  1. No. The clerk's office stated that the divorce is filed, legal and valid in my state.
  2. I received an RFE for my K-1 petition asking for “legal proof of marriage termination.” I already submitted my full divorce decree. In my state, uncontested divorces can be signed by a judicially-appointed Special Referee rather than a judge, and the courthouse confirmed that my divorce is fully valid and final under state law. The RFE says the decree is “not sufficient” because it “was not signed by a judge.” The clerk told me that having a Special Referee sign it is standard procedure where I live and that it carries the same legal authority. Has anyone dealt with this before? What should I send back to USCIS to clear this up? Should I request a certified explanation, an affidavit, or some kind of court documentation to prove the decree is valid? I want to respond correctly so the case doesn’t get delayed any further.
