  1. Ok heres a question; I lived in Canada for 4 yrs before coming back to the states and if I have to file my income for the last 3 yrs it would have to be a canadian income tax because I didn't work up there. Just my husband did. What can I do with that?

    Is the CR2 process the exact same as CR1 in regards to the same forms and process being filed for each?

    I ask this above because I kind of want to follow Jame's shortcuts but want to make sure the entire process is going to be the same first. Can I use Jame's shortcuts which reference CR 1 on a CR-2 for child??? Is the process the same??

    Any takers on an answer??

    Yes, all CR/IR visas are processed the same way by the NVC.

  2. Yes that should be fine. I use just a pay stub and that worked for me. But I was working for the airlines and had my badges also. But you should be fine. Just make sure that you stress you have to be back to work on a certain date.

  3. I have done that a lot and you should be fine. It's not as bad as you think. They just need to see that you are work and will return to Canada. You are lucky you can come to the states. I can't go back to Canada with my husband because they want us to do immigration but we are going to try it back in the states again. But this time without an attorney.

Do I just file the I130 or do I have to file something differant and how do I find out what I have to file and do with this CR-1? I am so confused on this. The first time I file a K-1 and everything else that went with that. I don't want to use another attorney and go thru that mess again. 1500.00 down the tubes and nothing to show for it. I guess you can say I don't trust them. 1 rip off attorney is enough for me.

    So if anyone can help me or lead me in the right direction I would appreciate it.

  6. We are thinking of trying the US immigration again. I had brought my now husband down on a K-1 visa the first time. We were married Aug of 2007. But all went bad from there. Not with us but our so called Immigration attorney. So my husband was fed up with the attorney and went back to Canada. I was also. He has been back there since Aug of 2008. Now I have been hired on at a federal job and don't want to quit to move up to Canada with him. So we decided that we will try again.

    My question are; Has anyone ever tried this before? Should I file I-130 or I-129?

    I am wondering if we are going to have a hard time with this. We have all the papers from the last round on how our attorney messed up. Like telling him he could work with out a work permit. US gov was not happy!!!!

    Any help would be greatly appreciated on this

    My husband and I are in the process of trying to get a credit card so we can build up some credit - I finally convinced him that credit cards are not pure evil.

    I'm the lucky immigrant with zero credit and he has just spent 2 years and some change abroad and has zero credit as well (stupid, stupid, stupid him). Well we both have ok paying jobs, no bills or debt and we live rent free with his family to boost our savings.

    But still we're experiencing a bit of...well...unwillingness to co-operate from our bank (RBC Centura).

    So I was just wondering what everyone else's experience was in regards to getting credit cards etc. and what bank you were with?

  8. Today has been the day from hell. We got a letter from immig. and they said we need to make a appt. with Info Pass. We did that....for reno immgr. went to the appt just to have the guy say...sorry we can't help you. you moved to california so you have to go there. So made another appt with sacramento immgr. and we get there just to hear the woman say. "I am not sure why they put a hold on your I-765.....but she would email them and find out. She did and said we got a letter telling us that they needed more info. Well that was a surprise to us....We never recieved anything from them.

    So she said I will email them back and tell them that....and she calls back this evening to say...OHHH

    they sent it to you Immgr. attorney....So I call him....and of course he doesn't answer his phone..(have his cell #)....so now here we sit....waiting on him.....

    To tell you the truth....I wish I would have lied cheated and just do like all the other ones that do that and get everything done so quickly.....You try and go by the rules and you get screwed....

    Thats what my ex did and his sister did the samething....snap of a finger and they work premits and green cards.... I am guess I am just tired of all the pass the buck stuff. I wish there was a number to call and talk to real live person.....

    Well just need to vent....and I guess I have done that......

You also need to determine if iit better for you to be treated as a non-resident alien or if you want to elect to be treated as a resident alien for tax purposes (because I assume you fail the resident alien tests) ... The answer depends on individual facts and circumstances so the answer is not the same for everyone.

