  1. If you are a PIO and your Spouse/Fiancé is a PIO and you are both Hindu.  The Hindu Marriage Act covers Hindus outside of the territory of India.  If you Not Hindu or Sikh, you have to marry under the Special Marriage Act if you are a foreigner marrying an Indian Citizen.  

     

    Example: You live in the US, you are a PIO or OCI holder and your fiance is living in India, hold an Indian Passport and you are both Hindu, you can marry under the Hindu Marriage act

     

    Example 2: You live in he US, you are a PIO or OCI holder and your fiance is living in India, holds and Indian Passport and you are not both Hindu, you have to marry under the Special Marriage Act

     

    Example 3: You live in the US and you are Not a PIO/ OCI holder and your fiance is living in India, holds and Indian Passport, regardless of religion (except for Sikh) you must marry under the Special Marriage Ac.
