  1. Hello guys,

    Finally after 4 months since they received our papers (I-130 and I-129F both sent at the same time)

    they just cashed the check on January 2, and I got the NOA1 2 days after...

    It sucks that it took them that long just to cashed the check and sent the NOA1 for the I-130.

    Now i wonder how long will it takes for them to send us the NOA1 for the I-129F and the NOA2 for both (I-130 and I-129F)

    We are keeping our fingers crossed....goodluck to all of us guys!

  2. Do you think it will be ok if my husband will send both directly to the Chicago Service Center?

    We've heard that the Texas Service Center dont accepts I-130 and I-129F petitions anymore, thats why

    anyone who send in theirs to Texas SC were being transferred to California Service Center.

    pushbrk said to send them to Vermont SC. So which is which? California or Vermont?

    I filed my I-130 and I-129F packages together and have now received NOA1 for both petitions. Both petitions are already displayed on the USCIS web site. I filed the petitions simultaneously on the advice of a USCIS officer. While I am far from an approval, this would suggest that joint filings are acceptable to USCIS.

    Several members have received this advice and a lot has been said about it in the forums. Now we have some evidence that it seems to be an accepted procedure. I sent the packages before the July 30 fee change so I cannot be sure that this will continue to be accepted procedure. I was given this advice by the USCIS officer partly to avoid any problems related to the fee changes. Strangely enough, my NOA1 for the I-129F states that the fee was waived. This is odd since I sent it prior to the official fee change and only paid $170 for my I-130 petition.

    I simply wanted to share this information for others considering joint filings. Instead of making recommendations, I will leave it to each person to draw their own conclusions.

    For those that are interested in filing simultaneously, here is how I put together my packages.

    I created a separate package for each petition based on the K-3 guides and General Assembly instructions. Each package was bound with ACCO fasteners, each important item was tabbed along the bottom and each package was put into a separate envelope. Each package had a separate cover letter. Both packages were put into priority mail envelope along with an additional cover letter explaining that I was filing both petitions simultaneously.

    Here are the contents of my packages.

    Joint submission cover letter.

    I-130 Package

    I-130 Cover Letter

    1. - Payment in the amount of $190 (Money Order)

    2. - Form I-130

    3. - Copy of birth certificate for JC (Petitioner)- 4 pages

    4. - Copy of notarial Marriage Certificate (Spanish)

    5. - Translated copy of notarial Marriage Certificate

    6. - Addendum in reference to notarial Marriage Certificate(this explains the discrepancy with regard to wedding date. Per USCIS officer instructions)

    7. - Copy of divorce decree for JC (Petitioner)

    8. - Form G-325 for JC (Petitioner)

    9. - Passport style photo for JC (Petitioner)

    10. - Form G-325 for A.L.L. (Beneficiary)- 4 pages

    11. - Passport style photo for A.L.L. (Beneficiary)

    12. - Evidence of bona fide marriage

    A. - Life insurance beneficiary form

    B. - Receipts for money transfers from petitioner to beneficiary.

    C. - Copies of travel documents from petitioner visits with beneficiary

    D. - Photographs of petitioner and beneficiary

    1. - Payment in the amount of $170 (Money Order)

    3. - Form G-325 for JC (Petitioner) - 4 pages

    Let me reiterate that this is simply my experience and you should not count on it as "law". If you are interested in filing simultaneously, you should consider speaking to an officer at the USCIS phone center. You will have to speak to a customer service rep and must ask to speak to an officer.

  3. Hello to all. my husband is going to send both of the petitions together. He said he will send them tomorrow.

    We are so excited. We hope and pray that everything will be fine...

    By the way since he is confused as of where to send the petitions, he said he will send them to

    California Service Center...hope it will be ok!

    I also filed both of mine together in April and I have not had any problems, they were both received and I got NOA 1's for both petitions. :yes:

    What is the complete URL for the second link that you posted? It did not post correctly.

    Also, I just looked at the new I-130 form that was published 7/30/07. It still directs Florida petitioners to file the I-130 at TSC. As I mentioned, it will be transferred to CSC. It seems a bit roundabout, but this does appear to be the current procedure.

