    What you are stating is that he needs to work and stay in US until his physical green card arrives. is this correct?

    The problem is that he needs to go back to Pakistan two weeks after arriving here as he is winding down his house and work related obligations there. Plus, his 3 other kids will be in Pakistan while he is here. The purpose of this visit is only to scope out schools and housing. He will migrate with his entire family in June/July time frame (as stated above).

    Can he legally leave US on I-551 stamp?

    Once his green card arrives by mail at my home address, I will send it to him so he can re-enter US when he migrates.

    Do you see any major issue with this plan?

    I just heard that if my Brother comes here, the only way he can exit US and re-enter is if he has a Green Card. And the Green Card could take from 2 weeks to 2 months to arrive from the day he enters US.

    Is this correct?

    Please let me know ASAP as my brother is coming here during the last week of March, with partial family, to scope out the schools and housing. He needs to leave after two weeks and then migrate with the entire family in June.

    At the time of filling out DS-261, his plan was to enter US along with the entire family. This means that if there was a choice in the DS-261 form, we likely chose "accompany" instead of "follow to join".

    It would be most helpful if somebody can explain what process he needs to follow if he wants to leave US two weeks after entry and then re-enter US again in June.

    As always, I want to thank you all first for all the guidance I have received against my previous posts. It has saved my hundreds of dollars and a lot of time.

    I am a USC (born in Pakistan) and I sponsored my brother, sister in law and their 4 children 13 years ago. Two weeks ago, they finally had their interview in Islamabad and now are awaiting to receive their passports along with GC paperwork.

    After getting their GC paperwork, the family will migrate before the start of the school year in August. However, my brother and his wife would like to pay an initial visit to US to scope out a place to live, check out the schools etc. They want to do this by visiting without the children and then later migrate with the entire family in July timeframe.

    Can they pay a visit to US on GC paperwork without their 4 children or do they all have to enter US at the same time?

    Any help you can provide would be much much appreciated.

    I would greatly appreciate your guidance here.

    I am a US citizen and am trying to get my mom into US. Mom and Dad were here on GC in 1999. They left in 2000. Dad passed away. Mom stayed in Pakistan due to medical being too expensive here. Her GC expired in 2010. I would like to bring her here as I believe I can afford her medical insurance now.

    The options I see here are:

    1) Request USCIS to re-instate her old GC. Will they entertain this request?

    2) Apply again for her GC. How long before she is eligible to come here?

    I am a USC and applied for an immigrant visa for my sister back in 2004. She lives in Karachi, Pakistan and has recently moved to another house within the same city.

    What is the process to update USCIS with her new address so all visa related paper work goes to her new address without a hitch?

    Any guidance you can provide would be much appreciated.

  7. Your mother is guilty of immigration fraud, as "visiting" once a year to fool USCIS to assume she still is a resident of the United States is fraudulent. Another first for me: I hope she gets caught this time, her card taken away, and send back to Pakistan.

    Amazing how you just passed the judgement. Obviously you are a person with no compassion. Do you really think this is something being done intentionally? Please, do not waste my time by replying.

    I am a USC and my mother, who has a Green Card, visits us from Pakistan once a year every year to keep her Green Card active. Due to family reasons, she can not stay here for more then 3-4 months. Anyway, she hasn't had any problem entering US as long as that occurs within the year. However, this time, she has been out of the country for over 15 months.

    Will there be any problem if she tries to enter US after 15 months?

    Any help you can provide in answering this question would be greatly appreciated.

    I am a USC and filed a I-130 for my brother and his family back in 2003. My brother is 40 years old, his wife around 32, kids are 10, 8, 4. I think it would be another 6 years or so before he gets his green card.

    Now, my brother and his family, who lives in Pakistan, has been granted a 5 year multiple B1/B2 visa.

    Obviously if he comes here on the visit visa, he will not be authorized to work.

    Is there any way he can come here to visit and file for an adjustment of status based on the fact that his I-130 is pending?

    If so, will he be able to get employment authorization?

    Any information you can provide will be greatly appreciated.

    I recieved a letter yesterday from USCIS that the application that the I-130 application which I had filed for my sister (I am the US citizen) has been approved and sent to the National Visa Center.

    My sister is married, has kids, lives in Pakistan and is 37 years old.

    What are the next steps and how long will it take for her to get a visa?

    I am a US citizen (living in a Chicago suburb) and filed N-400 for my wife (from Pakistan) on March 13th, 2009. Yesterday (April 11th), she received the invitation for finger printing.

    My question is.......Is I-751 (Petition to remove conditions on residence) a requirement for a US citizen filing for the spouse?

    I don't believe I filed I-751 for my wife.

    Is this going to cause a problem with my wife trying to get citizenship.

    If so, can I file I-751 now?

    I live in a Chicago Suburb and filed N-400 on 3/13/2009 for my wife (from Pakistan). Received a receipt on 3/19/09 that USCIS has received the application and that it has been forwarded to National Benefits Center (NBC).

    When I look at the processing times for NBC, I don't see N-400 as one of the form for which the processing times are listed.

    Any idea?

    Is NBC really processing the N-400 applications?

    What is the usual procssing time for N-400 applications?

    Which center is processing the N-400 applications for Illinois?

    Any feedback will be greatly appreciated.

    In 2003, I applied for a green card for my sister who is over 21 years old and married.

    Recently she had her third baby.

    I need to add her baby's name in her green card application.

    How do I go about doing that?

    I tried to search the USCIS website but couldn't find the right information

    I would greatly appreciate the answer to this question.

  14. I am a US citizen. My wife entered US on a K-3 visa in 2003. After an interview in Sepetember of 05, she received her green card which is good for 10 years.

    I filed for her I-485 last March (2005)

    I noticed that when I applied for her I-130 back in 2003, there was a paragraph asking me to file a I-751, 3 months before the the 2nd anniversary of her getting a conditional permanent residency.

    I am confused now.

    Does her green card makes her a conditional permanent resident (it's good for 10 years!)?

    Do I need to file I-751 for her?

    Can somebody please explain the whole process for me.

    I have a question very important to making life changing decisions. I am a US citizen. My Parents (Age 76 and 68 now) if they come to live with me on a green card, willl they be eligible for Medicare and/or medicaid?

    This is the single most important reason why my parents went back to Pakistan after living with me for a year in 2000. They both had deteriorating health and both were found not eligible for any kind of public medical aid/insurance.

    Great appreciate your answer.
