  1. Hi all,

     

    We received NOA1 for our CR1 spousal visa in mid-September 2020. It has nearly reached the 8 month mark since we filed and we are yet to receive NOA2. 

     

    I have read estimates for NOA2 are 6-8 months. Can anyone share any insights on processing times in 2021? 

     

    Is there any number we can call to see about processing times? Been a long time since we heard from anyone.

     

    We really appreciate any insights. Thank you in advance.

    Since he has actually filed taxes for the years asked about in the I-864, no need for you to be anxious about him not having US-based income for those years.

    Will it matter that no US income was earned, due to his income coming from overseas. I know that foreign income is not counted. 

     

    If he gets a job next calendar year in the US and his yearly expected income is above the threshold is this sufficient without previous income in the US for the last two years?

    Aside from what HRQX noted about the filing requirement, the I-864 form asks: "Have you filed a Federal income tax return for each of the three most recent tax years?"  Your spouse cannot claim that he was not required to file taxes since he earned income above the filing threshold.

  4. Hi!

     

    My spouse and I filed I130 in September 2020. 

     

    My spouse (the US petitioner) was living in Spain for the past two years and working in Spain until mid-October 2020 (he was earning above the US income requirement during this time). He therefore, has not filed US taxes for the past few years. He has just moved back to the US and is looking for employment now. If he gets employed in January or February 2021 with a salary that meets the income requirements, will this be sufficient for him to sponsor me when we need to file I846? 

     

    I am worried that on his next income statement in 2021, he will have only been working for a few months and therefore, have low income on his tax statement. Will his anticipated income meeting the requirements be sufficient?

     

    Just trying to work this out now, to see if we need to get a sponsor.

    Just another question on that :) 

     

    I lived in Amsterdam for just 5 months. I read that you only need police certificates from places you lived for more than 12 months. Is that right?

    Since the petitioner is now living at an address already provided, there is nothing to notify USCIS of.

     

     

    No; however, when the file reaches the NVC, you'll need to make sure that it will be routed to Sydney and not Madrid.  You will be able to tell this by the first 3 letters in the case number (you will want to see SYD).  Until then, there's nothing you can do.

     

     

    Don't bother calling and don't bother with that form; USCIS will not speak to you (they will only speak to the petitioner) and that form isn't meant for use by beneficiaries of an I-130 that is pending a decision.

    My partner (the US petitioner) was living in Spain when we filed I130 and has now moved back to the US. He has moved into the address we listed as our US mailing address. Does he need to notify USCIS of his move back to the US? 

     

    I am an Australian citizen (Beneficiary) and was living in the UK when we filed I130. I have just moved back to Australia. I originally put my visa interview location request on form I130A as Sydney - Australia, as I knew I was moving back. Do I need to notify USCIS of my move to Australia?

     

    I have tried to call them but they do not answer the phone. I have also looked at updating them online with the 'Change of Address' page (https://egov.uscis.gov/coa/displayCOAForm.do) but it only seems to want US addresses (wont allow my Australian zipcode etc). 

     

    Any help is appreciated! Thank you :)
