  1. Let's say that lady has entered the US via K1 visa. She entered the US on August 2007, so it's 18 months since the day she got here until today. But during that 18 months, she's bêen spending more than 5 months in Vietnam already ( April 1st 2008- July 1 2008 , and Feb 27th , 2009 until now) and continuing to stay in Vietnam for a very long time.

    Her situation:

    She has a temp grêen card, which will expire in Dec 2009

    She has a 1 year old kid with the petitioner, who is a US citizen and got a US passport, currently living with her in Vietnam.

    The husband has bêen asking her to come back to the US for several times but she made up reasons to decline, therefore the husband thinks that she just waits for the right time to come back here for the 10 years grêen card.

    As you can sêe, this is not a love based marriage on the lady's part, so the husband doesn't want her to come back to the US anymore. Is there anyway to stop her from coming back ? Can he divorce her without her presence in the US ? Can he take full custody of the kid and bring the kid to the US ?

  2. I need some help. Packet 3 asks for last years tax transcript, but that won't be available for 2008 until after Thi has her interview. They say they may accept w-2's and a certified copy of your tax return. I am doing my taxes now for 2008, how do I get a certified copy of the tax return for 2008 and I get 1099's, not w-2's...why don't they mention 1099's being acceptable? :-( helpppppp

    Also, does HCM allow sponsers for k1? I was going to bring a back-up just in case...what forms does the sponser fill out? Is it just the I-134 or something else? thanx for any advice here guys. so confused. :unsure:

    If the interview is before April 15, then the 2007 tax year is just fine.

    Make sure you have a tax transcript, though. You can order one over the phone, (800) 829-1040, and it will come within about a week. The transcript basically just proves that you actually paid such and such amount of tax into the system. A copy of your return doesn't actually prove any tax was paid. Good luck!

    and if you have a fax machine, you can ask them to fax the tax transcript to you so you can have it within minutes. Some agents will not do that for you, then you just hang up and call them again to get to the agent that is willing to do it.

  3. it looks like you are not well prepared. I think ME doesn't work on this personally, otherwise you wouldn't have this problem. ME helped me out before and those things you mentioned above were well prepared by me because ME told me to do so .

  4. What should I do next ? She's here a month already but when I bring her to apply for a SSN they told me that I need to get her a green card first.

    What forms and steps should I follow?

  5. It was 2pm in the afternoon and I went inside the HCM consulate to renew the visa for my daughter, so I happened to sit in the big room where people were waiting to be interviewed for all types of visa ; k1, k3, cr1 etc .

    So right in front of where I sat was window number 11 . The girl was being interviewed by a white mean male, aged about 45-55. The translator was a lady in her mid 30 and she looked so SEXY . I kept looking at her breast all the time .

    Anyway, while the girl is being interviewed, her SO or husband stands about 10 feet behind her, looking VERY SERIOUS .

    After asking the girl all types of questions , evidences etc, the white dude waves the her SO over and started asking him.

    At first, the interviewer asks him in English but that dude doesn't know English very well so the translator must translate for him ( a negative point there) .

    so they chatted for a good half an hour then the interviewer told him that everything is ok now. she PASSED . The dude was so happy , and while collecting his papers, he said in English something like this " Oh god, I'm scared, I'm sweating" . The interviewer was like " All I did was asking you questions, why are you scared? " then he told the translator to

    take back some papers and keying something in the computer, then proceed to ask the SO again ........ this time it takes for like 15 minutes and the interview told him to wait.

  6. I went to the Social Security Admin office to apply a SSN for my step-daughter, they told me that they need a Work Authorization form (since she's on 4 years old) to proceed , and/or a green card .

    Is that right ?

  7. hmmm, I don't know. but they asked my wife to go back to San Francisco to have the marriage license notarized .

    I was like ####### ? so if an American happens to have labor in Vietnam, she must fly back to the US to have her marriage license notarized by the Vietnamese consulate and bring it back to Vietnam, then they can continue with the process so they can take their kid out of Vietnam .

    This is the most stupid thing that I've ever heard of .

  8. My wife is a permanent resident of the US, I am a USC .

    My wife gave birth to my daughter last month.

    When my wife brought my kid to the consulate to report a Birth Abroad, the consulate asked for my daughter BIRTH CERTIFICATE *Khai Sinh* the paper from the hospital where my wife had labor is invalid.

    My wife went back home and go to the local government office to get a Birth Certificate for my daughter, the local police department told my wife that our marriage license is INVALID , she must take it to the Vietnam Consulate in San Francisco to have it notarized . ####### ???

    What should I do now ? I'm flying to Vietnam next wêek for this mess .

  9. Do you know how long it will take to have the passport ? And what address should I use for questions 13 and 14 in the Application for a US passport(I don't know if I should use my address in the US or the address in Vietnam so they can mail the passport to.) ? . We plan to bring our daughter back to the US on June 26th , 2008 .
