Perhaps, he should turn in the green card and apply for tourist visa instead?

Yes on taxes for the last few years since the time he has been spending most of his time in India. He only spends about a month here in the USA wen he visits, so no Obamacare...

Yes, that was the initial intention for them to move to the US. However, my mother does well in India than she does here, because of the familiarity of the house there. The reason for my question is to keep my father's green card active so that down the road he can come live here.

Is their primary residence in India? The purpose of the green card is to become a permanent resident in the US and it is expected that the green card holder spends the majority of their time in the US.

My parents are both Green Card holders from India. However, shortly after my mother got her Green card, she was diagnosed with dementia and her health began to deteriorate. As of right now, she has no capability of taking care of her daily needs herself and my father is her primary care taker. Over the years we have been having them travel to the US once a year to keep their Green card active. However, now traveling is becoming a big problem for my father having to manage her the entire trip here and back. We have filed the I-131 twice already to get a 2 year extension so that they can avoid the travel. Furthermore, her Green Card is to expire in December and we need to apply for a renewal.

My question is, is there anything we can do on a medical basis where they wouldn't have to travel, however still keep their Green cards. I am especially interested in keeping my father's green card active so that he can travel to the US freely, because he fortunately is in good health. So if he can get some sort of an exemption based on the fact that he is her primary care taker?

Secondly, if we can avoid the travel, is there any way we can renew my mother's green card in India? Any guidance is much appreciated.

I received it yesterday, Monday July 5th, 2010.

Are you working, or planning on traveling anytime in the near future? If so, you can get your passport stamped. Otherwise, you can wait for your approval.

No plans to travel out of the country (or to Arizona... ) in the next couple months. But I never received my NOA1 that says that the GC has been extended for one year, while the processing is ongoing.

So, I have one week left on my Conditional Green Card. It expires May 19th...I am going to get an Infopass appointment for before the 19th...If the approval comes before that, I can always cancel the appointment. Anyone have any other suggestions?

Thanks for the response. To clarify something more, the NOA1 would extend my Green Card for one year. The green card expires on May 19th, if I do not receive anything before that date, what does that do to my legal status?

OK...so I have yet to receive my NOA1. My application was mailed on 3/24 received on 3/25 and the check was cashed on 3/29. It has been 2 weeks but no sign of the NOA1. Is it time to freak out? Is there a way to find out what happened...Any help is appreciated...Thank you

I filed my I751 petition one week and a half ago and the check has been cashed. But I have yet to receive my receipt from USCIS with the extension of the Green card. Does anyone know how long it takes for them to send out the receipt notice? What happens if it is lost in the mail?

Well, oddly enough, a day after I posted the aforementioned question on the forum, I received an email from USCIS stating that my LPR has been approved. And the status now stands as "Notice mailed welcoming the new permanent resident." The card will be sent to me within 60 days.

I wanted to thank all the great people on this forum who have helped me thru this process. Trying to file for immigration without using a lawyer is not an easy task, but knowing that I could turn to the great folks on here for answers to all my questions was a the biggest peace of mind. I appreciate all the help that I have gotten here.

I need some advise...I had my family based Green Card interview on April 2nd 2008. The officer interviewing me told me that everything is OK from her end and that she will approve the case. However it was pending the FBI name check and she said that once that comes in they will send me the decision officially.

In my portfolio online, the last posting it has is from January 2008, where they received the RFE documents that I had mailed to them.

So my question is how long do I wait to contact USCIS about the case?

And, do I call USCIS or make an INFOPASS appointment and go the local Chicago office??

Name checks are quite routine for I-485, and it happens often for AOS to be approved pending final name checks.

Also your profile shows CR-1/IR-1 which has NO AOS those visas are green-card visas you get LPR status upon entry to the USA, yet you are talking about AOS which is a process from a NON-Immigrant visa like K-1 or K-3.

I had concurrently applied for I-130 and AOS. My I-130 was still pending; however I got a letter in the mail for an AOS interview.

So I just had my interview for AOS yesterday. The lady was pleasant and didn’t ask too many questions to me (intending immigrant), and made small talk with my wife instead (petitioner). She started at top of my file and as she kept going thru it, asked me for a few originals, employment letters, pay-stubs etc. She also looked at my wife’s and my passport, my EAD and proof of joint assets. She did keep my I-94.

She told us out right that she will approve this petition, however they are still waiting on one last back ground check to clear and as soon as that happens, they will mail me the approval.

Later in the evening I got an email from USCIS, saying that my I-130 was approved and as of April 2nd they have mailed me the approval notice. April 2nd is the same date as that of my interview. Does this mean anything? This background check that the lady referred to was it just the “standard line” and she said that only because the I-130 was still pending?

Or maybe I am just reading too much into all this...

Well it is sort off...my Grandmother is 90 years old and not in the best health at this time...no particular illness but just old age and a weak immune system...So I can't turn in massive Doctor's reports, but maybe a letter from our Family physician. Would that suffice USCIS for consideration??

I have filed for my Advance Parole concurrently with my I-130 application in October 2007. I need to travel out of the country in February 2008. I called regarding the approval of my AP and they said that they are running 30-45 days behind. So I won't hear anything till the end of January going into February. Is there something I can do to expedite my process for the travel approval??
