  1. I had my N-400 interview based on marriage 2 months ago. I passed English and civics exams. Yet IO couldn't make a decision because she did not receive my "A" file from TSC. I made an info pass a couple of weeks ago and talked to INS agent. Basically, all she did was to notify TSC to send my "A" to the local USCIS office. Meanwhile, the form I received from the interviewer ( I think it's N-625 or something...!!) says that USCIS must make a decision within 120 days or I can file a case in the district court against the IO and request the reason behind all these delays. Moreover, I sent an email to my senator a week ago and I haven't heard from them yet. I'm also planning on involving an Immigration attorney if it's not too late for that...

    Does anybody have any idea about filing a case in the district court in case they don't make a decision for my N-400 within 120 days? and does anybody know a thread to an immigration attorney?

    You help is appreciated.

  2. Filed for N-400 and had my interview in March 24, 2008 but my I-751 is still pending. IO said that she didn't receive my "A" file (I-751 file) and she couldn't make a decision for my N-400. She mentioned that she would call TSC and request my "A" file. She also said I might have an interview for my I-751 before getting the final decision on my N-400. From what I understand, my I-751 must be approved first then they can make decision on my N-400. The weird thing is that they sent me the interview letter from TSC knowing that my I-751 was and is still pending. I don't know what's going on over TSC but I'm put on hold and I don't like this situation.

    Further, I called USCIS and they said that I should wait for 30 days and if I don't hear from either TSC or my local INS office, then I give them another call...!

    I sent my I-751 in Nov 2006 and it's still pending because of the delays USCIS stuck in since last July...!!!

    Folks, what is the next step to follow to get this done? and do you think hiring an attorney could speed up my case?

  3. I filed to remove my conditional Nov 06, Bio Dec 06....I filed through TSC...still waiting.

    My extension letter will expire Feb 08. Since I'm going on trip overseas, I want to make sure that I won't have any issues with custom/service on my way back. So I requested an Info Pass and went to the local office this morning. They were nice to me and they did stamp my passport, which extended my residency another year, but they kept my expired GC. They said "I can't have both". Meaning, expired GC and stamp on my passport.

    I'm actually going on trip with my wife next week and I wonder if the passport stamp ( a year permanent residency extension) is enough to go through the customs on my way back without any issues (especially overseas customs)???

    and does it make any sense for local INS to keep my expired GC?

    I know it's already expired but it's still considered as a proof for my legal residency.

    Any help is appreciated.

  4. OKay TSC filers,

    I called INS customer service about 2 months ago and I received a letter from local INS stating that my case is still under background check and if I don't hear anything within 6 months from the date I received that letter then I must call them back. I called today and the INS agent told me the same thing (what the system shows basically). I also asked him "if I'm eligible to file for N-400 since I'm married to USC and I can file within 90 days before the 3rd year from receiving my CGC. His answer:-------> I AM NOT ELIGIBLE TO FILE FOR N-400 BEFORE RECEIVING MY 10 YEAR GC even if I have a legal conditional status or specifically expired conditional GC and extension letter from INS???

    Further, this was the most confusing thing I ever heard from INS guys..!!!

    Anyway, do I have to listen to the INS agent or I just go ahead and file my N-400?

  5. The last approved case from TSC was June 18 as far as I know. I got my NOA in Dec 2006 and my case is still pending. I have a friend who got his NOA last Sep and he is still waiting...So I am asking again and I do need some help from you guys... Is there any legal way to check my case other than call customer service ( I did call them last July and the machine kept telling me to call after 30 days)?

    I will have to gather all the paperwork and evidence showing that we've married for more than 3 years.

    Right now I have the following:

    - Tax returns for the last three years.

    - Pics before and after we got married.

    - Life insurance statements. (I put her on mine and she puts me on hers)

    - Some bills with both our names.

    - Car insurance with both our names.

    - Car title with both our names.

    - She added me as authorized user for her credit card and I did the same.

    - We do opened different accounts in the same bank. I don't know how that will work for us. I may just go ahead and add her to my account.

    - Airfare tickets for trip overseas next December. ( I am still waiting for my 10 yrs GC, hopefully I get it by then. But I do have my NOA and expired GC I can use for my trip next December).

    - I can get two letters from our friends stating that we've been married and lived together for the last three years.

    - Copy of Marriage license.

    - Copy of my expired GC

    - Copy of my NOA for I-157

    - Copy of my work permit I received in 2004

    - Copy of NOA for the adjustment of status...( old stuff as proof of our marriage for the last 3 years)

    I did sent the same package to remove the conditions....

    Do you guys have any other suggestions...??

  7. As the USCIS implies on the processing times page, if your NOA 1 date was before January 13 (as of mid-July) and you still haven't been approved, you probably have other problems with your petition (RFEs, etc.).

    I beleive I sent the stuff they requested and I got my NOA1 10 days after I sent my application. I also had my BIO on time and every was fine. I remember when we first applied for K-1 at the TSC and it took us about 9 months to be approved. Now we are experiencing the exact same thing... DELAYS and more DELAYS.

    I am hoping I can hear something very soon...

    I do have a question: is there anyway to request another extension if the case is still pending after the one year extension is expired...? Or maybe go to local INS and stamp the passport???

    Just curious if you two went through AOS previous to removing conditions, I know some people get different visas that don't need AOS. Anyways, I was curious if you had any previous delays due to background/name checks? My husband had a delay of AOS approval due to the name check, and I was curious if that would delay approval when lifting conditions as well.

    Have either of you contacted you local Senators or Congressmen? We contacted our Senator's office during our AOS process, and they helped us very much.

    My AOS was smooth.. I mean it took me about 7 months to be approved. You maybe right about the name check process but it is still taking to long to run a background check on my name and stuff...!

    In addition, I don't know if contacting local senator or congressman, it may take forever to see one of them...!!

    probably, this will be my last option.

    I haven't heard from TSC processing center since I had my biometrics in Dec 2006... Also I haven't seen any approved cases since June 19, 2007... So I don't know what's going on over TSC..!!! Whenever I call USCIS, I get the same thing..(wait for another 4 weeks then call back) FYI, I wasn't able to talk to any of the USCIS officers..!!

    How can we get some info about our pending cases or how can we talk to somebody in TSC instead of talking to a computer? and is the Info pass thing on USCIS site worth to try???

    What are the procedures to follow in case my case is still pending after one year eligibility to work and travel overseas? I mean is there another option or procedure to follow to extent your temporary residency and be legal???

    If you guys have any info about these issues, please provide me with what you know.

    I had my BIO on Dec 8, 2006 and still waiting.... I called twice to follow up with USCIS and I couldn't talk to anybody.. All I got computer thing saying that I had to wait... So I am waiting...

    I just came back from a trip overseas and I had no problem getting back in. my case still pending that I submitted on Dec 2006 to TSC, and since Biometric appointement which was on Jan 11 2007 nothing heard.

    when was your biometric apointement? and have you tried to call TSC to inquire about your case?.

    Please share if you have any info.

    I filed for I-751 to remove the conditions Nov 2006 at TSC. My case is pending and I haven't heard from them yet...! My conditional card has expired Fev 2007. I did receive a letter from USCIS extending my status for another year. I do work and go to school for my bachelor degree.

    My concern here is that I am planning on going overseas next December with my wife and all I have as proof is my expired GC and USCIS letter. Will be there any issues with custom service if going overseas and coming back to the states? I mean are the expired GC and letter enough for me or do I need to get an additional USCIS document proving that I am legal in the states?

    Also is the one year thing means I am legal since the day I received it or since the expiration of my GC?

    I appreciate your advice and help in advance...
