  1. I did read that they allow you to drive up to 1 year but that said with a tourist visa but that doesnt make sense cause a tourist visa is just 90 days... /confused

    Actually, visa waiver is just 90 days but a tourist visa can actually be up to a year, depending what visa and with what purpose you asked for it.

    Oh, I didn't even think of that.

    I'm here on a K-1 Visa so that doesn't fall under the tourist visas anymore, does it?

Yeah, I didnt even think to go to my city hall to get my DL adjusted because I really thought I was allowed to drive here with my EU license but I was wondering about the fact that it is in Dutch and if a cop would of pulled me over, I doubt he would of taken my word for it that it was a real license hehe so I started looking into it more and found out I wasnt allowed to drive :-| but it'll be fixed here soon I hope (hopefully they dont make me drive for 6 months on my drivers permit like they do 16 year olds lol because we're taking a driving trip from Ohio to Vegas for my 21st Bday and it would suck if I wasnt able to drive.

    but I actually went to the DMV after making this post and I'm going to do the written part tomorrow and just get an Ohio DL just to make sure I'm not in trouble if a cop does pull me over. I was under the impression that I needed my SSN to get it (cause thats what they told me both times when I called in asked about it) but apparently not when I walked in today so thats good news :D

    And I do realize that it wont get here as soon as they sent it but its almost been a month is why I was wondering.

    Karin: I do not have my name on the mailbox (none of us living here at the residence do though) I hope that wont be a problem, I got the other paperwork they sent us (NOAs and RFE). Now you're making me worry! haha :D

  4. Hi, I'm from Belgium and I've been here since July, got married in September, filed for AOS and EAD in November, my EAD just now got approved but still waiting on my AOS appointment and stuff.

    But anyways, I was wondering if I was able to drive here in the US with my European (Belgian) Drivers License? I'm in Ohio.

    Also, my other question was... I called in to see what was going on with my workpermit because it had been way past 90 days (they received my case on December 9th 2008) and we still hadn't heard anything about it getting approved or anything and the guy that we talked to sent in a request to expedite my case because it was over 90 days and 3 days later I got a letter in the mail saying that my work permit was indeed approved.

    " On 04/02/2009 you contacted us about your case. .... The status of this service request is: We have approved you case and an approval notice was sent on March 27, 2009 to the address we have on file."

    It does say if I do not receive the notice within 30 days that I can send in an other form to receive a duplicate..

    But I was wondering if it's normal that its taking so long for my EAD approval notice to get here? Normally I get my paperwork pretty quickly (even this last letter they sent me I got 3 days after we called in about this)

Hey everyone, our time limit was indeed up for our i765 to be finished so we called into USCIS and poof, they send us a mail 4 days later to tell us the status of the service request we were calling into ask about and it says that it was approved on March 27th so it should be here any day I would imagine. Since the official approval letter isn't here BUT we do have this letter from US Citizenship and Immigration Services informing us that it HAS been approved, is my wife now able to go get her SSN and a job? What should our next step be? Do we have to wait for the official letter stating approval or no? Thanks in advance

My wife sent everything and shes not sitting right here but I believe for my mother (sponsors) support we sent just about all of her tax info, we sent in her W2's etc and I believe we did the same for myself, we also sent in a paper from her showing her expected pay raises in the school district that shes a speech therapist for.

    We're getting ready to send out our RFE return and this is what we included.

    Sponsors (mothers) evidence return:

    Direct deposit/payment records for the last 6 months

    Copy of her passports biographical page to prove citizenship as an American

    Letter from employer stating where she works, that shes still working and numbers for contact

    Federal tax returns for the 2008 year

    Also included a copy of the affidavit that we sent with the original package incase they needed that

    For myself what we sent in for the return:

    Copy of passports biographical page

    Federal tax return for 2008 year

    Copy of the original affidavit with the AOS package

    Should we have sent in anything extra? I hope not because we're leaving now to mail it out :)

A little background: We first started this process as a K1 visa, we were now applying for AOS and Work permit after her visa was accepted and she is already in the country, we’re already married etc. I am NOT the main support on her forms though, my mother is because my tax forms cannot prove that I make over the poverty limit. I am the petitioner obviously though.

    We have had my wife’s AOS and work permit forms in for a few weeks now and we received a biometrics appointment AND a yellow request for initial evidence paper (separate mail not in the same). Anyways there were two yellow forms included the first one says

    X For the household member’s income to be included in the household income, the household member’s income must have been from a lawful source and earned while the household member was authorized to work in the United States.

