused for possession of cannabis
This happened 25 years ago and I didnt have a custodial sentence in fact the amount was 1 gram but it's still on my record as no live trace and when asked at the interview about it I told the consular officer truthfully
Anyway I got a 221g and had to give my consent for them to check with acro which they did and then i got my passport back with the refusal notice but nothing on how they came to this decision
Is there a way to appeal?
Do we create a case at uscis or do we find a lawyer?
I've read that this is likely to get a waiver and is just a blip but do we spend money on a lawyer or just go down the uscis route?
If a lawyer is needed is it best to have a uk based one or a us based one?
Sorry for all the questions but after trying for months in this process and getting told all sorts of different things that we needed and didnt need you can maybe understand our frustration
Any help or advice would be greatly appreciated thankyou

In my case it took nearly a year but we had a couple of rubbish lawyers to begin with
When we found the one we used it took around 6 months but we managed to get an expedite through
Without the expedite over 12 months but check the latest status on uscis
