  1. I guess not! haha

I'm curious if anyone has had a recent EAD approval.

We filed Nov. 7th. With a NOA1 Nov.24, and Biometrics completed on Dec. 11.

Last week we received a notice for the first interview for the AOS near the end of Feb, so I'm hoping that this means that the work authorization will arrive before that time.

    Any thoughts??

Our Initial approvals for the K3 visa took sooooooooooooo long (15 months) so now this process of AOS and EAD seems to be moving very fast but I don't want to be fooled by this.

    I hope it comes quickly!

    Thanks!

  3. Hi ladybug..

I sent the packet to chicago the exact same date!!!

according to the timelines.. and if they already cash our checks... we should be receiving our NOA's on the mail soon...

and yes, its slower from october all the way to december...

    :) good luck

We sent the AOS package including the EAD on NOV 7th also. We sent two seperate checks. One for the AOS and the other for the EAD. I saw that the AOS check was cashed yesterday but not the check for the EAD. I hope that all moves smoothly and most importantly...QUICKLY!!!!! For you as well.

    bless

I was wondering, why did you write a check for your EAD? I doubt that they will cash out your check. I guess your OK because the fee of your EAD is included in your AOS fees.

oh yea i just read now

"The fee for I-485 applications filed on or after July 30th 2007 inlcudes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication -- as long as you paid the "new" rate for the I-485 effective July 30th 2007). "

well i guess the check for $1010 covers the adjustment of status and the EAD right?

    I hope so.

Thanks for questioning me because I wasn't to sure about this.

    bless

the check for 340$(EAD) that we sent in addition to the AOS fee was returned to us on friday, with a NOA stating that this fee was unnecessary. The EAD fee is included in the AOS fee of 1010$! sweet!!

but still no NOA for the AOS. I guess it should arrive this week. I HOPE!!

    Bless

NOA received in the mail on Monday, Nov. 24.

  7. First of all I want to thank all of you who assisted me in the 15 LOOOOOOOOONG months of waiting for my wife's arrival here in the US.

She is here finally!!!!!! Since September 23rd. Life is good.

I have one question regarding part 2 on the I-485 AOS application. I believe that we check selection (a.), but I'm not sure. It's a bit confusing but none of the other selections seem to apply so I believe this is the correct selection.

She entered on a K-3 visa.

    Any help is greatly appreciated.

Good luck to all of you waiting for approvals. Our situation was unusually long, but I must say that our love for each other is what saved us. Now that we are together, the waiting is all a distant memory.

    Stay strong!!

    Bless

  8. OP, daisychain is correct. You will be the main sponsor, so you will need to fill out a I134. Your father will be the co-sponsor, and should do the same.

If you use the latest version of the I134 (02/28/07) it doesn't inclue the "temporary" part. So fill in that question. If your father is not planning to directly give her money, he can check do not intend.

For my wife I put something like "I intend to support my wife with everything I have for the rest of my life."

Are you currently living abroad or in the US?

Even if your wife has as co-sponsor, you still are the main sponsor, so you should also accomplish a notarized I-134. Moreover, as proof of income, it's advisable to send an original paystub and original letter of employment.

(was in the same situation. My husband was in the philippines for a year. he has a certificate of no file for 2007. his mom was our co-sponsor. we submitted an original paystub and notarized letter of employment).

Hmm.. I just went through my duplicate copy of the I-134. I don't see the "complete this block.." part on item 11.I do see the other sentences you mentioned. But from my understanding, the documents are supposed to be uniform and downloadable from the same USCIS site.

    Thank you very much!!

I have one for myself filled out as well now.

Getting it notarized today and sent down to brasil.

"I intend to support my wife with everything I have for the rest of my life."

    EXACTLY!!!!!!!!!!!!!

    bless!!

anyone else??? i checked "no" and sent to my wife via dhl. She is wondering why I checked "no".

now i'm a bit worried that i should have checked "yes".

is this question intended for someone other than a wife?? a temporary visitor??

    hope someone can help.

    thanks a lot!!

    bless

    ANYONE????

Yes, the same form is used for tourist visas. Although checking "no" is appropriate enough for K1 or K3, the partner's reaction would seem to cast a strong vote for the alternative of "yes" and "I will support the beneficiary as my spouse." Now comes a test of your relationship communication skills. Good luck.