    In order to process your application further, submit evidence that the household member on form I864 Affidavit of Support or form I864A contract between sponsor and household member, was authorized to work in the United States. Examples include one of the following:

    A copy of form I-94

    A copy of a valid employment auth document

    A copy of form I94 showing employment authorized

    A copy of a valid form I-551 or lawful permanent resident card

    A copy of a birth cert

    Copy of cert of naturalization

    A copy of a certificate of citizenship

    The next yellow paper inside of the mail was almost identical but just a little bit more short. Everything was the same except for the fact that under what needed to be sent in it says

    X The household member on form I-864A contract between sponsor and household member, failed to submit proof of current income.

    In order to process your application further, you need to submit evidence of the household member’s current income. Such evidence should include:

    Letter of employment containing the following:

    Dates of employment

    Nature of the job

    Wages or salary earned

    Number of hours per week worked

    Pay stubs or other documents of pay for the previous 6 months

    Now all of this is fine and dandy but I’m not exactly sure what they’re asking for, in regards to who it should be for and the last thing is that we sent all of this information in with our AOS packet, we didn’t leave a single thing out, we sent W2’s and all :/ Any help will be greatly appreciated though, thanks again VJ!

  10. Okay here is a quick little background of information.

    We submit our entire AOS package Nov 25th, along with the work notice (EAD). Shortly after we received our NOA on Nov 30th. Now today we have received our ASC Appointment Notice.

    Nowwwww though we are curious because of the fact that my wife is hoping that she can work really soon, what is to be done at this appointment? It says that it is for biometrics? Do we still need this? On our K1 I was under the impression that we did all of this while she was still in Belgium at the embassy and as long as this process was done within a year, that we do not have to redo the fingerprints and all of that fun stuff. Is this not the case? If not, how soon could we expect a work permit, if we do need to do this all over again once we get to the appointment how soon could we expect a work permit? Thanks a lot for the information, we're just anxious and nervous hoping this all is finished ASAP.

  11. Yes thats what we're going threw now, it's just a matter of which paper to use at this point. I just finished my 864 for myself (lol after work expenses my income is measly) and filed it as the main sponsor/petitioner now we're just waiting to hear what the VJ forums say about if we should just use the 864 for my mother who is going to joint sponsor or if we should use 864A and file as a household joint sponsor

Hello, my wife and I are filing our AOS but as it is we're a young couple and currently I can't file for her Affidavit of Support under just my income so in the meantime we're using my mother who is a speech therapist as the sponsor. My question is when filing this in the AOS packet do we need to do anything special? We marked under part 1 that my mother is the petitioner. I filed or am filing for the immigration of my relative. Is this correct? Otherwise I wasn't sure if I needed to file it under myself and then list her as a joint because when we were first applying for the K1 visa we tried to use mine but were denied so then my wife had to return to the embassy with my mothers information. We're just a little confused, some clarification would be great, thanks.

    Your wife is the "applicant" in this context. You are the "petitioner" and your mother is the "joint sponsor".

    Okay so then just to clarify, on the Affidavit of Support, I fill it out as in I am the sponsor (even though I know my current earnings aren't what meet the guidelines and on the same support form my mother should fill it out as a joint sponsor?

    You shoud fill out and submit one (1) form I-864 for petitioner/sponsor which is yourself even your income is zero ($0.00) and your mother must submit one (1) form I-864 for co-sponsor/joint petitionerwhich is your mother. Hence, you must submit two(2) affidavits.

    Sorry one last question but when my mother goes to file her form, should she just use another generic I-864 or should she use the I-864A for a household member? I just saw that there was an A form and didn't know which would be best :/

    once you get married within 90 days from the day she entered the US, it doesn't matter when you file for AOS. ggodluck.

    Cool, yeah we were married within the 3 month window we've just been slacking on getting the AOS put together. Glad to hear though, gotta file soon for her work permit though :/

  17. Hello everyone, I was just posting because we were making our adjustment of status kit. I was just curious exactly what all do we HAVE to send in with the main I-485 form and is any of it optional? One reason why we're completely stressed out about this is the fact that when we were doing our K1 we really didn't know what all we were doing and still are just stumbling threw this, when we made her entire packet, being the smartest people in the world like we are, we didn't copy it all so now we're kind of stuck, what would someone suggest?
