wow, that totally sucks.
they rejected it on the fact they list the receive date as July 30th. and thats the first day of the new fee increase. The 27th was a friday and if they signed for it in the mail in the afternoon, they wouldnt process it in to their system until the following monday morning july 30th. They arent using postmarks but their own receive date which is posted on your NOA1. so to them the fee is incorrect. What a hassle to resend it and lose the time also. i feel for you but i dont think they will allow you to use the old fee or received date. They dont recognize the postmark or delivery signature. they only recognize when they process it in which was that monday July 30th.

tough break, maybe they will speed yours up alittle since its already packaged in their format and ready to go.

I know it sucks.. But you should have used priority mail.. BUT since you got delivery notification from before the 30th I would fight it.You will lose as you are fighting the government But I would fight it.

We don't have much hope in winning this battle...the war is what really counts.

Fact is, that we did send the petition priority mail and we have all the proof of delivery that meets the criteria set out on the USCIS website (Applications or petitions postmarked or otherwise filed on or after that date must include the new fee.) Our application was POSTMARKED and filed before the new fee came into effect.

We will do what we can do. We've had our cry and "######" session over this, now it's time to move on. I guess we will have to see what the outcome of all this is to determine if we will still be July filers, or will now be September filers :crying:

Application Type: I129F, PETITION FOR FIANCE(E)
Current Status: Case Rejected

On August 15, 2007, we determined that this I129F PETITION FOR FIANCE(E) was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case.

Here's our experience:

Mailed/Postmarked I-129f to CSC on July 25, 2007 (along with $170 processing fee). Received postal confirmation of delivery (signature obtained) on July 27, 2007. Waited for a month for our NOA1. At the end of August we received our packet back in the mail with an NOA stating that it was being returned due to the wrong fee being attached!!! The whole petition had been taken apart by someone at the CSC and reorganized, pictured stapled together, covering letter removed and everything all put back together with an ACCO clip.

We are so pissed!!! We had the package post marked and mailed before the July 30th fee increase and we have postal confirmation that the petition arrived and was signed for before July 30th. The NOA has a receipt date of July 30th (what a surprise...sarcasm intended).

Why was the package seemingly prepared for processing if the fee was supposedly wrong? Wouldn't the whole thing have been returned to us as we originally sent it? The whole "wrong fee" thing just seems like a money grab to us. We called to ask how we can remedy the situation as we feel that we are being charged the higher fee unfairly, as we followed all the rules. Also, our petition has now been unfairly delayed another 6-8 weeks. We were told that we should just re-submit the petition with the new fee because re-submitting with the old fee along with any postal delivery evidence that we have will only slow down the processing of our submission and may result in another rejection!

What a load!!!!

FYI: I mentioned in an earlier post, that our money order had been cashed on August 3rd...that information turned out to be bogus too!.

Does anyone out there see a little black cloud following me around? :unsure:

We are upset about all of this, and are going to submit copies of our postmark and delivery receipt information with our resubmission along with a cover letter explaining what has happened and asking that we be processed under the old fee schedule and that we be put back in the processing waiting list according to our original receipt date. We are however going to submit the new $455 fee in order to prevent any further delays in processing.

Not holding our breath here...but hoping for the best.

We sent our I-129F packet on 27th July 2007, delivery was confirmed on 15th August (have no idea what took so long) but the postal tracking states that the packet was postmarked on 27th July so we should have beaten the fee increase deadline ruling. HOWEVER, we have had no confirmation from CSC via post or email of receipt of the application and our check has not been cashed.
Initially, I was just thinking that the delay on the NOA1 might be due to a volume of applications arriving in July/August but I am now concerned that the packet is lost in the system and there will be little we can do about it other than resending the whole thing which will subject us to applying with the new fee and setting us back a further 6 - 8 weeks.

Does anyone have similar experience or advice on where we stand with just confirmation from US Postal services that the packet was actually delivered?

What the heck is going on here?

We sent in our I-129f petition on July 25th and received postal confirmation of delivery on July 27th. We also received confirmation that our money order was cashed on August 3rd. We waited 3 weeks with no NOA1 in sight and decided to call to get our case number. We were told that we should wait a couple of more weeks and we should have it...the very "helpful" person who answered the phone was very abrupt and hung up before giving us our case number.