    Thanks a lot!!!

  12. hello all.....

my father will be the sponsor for my wife because while living abroad I can't show with past w2's that I make enough to support her.

    anyhow,

Do we need just one I-134 completed by my father with all necessary documents? Or should I send one for myself also?

I have everything from my father ready to send to my wife, but I'm just making sure that's all I need.

    Also.......question #11 on the form

    11. (Complete this block only if the person named in the item 3 will be in the United States temporarily.)

That I.... intend..... do not intend, to make specific contributions to the support of the person named in item 3.

(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to

furnish room and board, state for how long and, if money, state the amount in United States dollars and state

whether it is to be given in a lump sum, weekly or monthly, or for how long.)

What do I put here?? Its a bit confusing. My wife will not be here temporarily, so I guess I don't need to answer??

    Thanks a lot!

  13. Just wondering if anyone has processed a K3 spouse visa at the US consulate in Rio lately.

My case(I129F) was forwarded down there last friday so it should be there or arriving shortly.

I want to be prepared with all of the necessary documents ASAP, so I'm wondering if anyone has an up to date list of docs.

I have found the list on the consulate website but I would prefer to hear from someone who has actually been through the interview.

    Any help is greatly appreciated!

    Thanks to all of you.

    Hi Jonbless!

I am so happy, now I can finally help you! It feels great to be approved and worry about the final documents, doesn't it?

Well, what I needed to gather

    - 1 form DS 230 (part I only)

    - 2x form DS 156

    - 1 form DS 157

    - K3 visa fee (US$ 131,00)

    - 2 pictures 5x7 with the ears showing

    - Affidavit of support (I134)

    - Marriage certificate and copy

    - Birth certificate and copy

    - medical exam (sealed)

    - background clearance (secretaria de segurança pública)

    - background clearence (polícia federal)

They should be in this order for the interview:

    1. Taxa do Citibank

    2. 2 fotos de frente (com as orelhas aparecendo e com seu nome atrás)

    3. Passaporte (atual e todos os outros que você já teve com visto de entrada nos eua)

    4. Form DS-230 part 1

    5. Dois forms DS-156

    6. Form DS.157

    7. Certidão de Nascimento E CÓPIA

    8. Certidão de Casamento E CÓPIA (se aplicável)

    9. Certidão de Divórcio E CÓPIA (se aplicável)

    10. Certidão de Óbito E CÓPIA (se aplicável)

    11. Serviço militar E CÓPIA (se aplicável)

    12. Atestado de Bons Antecedentes E CÓPIA (Secretaria de Segurança Pública)

    13. Atestado de Bons Antecendentes E CÓPIA (Polícia Federal)

    14. Exame Médico (lacrado)

    15. Suporte Financeiro

    - Form I-134

    - 3 ultimos impostos de renda federais

    - prova do emprego atual

    - prova da cidadania Americana (cert. nasc.)

Please note that there are a lot of doctors in Rio de Janeiro. Your wife will need to take a lot of vaccines (many she can take at public health centers). The doctor will let her know which vaccines she needs depending on her age and background. The doctor will also ask for a chest x-ray and blood test (to see if she has aids or sifilis). Once she has everything the doctor requested, she will have to go back to the doctor. Then he will give her a sealed envelope.

Police background clearences should be requested right now. They might take some time to get done. I also know that people who have lived in Rio need to get a special certificate.

Everything needs to have its original and a copy in the back. The fee can be paid at any Citibank. It cannot be paid at the consulate though. The forms can be downloaded at the Embassy website, but I guess you know that.

Make sure your wife's pictures have her ears showing = A LOT. If they think the ears are not visible enough, they will ask her to re-do them.

Hummm... I guess this is it. That's what I had...

IF you want, I can't send you the packet 3 with all Brazilian Embassy Information to your email. Or maybe attach here later on, since I am at home and the file is at work.

jonbless, count on me if you need anything, ok? I am here to help you and now try to speed up your process.

DO you know when your case arrived at NVC? Do you know when it left NVC?

    Boa sorte!

    Renata

    Valeu Renata!!

    Mandei um email pra voce.
