  1. I have my AOS interview in a couple of weeks. I submitted I-864 (co-sponsor and sposue sponsor). My cosponsor enclosed her most recent tax return, W2s, and also recent paystubs (even though that was not required).

    My notice for interview states the following: (to bring with me)

    A completed affidavit(s) of Support (I-864) with all required evidence, including the following for each of your sponsors (unless already submitted)

    - Federal Income Tax Returns and W-2s, or certified IRS printouts, for the past 3 years;

    - Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 months;

    - Evidence of your sponsor's and/or cosponsor's United States Citizenship or Lawful Permanent Resident Status

    My cosponsor only enclosed her most recent tax return. I guess she should get me all of her tax returns from the last three years. My cosponsor did not enclose an employment letter (which was not required), but I guess I need one now. Finally, paystubs for the last 2 months were enclosed in the initial application, but perhaps best to get two "fresh" ones (even though I filed the application in the end of June this year)

    Has anyone some recent interview experience, and whether they wanted tax returns from the last three years (or whether the most recent one was sufficient). I am just a little puzzled. It is my understanding that earlier you had to submit employment letter, paystubs, tax returns for the three most recent years. Then, it was changed, and only last year's tax return was required when filing. Now you apparently need all the info again.... (but only at the interview)

    Also, I should probably bring original evidence of cosponsor's citizenship...? (filed a copy in my application)

    Any thoughts??

  2. I was able to get an interim EAD for about a month ago. I brought an employment letter, the IO had a look at it and then went to his supervisor. They approved my interim EAD on the spot. I had to do the biometrics again and had the interim EAD about 10 days later. However, I believe the policy changed just a few weeks ago, and there is longer possible to get this interim EAD. Nevertheless, make an infopass, explain your situation, and bring an employment letter. It could work.

  3. I have no personal experience of this, but it appears that USCIS made an error.

    "If the sponsor did not file tax returns for any reason other than their gross income was below the IRS filing requirements, include a copy of the provisions of any statue, treaty, or regulation that supports the claim that he or she had no duty to file an income tax return with respect to that income."

    A required reference to a statute is only needed if you "did not file tax returns for any reason other than their gross income was below the IRS filing requirements" You did not file any taxes because your income was under IRS filing requirements and no reference should be needed. I would include a copy of your earlier explanation, and then describe even more in detail why you did not file taxes. Maybe make a reference to Publication 501 stating that you are under the limit. http://www.irs.gov/publications/p501/ar02.html#d0e490

    I don't know much about taxes, and maybe you were required to file taxes if someone claimed you on their return or if you received any grants - funding for your studies

    Hi all,

    My husband had his biometrics done on 8/18/07 in New Rochelle, NY. I wrote about his experience and posted it in the AOS forums if anyone is interested. It's posted under "New Rochelle, NY biometrics experience" Basically, all went very well.

    Also, we got RFE's in the mail today! :wacko::unsure:

    I have a question about the first request, I hope it's okay to post here about that. I will also post in the general AOS forums just in case.

    The first piece of evidence they want is my tax returns, BUT I had clearly explained (I attached a letter of explanation to the I-864) saying that I did not file taxes for the most recent year - 2006 - because I was unemployed, here is what I actually wrote:

    "I did not file taxes for 2006 and 2005 because I was unemployed both years. At the time, I was attending Purchase College full-time during the 2005-06 academic year."

    I also included an unofficial transcript from my college to show my attendance.

    I had thought that what I had sent was going to be sufficient evidence :-(

    In the RFE it states:

    "If the sponsor did not file tax returns for any reason other than their gross income was below the IRS filing requirements, include a copy of the provisions of any statue, treaty, or regulation that supports the claim that he or she had no duty to file an income tax return with respect to that income."

    So does this mean I have to find some "statute, treaty, or regulation" to send to them? Where would I find this crazy piece of evidence? What do I do?

    I included my parents as household members and they filled out the I-864A forms, and they need to send things according to the RFE's, too. I have questions about that too, but I will post that at another time.

    Has anyone else out there ever gotten an RFE like mine - requesting evidence from someone unemployed and having to send a "statute or treaty" supporting the 'claim'?

  4. Also, it may not be an error at all.

    I was in the United States on a F1 Visa and OPT. When I received my NOA1 (for AOS), the number was different from my earlier alien number. I called up USCIS, and they told me that a new alien number is assigned when you are applying for AOS. My new alien number was totally different from my earlier, the operator said that was fine, but also told me that they usually only change one digit (which could be your case).

    Of course, there is probably an error if your alien number on your biometric appointment is different from your NOA1, and if that is the case, I would bring both NOA1 and biometric notice to the appointment and point out the discrepancy.

  5. I would suggest that you provide more facts. Your current statements are rather conclusory; provide some facts. Also, you need to clearly state out name and address of the person making the statement.

    I suggest the following:

    1. Full name, address, and phone number of person making the statement

    2. Describe the person's relationship to you and your spouse

    3. Give some specifc facts, e.g. they attended your wedding, they know you were going out before getting married, how happy you were about the marriage, etc -- facts SHOWING marital union - compared to just stating conclusory that you and your spouse live in a marital union.

  6. I know that we are far away from interviews/transfers at this stage, but I've seen that some are transferred to CSC and other applications are sent directly to the local USCIS office. And, at least the way I understand it, if your appication is sent to CSC you will most likely not need an interview at all.

    So... what criteria determines if your application is sent to CSC or to your local office?

    I just found this forum and thought I should add my info as well.

    June 27 Filed AOS/EAD

    June 28 Received in Chicago

    July 9 NOA 1

    July 30 Biometric

    Also, I got a touch today today on my I-130 and EAD, does anyone know what it could be?? (it's not about the biometric since I received the notice for that on Monday last week). There is no info about the touch, just the fact that it was updated today July 20.
