    I-865 is not required as the I-864 is not yet in force.  But, other VJ members have had success getting their change of address properly reflected on USCIS records by filing I-865, with or without an I-864 in force.

     


    Thank you!! I ended up calling yesterday and the agent told me she saw the change of address reflected and also gave me a confirmation number.

     

    Is this enough of a confirmation that the address has reflected? 

  2. Hi, all!

     

    My husband (applicant) and I (USC) are moving to CT next week and I just have a few questions.

     

    1. He submitted an AR11 online for his I-485 and I-765 and I did one for the I-130. Do we need to do any follow-ups with Emma/USCIS to make sure our change of address went through?

    2. When we filed in Jan 2021, we submitted the i-944 and i-864 for self-sufficiency/support. I understand that the i-944 is no longer necessary after March 2021, but do I need to submit the i-865 for my change of address as his sponsor for the i-864?

    3. Husband was here on an H2B and has a SSN and driver's license. CT has an option to apply for a DL for undocumented residents--is he considered undocumented or should he just schedule a regular out-of-state license transfer appointment?

  3. Also no biometrics letter or any other movement! I did try to expedite for my husband's EAD but we were denied on June 24th. Other than the denial, it's been absolute crickets since Jan 11th receipt of our I-130/765/485 package (other than a Jan 24th fingerprint fee receipt haha).

     

    We're moving to another state at the end of August, does anyone know if that will negatively impact any of our applications? I'm waiting until closer to our move date to notify USCIS of our change of address.

     

    My husband wants to try and strike it out on his own with a small business, but I know he'll need his EAD for that. Would contacting our local representative be the best way to try and expedite that EAD for his self employment? I'm assuming I should wait until we move to our new state to do that?

  4. We also have not received our biometrics letter!

     

    Our case (AoS from H2B) was received on Jan 11th, and we tried calling two days ago.

     

    The first agent said that biometrics were being waived more regularly. He couldn't tell us if my husband's was being waived or not, but he did say the current EAD timeline is 9-11 months.

     

    This sounded so preposterous to me!! So I made my husband call back to see if we could try expediting. The second agent was a lot less chatty. We simply asked if we could expedite and she asked us for what reason (she read off a list of 7 reasons?), we said financial hardship (I am a grad student and can only rely on student loans and generosity of my parents for so long!), and then she gave us a reference number starting with T1M and ending with MSC... The whole conversation lasted about 5 minutes, it sounded like she read from a script, but I appreciated how straightforward it was.

     

    Judging by other comments, it sounds like the biometrics were indeed waived if we were able to expedite? And does anyone know how to track the reference number for the expedite request?

    Whoops! I do not know where my head is, I think I was reading another's post and confused myself.

     

    We filed an AOS from an H2B (not H1B). Our correct timeline is:

     

    Mailed to Chicago Lockbox: Jan. 8, 2021

    Received by USCIS: Jan. 11, 2021

    Fingerprint Fee for I-485 Received/Accepted: Jan. 24, 2021

    Email Received with Receipt Numbers: Jan. 25, 2021

    Checks for AOS package cashed: Jan. 26, 2021

    I am the petitioner.

     

    We were waiting to file our entire package (I-130, I-485, etc) until I got my new social security card that reflected my name change so that we had at least one document with my married legal name (haven't been able to change my Driver's License/Bank Accounts without my social security card reflecting my married name). However, I just received my social security card and they spelled my new last name wrong. I thought it was a mistake on my part, but the SSA mailed back our marriage certificate and I have a copy of the name change application, all of it with the correct spelling. I am not sure how they misspelled my new last name.

     

    Is it worth sending in a copy of incorrect social security card with our AoS package with a copy of a new application to correct the spelling? Is the marriage certificate enough to show proof of name change?

     

    Additionally, my husband's work visa expires December 1, 2020 (this Tuesday). I know we really cut it close with planning to submit on November 30th... Would it be OK to file after Dec. 1st? Would I need to include a letter explaining why we are filing after his work visa expired?