    I am not sure what you mean by the resident alien tests? We have not taken any test yet. We just sent our I-485 and his I-765, in Oct of 2007. He went for his Biometrics appt and we have not heard anything as of yet. So this is why I am wondering if we can file as resident and joint.

  10. It's not that complicated. You're married - so you either file a joint return (married filing jointly) or separate returns (married filing separately).

    One may benefit you more than the other (meaning more or less of a refund), so figure it up both ways and see which is better.

    After my husband and I were married, he went to the SS office and applied for his card. They asked for his passport. He showed it to them and they did the rest. He recieved his SSN within 2 weeks. He is now working here in the states. The company did ask about work permit and our immigrations attorney sent a letter to the company:

    Canadian citizen was legally admitted to the United States as a K-1 Fiance. Such individuals are authorized to work unthe the authority of 8 Code of regulations section 274a.12(6). So I am hoping this is correct. I don't need that kind of worry now. The company did except that from him.

Well, actually we had two immigration lawyers say he was okay to work based on his K-1 status, but the HR department was iffy because of the I-9 requirements, which they were right to be as the HR department was correct. (The I-9 details the requirements for employees that employers must check for. See the requirements here: http://www.uscis.gov/files/form/i-9.pdf) Since one of the sections on the I-9 is "An alien permitted to work until ___ date", you need to have an expiration date, which you will not have unless you have the stamp or the EAD card.

    Thanks for the reply. There's just one thing I don't understand about this. Doesn't the validity of the temporary EAD end on the day you get married and apply for AOS? That's the way I understood it. If so, the validity of the K1 visa is exactly the same as that of the EAD document, which is 90 days unless you get married sooner. In that case, the date you fill out on the I-9 form is exactly the same and it wouldn't make a difference. There's probably something I'm overlooking. But I am just like babblesgirl, looking for the means to make life easier when I finally arrive in the US. ;)

    That's the way I'm reading it too. I suppose though, however much we think there is a way around getting the JFK stamp, cellarlily's experience is probably indicative of how much of a wall there is here. It's incredibly frustrating to me how inconsistent some of the issues are associated with visa applications. I don't understand, for example, why the govt is intent on us not becoming a public charge but makes it difficult for us to actually help support our families unless of course you travel through JFK. Nonsensical *shrugs*

    As far as the SSN is concerned. You just show your Passport to them and they will fill out the rest of the forms. You can also find on here were it tells you about working and getting SSN. My husband applied and got his number 2 weeks later.

  13. We filed all our paper work and the USCIS sent us a NOA stating they recieved it on OCT 16, 2007.....When I last checked to find out if Johns EAD was approved it said still pending. But they are working on OCT 30,2007 EAD....Does anyone understand this stuff. I would have thought we would have recieved something by now.

  14. you can file as either single, depending *when* you got married, or as "separated"

    I filed my last return in Canada as "separated" and did not need to declare my husband's US income whatsoever. The lady who did mine at H&R Block was very knowledgable about what to do with it. Unlike the people I've met here at H&R Block in the US who really had no clue what they were supposed to do with our taxes here. :huh:

    I know what you mean. I am trying to get ours done here in California. (at H & R Block)....they told me we have to file seperate returns. That would me a loss of about $2000.00.....so I am looking for some who knows what they are doing now.

  15. Can only help with the process of filing income taxes? They told me today that we can not file a joint return. The reason givin was because my husband is still not a permanent resident yet. We are still going thru the immigration process. I am getting really upset with all of it. He lives here with me and we are legally married. We were married last Aug. Or could someone give me a name of someone in northern California who does these kind of taxes? :crying:

  16. Well my husband and I are going to call it quits. We were married in Sept of this year. We have just started the process of Green Card. He has not been approved yet. We had to get a sponsor and now I am wondering if he can stay in the states or does he have to go back to his country. I want out because of his drinking and mental abuse. I just can't take it. Can anyone tell me what will happen to him . If he could stay in the states thats ok with me. I just don't want to be with him anymore. I am so unhappy it's not funny.