Hurray, hurray...the hard copy of the NOA1 arrives in the mail yesterday (August 28th)! The notice date is August 16th. I'm so happy that I rush to the computer and enter our case number into the USCIS web-site so that we can begin to follow our case on-line. To my horror, I find this notice:

If this is the case...which I simply can't believe because we were totally ####### about everything being perfect...then why did they cash the money order if the petition was improperly filed and had to be returned to us?

Shouldn't the money order have been returned with the package?

If the package was mailed back to us on August 15th (that was 2 weeks ago), why don't we have it yet?

And, if the whole petition was rejected on August 15th...then why were we issued an NOA1 on August 16th?

Could this status report be some sort of clerical error? If that's possible, how can we find out? Are we in the system or not? What exactly was wrong with the petition...we did everything right...the process is fairly straightforward and not exactly "rocket science". We followed the guides here exactly.

We are going to be calling USCIS today to try to get some answers to our questions.

I'm so frustrated right now that I want to cry.

I hope this doesn't sound like an insensitive question, but I'm trying to figure out how to handle this situation.

I have significantly more assets than my fiance. He has two children from his former marriage which he shares joint custody with his former wife. He is very involved in his children's lives and pays his child support faithfully as he should. He has had some bad credit issues in the past due to his divorce.

Here's my question. His ex takes him back to court every year to have the child support reassessed. Although she is educated and skilled, she refuses to get a better paying job. Once we are married and join our assets, will his ex wife be able to take advantage of this, or gain access to the assets which I have brought into the marriage? Will his creditors be able to gain access to my assets?

Should I consider keeping the bulk of my assets seperate from his and just have a portion of our assets mixed?

I will be purchasing a house once our visa is approved, should I do this before we are married and keep it solely in my name, or will it automatically become community property once we are married?

I should probably be talking to an attorney, but thought someone here might have some insight into this issue. I have absolutely no problem sharing what I have with my fiance, and his children, it's his ex and creditors that I'm worried about.

There really is no rhyme or reason to when people are receiving their NOA1 from the CSC. Some people are receiving theirs in a week or two, while others are waiting weeks with nothing to show. We sent in our package on July 25th and the delivery was confirmed on July 27th. Our money order was cashed on August 3rd but we still don't have our NOA1! Go figure. Patience is a virtue...patience is a virtue...patience is a virtue... :angry:

Yup, all legal names ever used need to be checked and documented:
- maiden name

- former married name (s)

- any other name used

This just saved me one big headache. I haven't applied for my police certificate yet, but to be honest, I probably wouldn't have thought to ask that it be in both my maiden and married names. Whew...now I won't make that mistake. This process is going to take long enough without adding even small delays. VJ RULES!!!

Do they only do interviews in Montreal and Vancouver? #######?! Where did you find the information that it's taking them 6 months (and what is that 6 months from, from NOA2 or even later?). I'm ready to cry reading this. Our lawyer told us that we may have as little as 1 month wait in Toronto between the petition and the visa, but clearly maybe she's wrong if he can't even have his interview there....

And on a side note, since this is my first time posting, I'm not sure if my timeline will automatically show up, but here's my info:

Hi, and welcome to the group.

K-1 Visas are only processed via the embassy in Montreal or Vancouver. Since your boyfriend lives in Toronto, he will be processed through Montreal. As for the wait times, it varies by the service center that you are using and your own personal circumstances. Right now, Montreal is experiencing huge backlogs. Read through some of the other threads directly related to the Montreal embassy, and you will get a better idea of what other people are experiencing. Also, take some time to familiarize yourself with the "Immigration Timelines" and how they work. You can enter your own personal information into them, and get a much better idea of how long the process is going to take.

The 6 months I was talking about was after the Embassy in Montreal receives the approved petition.

Don't forget to keep your own timeline updated as this is what keeps the statistics as accurate as possible.

As for the "1 month" thing... :lol:

Try to relax. It's going to be a long road. Good luck to both of you.

I hope nobody minds, but I thought I would mess with this a bit to make it a little easier to read.
Personally i thought the asterics blended in with the background and the dates stood out. now its a bunch of lines and grids and my eye doesnt go the dates first. i have to look at it twice to see the dates. for me its a bit mucked up now.

Don't you just hate computers? It is not wrapping on my monitor, but it will probably vary with monitor size and display settings.

Changing my screen resolution fixed my problem...duhhhhh...why didn't I think of that?
