    We have our Green Card interview scheduled in 2 weeks. AOS filing through K1 visa.

     

    Timeline:

    - Medical Examination: September 2020

    - AOS Filing: March 2021

    - Interview: March 2022

     

    Do we need to get another i693? After reading the instructions, it seems we are not required to get another Medical Exam, since we filed for I-485 within one year of an overseas medical exam. 
    Worst case, if USCIS officer asks to submit another, It seems it is OK to get an RFE after Green Card Interview?

  2. Hello everyone.

     

    My wife entered did her Medical Exam overseas on September 2020.

    My Wife entered the US on K1 visa on January 2021. 

    AOS filing on March 2021. (submitted the DS-3025 Vaccination record, not the i-693)

     

    Interview is coming up in 3 weeks. I am a bit confused regarding the i-693. Should we re-visit a Civil Surgeon? 

    We are planning to not bring the i693 nor the DS-3025 to the interview since we filed within one year of Medical Exam, and before Oct 1 2021 (effective date of COVID requirement).

     

    Appreciate some guidance

     In June 2021 I have completed my overseas medical and submitted my DS-3025 (with all required vaccinations ticked off) together with my I-485 application. I understand that if AOS is filed within 1 year of my overseas medical, than getting the I-693 is not required. I have not received any RFE regarding the medical. BUT, since October 1st 2021 the vaccination requirements has changed and the COVID vaccination is added to the list. Yet at the time it was not a requirement and is therefore not present on my DS-3025. I have read through the instructions and all I can find is this; 

     

    'Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will need to have the Part 10. Vaccination Record completed by a designated civil surgeon. In this case, you must submit Parts 1. - 5., 7., and 10. of Form I-693.'

     

    The DS-3025 was properly completed, but the USCIS has gotten a new requirement in between my completed medical and the interview, but it is within the validity period of the medical. 

     

    Does anyone have any experience on how the USCIS will go about this?

    Does anyone know if a new medical OR an updated vaccination record is required before the interview?

    I guess we can go to interview without brining the i693. Is that what you did?

    Green card interview coming up for the wife. Marriage based via K1 Visa

     

    1) At the time of filing, we provided i-944. Since it has been revoked, do we need to bring all the supporting documents? 

    2) The wife did her medical examination overseas on September 2020. AOS filed on February 2021. Do we need to do another Medical Examination? It seems it is not needed since it was filed within one year. However, check below

    3) Wife did not get her Covid vaccine yet because of previous Medical Allergies. Interview in 3 weeks. I am assuming I would have to visit a Civil Surgeon to update her Vaccination Record only (No Medical Exam)?

    4) Related to i864: The Wife now has a job. I lost my job for a month the got rehired with same company. Do I need to update i864 and bring it with me?

    No need for those 2 items to match.  As mentioned above, Current Income is calculated from recent paystub or taken from employment letter, while Total Income is copied from tax filing.

     

    Thanks for the answer. Do you suggest i file my taxes first?  Not sure when / and how many time USCIS will review my application. I am worried they reviewed after April 15th and then they would request a RFE for 2021 tax returns. Newbie questions i know.

    For Part6, Question 24a: I will use 2020's income as my recent tax return.

     

    But for Part6, Question 7: What should i use for current Annual Income?  Should it reflect my 2020 or 2021 return? Income from 2020 and 2021 meet the poverty requirement so no issue there.

    Forms needed to sent in with adjustment  of status I-485. Employment authorization i765. You need to file the medical exam and the sponsorship form I-864 I believe.

    But yes you will have to repay again. 

    I-130 was approved back in 2017. I used that  when submitting i485, but was rejected because it has been more than 2 years since i130 was approved.

    so i need to file i130 and i485 concurrently.

    Biometrics fee is not just the fingerprinting fee. It is for background checks so it is required for any new filing. Depending on when the biometrics was taken last time, they may waive the fingerprinting but they still need to do the background checks based on existing fingerprinting.

    I-130 was approved in 2017. Submitted I-485 in 2021. 

    Long story short, I-485 was denied because the I-130 has expired. We did not apply for immigrant visa before a certain time, thus USCIS denied the application.

    Before I contact a lawyer, I would like to hear your opinion as in what to do next? Do i need to start the entire process: File I-130 & I-485 and pay all fees?

    Received first Biometrics appointment (via mail) for I-485, but I had to call and reschedule because of a family emergency. 

    However, I have never received my second Biometrics appointment. I later noticed on my USCIS account that " Notice Was Returned To USCIS Because The Post Office Could Not Deliver It". Even though I have never changed address or anything.

     

    I called USCIS afterwards and was told to expect a call within 60 days. I waited 60 days and I called again and was told to to expect a call from a Tier 2 agent within 30 days to be informed on what is next.

     

    Has anyone faced this issue? (FYI, USPS been screwing up a lot lately, losing packages, not delivering packages, not updating tracking online ...)

    I am the petitioner, and I have an online USCIS account with two pending AOS applications: one for my wife and another for my father.

    The main address for both cases is mine. However, my father lives in another State at the moment.

     

    How can I change the address of my father's pending application without changing my wife's address.

    In summary, i want my wife to do her interview in Texas where we live and for my father to his interview when time comes in Florida where he is residing.

    Sorry a bit late to reply, but we are in same condition and was able to get my wife a DL in texas while AOS was pending.

  14. Thanks for all the answers. Just to update you, we were able to get my wife a Texas DL with a pending AOS :)

    You will have to wait until Greencard or EAD card arrives before they will give her a DL or ID now.

     

    Unlike in the past you can't have both a Texas DL and ID 

     

    If she has a DL from another country she can drive on that in Texas

  15. My fiancé entered the US on K1 visa, we got married and already submitted AOS package.

    We also received the I 797 receipt.

     

    She applied for DL in Texas and got one but turns out it expires on same day I-94 expires :( - because that is when her lawful precense expires. 

    Has anyone been able to receive a DL in Texas while waiting on EAD / Green Card?

     

    Digging a bit deeper, https://www.dps.texas.gov/sites/default/files/documents/driverlicense/documents/verifyinglawfulpresence.pdf  PAGE 3 , clearly states that a "PENDING I-485" should be enough to prove lawful presence in USA. Any thoughts on that?

    It states 12 months in the instructions. Which is a lot i Know. But better to have more information then less.
