  3. Hi, 2 questions!!

    1) What exactly do i need to apply for a SSN? I entered on a K1, got married and now have my employment card in hand. I don't however have my I-94 as it was sent off for my AOS so what do i need to prove my immigration status?

    2) How do i use my advance parole document? All i got in the packet was 2 peices of paper exactly the same saying that i had permission to re-enter the US with my picture and details on it. Do i need to show it on the way out as well as the way back in, and do i need to take both copies?

    Thanks to you all!

  4. Hi,

I have just received word that my EAD card is being ordered, and am wondering how long it will last for? Our 485 application has just had a second reuest for additional evidence (for ticking the wrong box once then the second time they didn't notice we corrected it!!) so we will probably have to renew it, as our case has probably been delayed by at least 4 months! So how long after it is issued is the usual expiration date for the EAD, and how do we go about ordering a renewal? As we filed our 485, is the renewal also free as the original was?

    Many thanks!!!

  5. Hi all.

I applied for my advance parole document on 30th january (the date they gave me) and have still not heard from it. i am supposed to be travelliung to mexico in 4 weeks and am worried it will not arrive, even tho they are processing after my date and have been for a few weeks! is there any way i can speed this up, or anyway i can travel without this visa? I am still awaiting my green card which will take a few more months. Or am i going to have to swim back? Thanks for your help!!!

  6. hi thanks for your replies, but i sent in my I-94 when applying for my I-485! Does this mean i do in fact have to wait now until i get my EAD??

I think you were only supposed to send a copy.

    15. Evidence of eligibility.

    B. Based on admission as the K-1 fiancé(e) of a U. S.citizen and subsequent marriage to that citizen.

Attach a copy of the fiancé(e) petition approval notice, a copy of your marriage certificate and your Form 1-94.

the way we read it was to send the original, and the customer service representative confirmed this. tho it wouldn't be the first bit of bad advice they gave us....

  7. hi thanks for your replies.

The RFE say in these exact words:

Form I-864 Affadavit of support was submitted, however it was not from the petitioner/sponsor.

Then it just requests we send one in for the sponsor listed on I-129F.

We submitted a form from my sponsor (wife) with the box first of two sponsors ticked. We put on her form her married name. With this we attatched an I-864A from her father who is the co-sponsor and all income requirements and all asked for tax information.

Any more advice based on this post?

Thanks to everyone! At the moment what we will do is just re-send the I-864 for my wife with the box ticked saying she is the petitioner.

Yes, if you'd mentioned that in the beginning, it would have been clear. She didn't check box "a" on the original submission and she should have. Even though her father is supplying an I-864A (as a household member) she is the petitioner and not a "joint-sponsor".

Submit a new I-864, with box "a" checked, and have her include her father's income in the household. She signs the form, he signs his I-864A.

Thanks for your reply. so would just ticking a box wrong mean we get an RFE? How come it says we didn't have one from my sponsor/petitioner? We will try that then and send it in, it's ridiculous though as we rang and spoke to three different people who all said to tick the box we did, they really do know nothing on there helplines!!!

  9. yes we are all in the same residence.

No, so she should have filled in the I-864 since she is the primary sponsor, but since she is also not qualified to meet the requirements, she needs another individual to make up the shortfall. Since her dad is living in the same residence, she could combine his income with hers, on the I-864. Her dad, since he is controbuting his income to help her meet the needs, would fill in an I-864A, Contract Between Household Members. Is that what was submitted?

yes that is what we submitted. On her I864 we put inthe small amount she had made which totals about $5000 a year, then on her dads we put in the full amount which is more than enough to meet the poverty line, and the RFE was only for the 864 not the 864A. Our theories involve that would it matter if we put her married name on the form, and it is different to what they have on their computer, or did we tick the wrong box at the top, and would that be enough for an RFE? I think we ticked the first of two joint sponsors but maybe we should have picked the top box??

  10. Hi today we received an RFE for I-864, affadavit of support. It says it is invalid as it is not filed out by the sponsor.

My wife i assme is the sponsor so we put her on the I-864, yet her dad is supporting us both so he filled in the I-864A in conjunction with the I-864. Why have we received an RFE for this? Should my wife not fill in the 864 and should her dad do it? Then would we need my wife to fill in the 864A ??? Any help would be greatly appreciated.

    Thanks

  11. HI ALL.

WE FILED OUR AOS PACKAGE ABOUT 10 DAYS AGO AND THE USCIS HAVE IT. MY QUESTION IS, HOW LONG WILL IT BE BEFORE I HAVE THE BIOMETRICS, AND WHERE ABOUT WILL IT BE? I AM WORRIED AS WE ARE REGISTERED AS LIVING IN HOUSTON, BUT MY WIFE GOES TO UNI IN DALLAS SO WE SPEND HALF THE WEEK IN DALLAS AND LONG WEEKENDS IN HOUSTON. IS IT POSSIBLE TO MOVE THE APPOINTMENT TO ANOTHER OFFICE OR MUST IT BE ON THE DATE/TIME/PLACE GIVEN? THANK YOU ALL IN ADVANCE

  12. Hi

We are filing an AOS right now. We are just aboutn to send it off but i have one question first.

My wife is the sponsor but she has only made $10,000 the last 3 years betwen them, so we are using her dad as a joint sponsor who makes way over what we need. We have all his W2 and 1099's for the past 3 years, but for my wife we only have tax transcripts and no W2 and 1099's. As his income covers everything and he is our joint sponsor, should we bother to get the W2 and 1099's even though her income won't be assessed? Last thing, after this we are ready to go!!! Thanks