    Im really really confused about it. By the way this is my wife's account i am using.

    So where should i really have to file our K3 petition?

    Some people say here to send it to Texas. Some say to Vermont.

    Which one really it is? I'm in Forida by the way!

    If you are filing an I-129F petition for your spouse, mail your petition to the Service Center where the underlyingI-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F.

  6. If the LPR can ONLY petition for the relatives you mentioned,

    how come my friend from Washington, she was able to get her younger brother.

    Besides he is already here. He got here last month...And my friend is not a US Citizen though.

    This is for a LPR petitioning a parent right? It clearly states on the I-130 Instructions #2

    If you are a lawful permanent resident of US, you may file this form for:

    A. Your husband or wife

    B. Your unmarried child under age 21

    C. Your unmarried son or daughter age 21 or older

    Therefore, ONLY a US Citizen may file for mother or father (USC must be age 21 or older) using I-130

    I will be filing for both my parents next year.... the process for them to get here is simmilar to a LR1 visa for a wife.... the visa they will get is called an IR5 it takes about a year from the time you file the I-130 to them getting the IR5 visa to come over....

    Remember that this is for a spouse but the forms and procedures are almost the same.... you just dont need to prove a marriage....

  7. I feel sad for the parents. If they were my parents I would want them to stay at the same house with me especially

    that they are already old and dont speak english. That would be too hard for them to move out by themselves. How long

    they have been here?

    We have some good friends who are in their mid 60's who immigrated from China through their son to the US 3 years ago. They are living with their son and daughter-in-law and 2 grandchildren. The son and daughter-in-law are both Chinese but now have their US citizenship The daughter-in-law wants them to move out and into HUD federal subsidy housing because she says the current situation with all of them living together is creating a lot of friction. Neither of the parents speaks any English and they are both very upset about this entire situation. Both parents do have social security numbers but have never worked in the US.

    My question is: Did the son, as his parent's sponsor have to fill out the I-864 for both of his parents and does this filing prevent them from going on public assistance? I also wonder if they do succeed in getting into this public subsidy housing if one day HUD's computers tie into USCIS computers and uncover this scam.

    To sum up the situation, these are 2 elderly Chinese parents who have never worked in the US and are asking the federal government to subsidize their housing and I would also imagine they will have to apply for food stamps so they can eat.

    I just want to make sure where to send in the petition.

    I know in the forms it says that if you live in Florida then the petition should be sent to:

    But then i heard that Texas SC is no longer accepting petitions for I-129F and K3.

    I also got a message from a member here saying that they are from Florida and they

    send theirs on Chicago SC.

    So thats even more confusing. Dont know which is the proper service center.

    My husband has filed for K3 for me at Texas service center and he also lives in Florida.

    We filed I-130 and sent it to Texas SC. And I-129 to Chicago Center where i think it says on where to send on that form.

    Your filing location will depend on the US Citizen's State of residence. Start here:

    You'll find a link to the filing chart for I-129F in that document. Please read the document first.

    Because our I-130 will be transferred to the same location, (either California or Vermont) the most efficient way to petition for a K3 visa process is to send both petitions together in the same envelope to the same address. Then your proof of filing the I-130 is in the same envelope as your I-129F petition. There is no need to wait for "proof" to be mailed back to you because it's in the envelope.

    I see your husband is from Florida. Florida files in Vermont now, not with Texas. TSC no longer processes I-130 or I-129F petitions.

  11. I was wondering if anyone has ran into this problem. I was recently married to a very beautiful filipina and I can't wait to get her here. When she picked up the local certified Marriage certificate she noticed that the suffix "Jr" was missing from my name. On the application there wasn't a spot to fill it in but it was on my legal capacity to marry from the US embassy and also on my passport. My birth certificate has "Junior" spelled out and this is causing confusion in trying to get it changed. Is it necessary to get the Marriage certificate changed? Does anyone have any suggestions?

    You have to get a joint affidavit to prove that its you or that its the same name of yours.
