  1. Hi Viktoria,

    My parents had their IR5 interview last month in Peru and they brought photocopies of everything I sent to NVC only... I didn't send them copies of I-130 approval.

    At the interview, the consular office didn't ask for any of that. As a matter of fact, the officer returned the photocopies that I had mailed to the NVC.

    At the embassy, they only asked my parents for the interview appointment letter, medical envelope, 2 color photographs 2"x2" and their passports... Nothing else...

    I called NVC and I got 2 different people w/ 2 different answers. I don`t know what to do.

    My mom compleetes the Forms DS 230 She is DIVORCED

    on qst 14 Spouses name

    qst 15 date and place of birt of spouse

    qst 16 address of spouse

    qst 17 Spouses Occupation

    qst 18 Date of Marriage

    Again my mom is divorced now. On qst 14 through 18 does she put N/A oe compleete the information

    I called NVC twice , first time the guy told me put N/A on all

    today I was in doubt and there was a lady on the phone and she said if you know the information complete it even that divorced.

    Complete the Form best to your knowedge. Blabla bla If you don`t know some of the info put UNKNOWN

    Please what do I anser

    N/A or I compleete the info since we know the info

    In what occupation do you intend to work in US?

    My personal answer is I dont know, so what do I answer. Unknown

    Is it OK to answer UNKNOWN

    or I can put Cook or Hairdresser since that`s what my mom is doing in her country but I don`t know if this some how can be a problem since they have different certificates here for this occupation.

  5. My wife just received her citizenship. She would like to apply for her parents to come to the US as PR status. She is from Taiwan. Once we submit the apps, about how long will it take?

    Also, can she apply for both her parents and sister at the same time? I understand it can take up to 10 years for a sibling application.

    Parents of a US citizen are immediate relatives under the category of IR5.

    It takes the same time as for other immediate relatives like a spouce of a USC.

    So 6-12 months for the parents?

    Yeah, I would say it's around 12 months.

    It looks it is now taking 6 months for I-130 approval at CSC.

    It does not always take 6 months for the I-130 to be approved by USCIS. So far it has taken just over 2 months from the day I mailed the I-130 for both my parents, we are now under final review at NVC and should have a interview date for July, if we do get the interview in July then it will have taken just over 4 months from mailing to Visa.

    On the average 8 months everything

    6 for USCIS and 2 for NVC, more or less

    BOTH are correct

    its just NVC changed its address recently to the first one

    so just send it using the first address (31 Rochester)

  8. None of the I-864 forms need notarization.

    The I-864A does not have a place like the other I-864 forms for a notary, it uses the same language as the other forms, and does not need to be notarized.

    Some editions of the Form I-864 and Form I-864A include a jurat to be completed by a notary or by a consular or immigration officer to show that the person signed or acknowledged the signing of the Form I-864 or I-864A under oath. The Form I-864 and Form I-864A, however, provide that they are signed "under penalty of perjury." Thus, 28 USC 1746 (which deals with the legal effect of unsworn statements) makes it unnecessary for Form I-864 and Form I-864A to be signed in the presence of or certified by a notary public or an Immigration or Consular Officer. Note that the jurat has been removed from the January 15, 2006 edition of the Forms I-864 and I-864A. Form I-86EZ is a newer form, and therefore never had the jurat.

    Are the Affidavit of Support forms required to be notarized?

    No. The sponsor just has to sign the form. You should know however, when the sponsor signs an Affidavit of Support form, he/she certifies that the information provided, transcript and/or photocopy of tax documentation is true and correct, under penalty of perjury.

    Sometimes the webpages are overlooked and have wording for the older forms. If the form itself complies with the new format that does not need notarization then no notarization is needed.

    Moving this to NVC forum, I-864 is NOT needed when filing a petition, it is needed when NVC requests it.

    I am very happy to hear that I don`t have to deal w/ notarization and so on but look what it says here.

    Where to File :

    Should be filed with Form I-864, Affidavit of Support Under Section 213A of the Act.

