  1. You have to have been married for 3 years AND have held a greencard for 3 years AND have lived in the USA with your Spouse for 3 years.

You may apply 90 days before the 3rd anniversarry of you getting your greencard as long as you meet all the other requirments.

Thank You for taking the time to answer.

Does the conditional greencard count or only the 10-year green card?

A Greencard is a greencard, you became a LPR the day you were approved for your Greencard, the fact you had to file to remove conditions does not make any diffrence.

Thank You for answering again. That clarifies my confusions!

  3. Hello everyone, I have a question regarding -When to file- and eligibility. I have looked online but find the answers different each time and slightly confusing and was hoping I could get help from you.

I will hopefully receive my 10year GreenCard within the next few months. My husband and I have been married for almost 3 years.

I have read that you can apply for Citiznship after being married for 3 years but somewhere else I read you need to be a permanent resident for 5 years? Now if the second part is true, does conditional residence count or do you start "counting down" as soon as you become permanent resident? I am so confused...

Any insight would be greatly appreciated!

  4. If your 90 day window just opened you have lots of time - 90 days worth. You don't have to file right at 90 days - you can file anytime during those 90 days right up to the day before your green card expires. And yes, you can order the transcripts over the phone - it is an option driven menu - it doesn't actually mention transcripts until several steps into the menu but it is pretty straight forward.

Oh Gosh You just made my night... I was honestly breaking down... I will have my husband call IRS and get the transcripts, it seems much easier than hunting for copies of our W2s :(

Thank You and everyone else who contributed!!!! You guys are wonderful!

  5. If you use your regular tax copy you need to submit all of the attachments as well - W-2s, investment receipts, everything that goes into supporting your tax filing. It is easier to send the tax transcripts from the IRS - they're free and usually arrive within 2 weeks.

Everything else looks good. Good luck.

2 weeks... I should have done this sooner :( My 90 day window opened a few days ago, so I don't think I have the time to do this... I just wanna cry :(

  6. I've been getting a little nervous since I'm about to file the I-751... I've been reading that many of you are submitting your IRS transcripts which you obtained through the IRS directly. I however was planning on sending the regular copies from turbotax (you know, after filing taxes, you get copies of what you filed - and that's what I wanted to use). Would that be okay??

Also I'm sending all these things:

    - Copy of permanent residence card

    - Copy of our baby's birth certificate

    - Copy of our 06, 07 and 08 joint US tax returns.

    - Copies of our bank statements, showing joint account

    - Copy of the title of our car, showing joint ownership

    - Copies of various car insurance notices

    - Copy of letters addressed to both of us and copies of letters, received by us at the same address

    - Copy of our three apartment leases

    - Copy of itinerary (vacation)

    - A copy of our airline tickets from our vacation to Europe and itinerary

    - Several photographs from throughout the marriage

    - Copy of our Sam's Club cards on a joint account.

    Is that enough??

  7. Hello everyone,

I figured I'd post my question here since I already have the temporary Green Card and we will be removing the conditions in a year.

We are planning on going to Europe early next year. Our problem is that my Green Card lists my married name (husbands last name) and my passport lists my maiden name. I was planning on getting a new passport with my married name on it but this process could take months.

My question is if it would cause problems on the boarder to have two different names on the passport and green card? Will it be sufficient to bring our marriage license with us?

I would GREATLY appreciate it if you could let me know what you think.

(My husband had called ICE and they said that they don't think it would cause problems but I would love to know if you have any experience with this issue)

  8. Hi guys,

my Green Card was supposed to be here the beginning of August and we still haven't received it. We called Customer Service and they told us to fill out the I-90 and that it might take up to 4 months to get the new green card!!!

Since we're already planning trips, I was wondering how long it took YOU to receive yours after filing the I-90? What is your experience.

    Thanks!

  9. I really appreciate your replies! Thanks! I just stress all the time and over everything  This is just so important to both of us because we'd have a harder time in Germany. My husband doesn't speak any German and we don't want to go over there now and spend even more $$ on German Immigration.

@ lucyrich - I guess you're right. Our first interview wasn't difficult to begin with. They just asked many detail-oriented questions, you know about the household and asking where things were etc.. Just making sure we live together and love each other.

I just wanted to hear your personal opinions/experiences. The guides don't really reflect that. So thanks again, hope all goes well for all of you too!!

  10. Okay don't chew my head of :D I looked in the guides and FAQs but haven't found an answer.

We had just moved when we submitted the additional info that immigration wanted before they could approve my AOS. Of course we filed the change of address form right away. But we are worried that they might have not registered that before they mailed out the notice.

What happens if we don't receive the notice/green card in our mail?

  11. @ devilette, thanks but I've read the guides. I just wanted to hear YOUR opinions, what the members here have to say from personal experience, that's all.

@Niagaenola - Thank's I appreciate it. We're just really stressed because we've never done that. Having found my husband and now that we have the baby, we're even more stressed if you know what I mean :-(

  12. Hi guys, I'm sorry I haven't introduced myself before posting my first post... my name's Ann, I'm from Germany, married a wonderful husband for 1 1/2 years, we got a cute baby boy and now we're even happier since my AOS was approved. Well we thought we were all set, ready to go... we were planning on visiting my family in Europe so that they'd get so see their grandbaby! But now I heard that since we haven't been married for 2 years, I got the so called Conditional Residence Card... so not like a Green Card that's good for 10 years.

We've been told that we have to fill out the I-751, 90 days before my temp. green card expires, and give them docs that prove that we're in a "bona fide" marriage. I'm ok with that because we won't have any problems submitting any info they want. I am still worried though because you just never know... what if they just deny it??? I am so worried...

Can anyone tell me their story? What is it like to go through the I-751 process? Is it hard?? My gosh, we are so stressed out about that right now... well actually I am, my husband thinks it's fine and we won't have problems...

    Thanks in advance,

    -A.
