    I did not send a new i751, all I did was I sent a letter to amend my i-751, along with more evidence and divorce paper work. If your divorce is finalized , send the divorce decree and if not , the send the divorce petition and mention that you will be sending the divorce decree as soon as your divorce gets finalized.

    No need to pay again. Just send in your letter/request to amend your Joint application to switch to a waiver.

    In addition USCIS has automatically extended the effective due date on RFE due to COVID by 60 days throughout the year. A late RFE response will not be an issue for you either way.

    Thank you for the info. This has relieved my stress. Earlier this extension was only for RFE  issues until June 2020 , mine was issued in July , so i was not sure.

  4. The deadline to send response to RFE for I-751 was today. I sent the documents last week with UPS overnight shipping and but UPS messed up the delivery which was supposed to be completed last week. However the package was delivered it today. I am not able to get hold of someone from USCIS to confirm if they received my documents. The delivery status from UPS says "Delivered - Left at dock". I am worried if USICS would be consider my documents received on time or not ?

    The RFE document which I received mentioned if USCIC does not receive my response by deadline, the case would be denied .

     

    Please share your experiences.

    Im planning on bringing the below documents with me (mostly end of 2016 and 2017 proof)  but wondering if I should also bring the copy of the 3 binders I had sent USICS previously with the rest of bank statements, affidavits, insurances in both of our names, utilities under both names, tax transcripts married filed jointly, photos, etc etc etc from 2013 to 2016. 

     

     

     

    1.    Commingling of financial resources:

    1.1  IRS Tax Transcripts 2016 (married filed jointly)

    1.2  IRS Tax Transcripts 2017 (married filed separately)

    1.3  Bank  statements for Joint Checking account and savings accounts from April 2017 to February 2018. Note: All four accounts were closed 2018 due to divorce proceedings

    1.4  Copy of Home Insurance under both names 11/2016 to 11//2017

    1.5  Car Insurance policy letter under both names 11/2015 – 11/2016

    1.6  Car insurance statements December 2017 to July 2017

    2.    Change of Address filed with USCIS on August 2017

    3.    Change of address USPS

    4.    Copy of response to RFI sent to USCIS June 2018 with:

    4.1  RFE Letter

    4.2  Cover letter from lawyer

    4.3  Form G-28

    4.4  Copy of green card

    4.5  USCIS I-751 Receipt notice 

    4.6  Copy of letter sent to USCIS informing them of divorce proceedings on October 2017

    4.7  Divorce petition filed by USC Spouse and proof of service

    6.    Correspondence from May 2016 to June 2017

    7.    Photos

    8. Letter from therapist stating we attended couples therapy for 4 months.

     

    I also have a scrapbook with photos, wedding invitations, cards from family and friends for engagement and wedding, etc etc etc 

     

    Any advice would be greatly appreciated.

    When did this happen?

    If you failed to respond to the RFE / provide the divorce decree, they would have issued a denial..

    Standard RFE time is 87/90 days... and 'hold' after denial before further action is 30 or 45 days , depending on which form/box is applicable and they tick.....so if this was not a very recent thing, you should consider that I-751 filing gone.

     

    With the denial it would also be (slowly) working its way to & through the immigration court system, for a nice NTA (notice to appear) headed your way, which would probably take a couple of years to happen.

     

     

    The good news is that a waiver I-751 can be filed at any time, without penalty, and without being classed as a late filing. Multiple I-751s are also permitted.

    Simply fill out, file, and pay for an entirely new I-751, this time with the divorce waiver box checked.

    You will get a new receipt, new receipt number, new biometrics, and probably require an infopass to get a stamp in your passport/on an I-94 as new proof of your status.

     

    Well, I still have time to respond to RFE. I was given extended time due to covid. RFE recieved in late July , and deadline to respond to RFE is Oct 10th. 

    So, when replying to RFE can I switch to waiver ? If so, whats the process to do so ? 

     

  7. I filled I-751 as join petition , however our marriage went south and my spouse (USC) filed for divorce  while i was still waiting on decision for my joint I-751 petition. Later, I received RFE on my joint petition asking for Divorce details ( though i never informed USCIS about my divorce since i was still waiting for the final divorce decree to do so, most likely my spouse informed USCIC with ill intentions to have my green card cancelled)

     

    I have received the final divorce decree now , and my question is "Do I need to submit a new I-751 with "Waiver" checkbox instead of Joint ? or Can I just sent a letter to USCIS to amend my existing petition and consider it as waiver along with sending final divorce decree ?"

So, Tuesday I received a status update text on my case saying  "Request for Evidence", and after 2 days while i was still waiting for the actual RFE letter in the  mail for, I got another  text update that "Response to RFE has been received " when I never sent anything.  Is this a glitch or something ? Has anyone experienced anything like this ?

    Btw, I am going through a divorce , and I wonder if my spouse did anything . But again , status update within 2 days is highly unlikely from USCIS reputation. 

  9. Hi There, Need some advice on my situation.

    My I-751 was filed as a joint petition 2 years ago in July 2018, but our marriage has gone south since last year. My spouse who is a USC, filed for divorce in Feb this year. The divorce is yet to be finalized . And last week, I received a RFE for my 751 asking for more evidence. 

    My question 

    1) While responding to RFE , do I need to mention about my divorce proceedings or just respond to whatever has been asked for ?

    2) In case I get approved after responding to RFE without interview , would it cause any issues down the line cuz Divorce was filed before the approval ?