    The signatures on the I-864A must be notarized by a notary public or signed before an immigration or consular officer.

  9. We're getting ready to file AOS for my wife's mom. I will file I864A as a household member as my wife doesn't work. I know she has to fill out I864 as the primary sponsor. My question is: Does she have to send any supporting documents alongwith her I864, as I'd be sending supporting documents with my I864A anyways? Our taxes, assets, etc are joint.

    The only supporting information for her would be if you are trying to proof that she works and her income but if she doesn`t work and you put 0 income and use your information to meet the requirements than is more than enough. May be marriage certificate to proof your relationship as a spouse and copy of ID that you live together in the same household, but you can see this on the tazes since you filed jointly. There is no need for letter she doesn`t work. 0 income is exactly what that means. As long as you proof your income and relationship to your wife and household as I said above you will be fine.

  10. You posted this to "Bringing family members of US citizens to America" forum which has to do with bringing children, Parents, or Siblings to the USA. Who are you sponsoring??

    Is your husband a resident of the USA? If so the you can add his income to yours, he will provide an I-864A as a member of your household.

    As I said in my first post I am sponsoring my mom. I know I can use my husbands income but I don`t want if I am OK w/ my individual income, that`s why I was asking if NVC compares the Poverty Guideline Class w/ my current annual income or w/ the gross adjusted income in question 25.

    I have question again. Thank you in advance.

    I am sponsoring my mom , on form I -864 in my case the Poverty Guideline Class is $25 000

    On question 23. My current individual annual income is $34 000 but

    on question 25 Federal Income Tax return information they ask for adjusted gross income based on IRS Form 1040EZ

    2008 $26 000

    2007 $24 000

    2006 $25 500

    Since my adjusted gross income in previous year was under $ 25 000 I am concerned.

    Do they compare the Poverty Guideline Class in this case $ 25 000 w/ my current individual income or w/ my adjusted for the prevoius years, or all of it. If all of it I can use my husbands income too. Can`t decide to use just my income or both of us in the household.

    My mom wants to come and stay with us in the US, meanwhile my dad doesn't. Is it ok for me to file the paperwork just for her? Will it cause any problems at the interview, does anyone know?

    It should not.

    In my opinion you might have a problem.

    When I filed for my mom they spesificaly asked for the divorce certificate. (Usualy this is not required to submit)

    They might treat that like you are breaking their mariage and have the right to tell you NO.

    I would sugest since they are still maried to apply for both and since your father doesn`t want to come to US just to go through the process and get the visa and then he doesn`t need to actualy come here.

    That`s the safest way to go and I would probably do that.

    My sister just had an interview yesterday 4/16/2009 in manila embassy. she was petitioned by her husband thru K3 visa. Now my brother-in-law didnt able to reach the poverty guideline family of 3 which is $23,000 and my sister was advised by the people in the embassy that she has to get a co-sponsor in order to give her a visa. anyway, the interview went well and visa is pending for submission of co-sponsor papers.

    Now, I am in the process of adjusting my status, because I just reached my two years conditional residence last April 10, 2009. Also, my husband is currently petitioning my 10 year old son from Manila. The question is, Can I co-sponsor my sister without any effect on the ongoing petition for our son, by the way, it's my husband's name declared as Petitioner? My husband and I filed Tax jointly.

    Please help us, I want to help my sister. My husband and I Annual tax together this year is $65,000. Will it be possible?

    Everytning is possible if you meet the Poverty guidelines. Do the math very careful. In my opinion but please check with NVC to be sure if you become a co sponsor for your sister than when sponsoring your child I would use both of yours income $65 000 and in this case you will have to list that you are co sponsor also for you sister so in this case in the worst case the poverty gudeline class will be for 4 people. You, your husband, child and the person you are co sponsoring. The gideline class for 4 people is I believe $ 25 000. In this case you guys are just fine. It`s completely possible even not use your income even when petitioning your child. Just make sure you meet the number they are looking for and + just to be safe. This is just my opinion. Good luck