    I-944 is still required until USCIS says otherwise.  The USCIS website is updated with the latest information on the ongoing appeal against the court ruling you mentioned -- https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/inadmissibility-on-public-charge-grounds-final-rule-litigation

     

     

    For the I-944, it is the immigrant's information that is required.  So only your husband's credit report must be submitted, yours is not required.  As for your tax filings, those are required for the I-864.  Submit the IRS tax transcripts.

     

    Thank you so much for the clarification! Embarrassed by my oversight, I was working off of my checklist for the I-485 and realized I had mislabeled/confused the I-864 and I-944 support docs.

     

    Could I trouble you with a few other questions?

     

    1. Is the I-94 web record on its own enough evidence to show inspection and admission for Form I-485? My husband didn’t get his passport stamped by the CBP officer at his POE but we were able to get the I-94 electronically from the website.


    2. He previously held a J-1 visa in 2014 and it specifically exempted him from 212(e) - the two year rule did not apply to him. We had previously consulted an immigration service here in Boston that said he would not need to disclose his old J-1 information because we’re adjusting from his H-2B but after re-reading the Form I-485 instructions, it sounds like we do need submit a picture of his old J-1 visa?

     

  9. Hi, everyone!

     

    I have a few questions about the necessary financial documents I will need to submit along with our AOS. I am a USC and we are doing an AOS from an H2B for my husband.

     

    I am a bit confused as to the necessity of the I-944. I read a post on this forum that there was a federal court ruling that vacated the public charge requirement for filing of the I-944, but the USCIS website doesn't seem to be updated. I am assuming that I should still submit the I-944? I am hoping to submit our entire package within the next week.

     

    If the I-944 is still required, I understand that there are a lot of documents that need to be provided, such as our credit reports, tax returns for last 3 years, bank statements for last 12 months, etc.

     

    For our credit reports, is the Chase Credit Journey screenshot sufficient or do we need an official credit report from one of the credit agencies (e.g. Experian)? I ask because my Experian credit report doesn't show my credit score. I am also an authorized user on my parents' credit card, so even though all of my credit cards are paid off, their credit card account has a debt balance and this debt balance is listed on my Experian credit report. Does this mean I would need to get the credit card statement from my parents' credit card showing the outstanding balance? Would I need to submit an additional letter explaining that I am an authorized user and the reason for the outstanding debt?

     

    As for the tax returns, are the tax return transcripts downloaded from IRS.gov sufficient or do I need to send the actual return that I filed through TurboTax?

  10. Hello!

     

    Myself (F, USC) and my fiance (M, LT citizen) are applying for an AOS from his H2B visa. We'll be getting married Tuesday and thought we'd get a jumpstart on the paperwork. This forum has been very helpful in collecting all of the necessary forms to fill out, and I've read the step-by-step guide but I still have some outstanding questions. Any help would be greatly appreciated!

     

    1. I'm changing my last name to his but we'll probably be ready to submit our paperwork before I've had time to formally change my name with the Social Security Administration and on my passport. Should I be filing with my maiden name or my married name? Should I wait to file until I have all of my official documents (driver's license, passport, social security card, etc) reflect my married name? Just worried that this will take too long as his H2B expires in December.
    2. He has some gaps in his employment history (some as long as 9 months) in the last five years. His only job has been in the US on his H2B, which is seasonal. How do we manage these date gaps in the I-130? Do we list the exact same employment information with just the dates adjusted five times or do we just extend the dates to be 2015 - present without caring about the gaps/time he wasn't in the US working?
    3. I've been in graduate school for the last two years and my only employment has been internships. I assume that internships still count as employment? 
    4. I've seen a lot of posts about people including 1 page letters as proof of their bona fide marriage and explaining why they are AOS from H2B to Green card. I assume that we will also need to explain our relationship. Is this a full recount of our history or just explaining why we've decided to get married now (e.g. will the explanation of COVID-19 be too exhausted/cliched at this point)?
    5. Similar to that question, his H2B last year was initially rejected due to 214(B) and his ESTA prematurely revoked (it was valid from 2018 to 2020 but cancelled in 2019 at the same appointment as his H2B rejection). I assume this will not work in our favor. Do we submit another letter explaining this situation? His H2B was granted at a subsequent appointment about 3 days later with the same consular official, apparently a lot of LTs were applying for H2B visas that day and they were all rejected then later approved.
