    My fiance came to the US on a K1 visa. 2 weeks after getting married in the US, she left for her home country (before filling AOS or anything else). It's been 1 yr since she left. I'm seeking a divorce and unable to locate her in her home country. We have no assets or children. 

     

    1) A legal volunteer in my county courthouse told me I just need to publish the pending divorce in my local paper in the US and file for divorce . I read also I needed to publish something in her newspaper also. True?

    2) Do I just  file for divorce in my courthouse even though I can't contact her in her home country or wherever she is?

  2. I wish I could work it out with her. But its at the point where someone is going to win and someone is going to lose(regarding the child) I know it sounds harsh and I know the child loses being raised by one parent. I started recording the conversations on my home phone and its not pretty. The family wants the child raised in Colombia. My wife agrees with them and is trying every way to get me to sign the letter where she could take the child out of the US. The father says in one conversation, that she should cross the Mexico border and try to fly home..

    Can anyone give me some advice or past experiences on custody of children in a case like mine?

    But I due plan to seek cousel next week

  3. I received a letter that I needed to send the additional paperwork and I had 87 days. Why would I go forward with the paperwork ,if I'm seeking a divorce?? If I have primary custody , I don't need additional money from her

    Sounds like you want her out of the US and keep the kid for yourself.

    I don't care if she stays here or goes home(alone). But if she returns home, she'll take the child and will never come back to the US. In the last few weeks she'll say that she wants to visit her family and I need to sign the letter for her to be able to leave with our child.I tell her now is not a good time and she gets very angry. And since she overstayed her tourist visa and the paperwork for AOS is not complete, she can't return to the US, but she thinks I don't know that. Also, at this point, between her family in her country and I , I wouldn't even be able to visit the child due to threats from them

    So now you might understand more, if I don't get custody I could lose my child forever

    My wife and I are thinking about seperating. She came here on a tourist visa, we then got married. We are in the middle of the adjustment of status. I sent in the initial paperwork but not the I-864. She also hasn't received her papers to travel out of the USA or work. We have a child(15 months old) that was born in her home country where we lived for 2 yrs. prior. The child has a US passport. My wife has been in the US 10 months now on the US toursit visa. We are also living in Florida ,if that helps. I would like custody of the child . I have a good job with assets(house paid for and savings)ly. She has basically nothing here or in her home country. She said she is going to move out and into an 2 bedroom apt with 3 other people AND the child and find a job working illegally, if I don't go through with the paperwork.I have been a good father and could give her a MUCH better life. I know I need to seek counsel, but maybe someone can add to this thread.

    My wife came here on a B1(visitors visa) and after 4 months we got married. I am applying for I-130, I-485, I-131, I-765 together and have sent my paperwork in and got rejected twice for the following reasons:

    Check amount incorrect --- I sent a check for $1010 as I have read on here. Do I need to sent seperate checks? fingerprint fees seperated?

    Under the I 765(Employment Authorization) form , what numbers or code do I need to put in the #16 ?

    Also, in this form(I 765) I prepared this form and sign it for my wife on the line( Signature of person preparing form, if other than above) She didn't sign it. Can she just go ahead and sign it above where I signed ,as the person preparing this form or do I need to redo this form and only she signs at the bottom?

    The paperwork was sent to Chicago 60680-4120

  6. Thanks for the responses. My girlfriend(wife now) came to the US with no intentions of marrying me. But after 4 months here with me we decided to get married. I knew her and dated for 2 years, as I was living in her country, Colombia for 5 yrs.

    "a few minor things needed to be corrected" --- USCIS said I sent the wrong amonut on the check and I didn't include a form.

    If the papers are lost in the mail, I guess I will have to send them again .. Right?

    My wife , from Colombia, came to the US(Florida) on a tourist visa. We got married 4 months later and filed the paperwork. USCIS sent the paperwork back to my residence ,saying a few minor needed to be corrected to proceed. The problem is that my wife and I are in Boston for a month , so I had my father foward the papers to me, and they possibly got lost in the mail. My wife's tourist visa for the 6 month's she was given at the airport, expires on June 15.

    Since USCIS "touched" the papers is their a record of it?

    Is there a big problem if USCIS receives these papers after June 15, a day her visa date expires?

    If I don't receive them in the mail in the next few days, I will have to fly home and try to redue everything quick

  8. DCF is for a CR1(or IR1 if you have been married longer than 2 years) visa. DCF simply means you file directly with the Consulate/Embassy rather than filing it the traditional route through USCIS & NVC.

    In most cases you need to be a resident for 6 months or longer before you qualify for DCF.

    If that is the case , what are my options ? Will she have to just come and go ever 2 months(lenght of tourist visa in the Bahamas) (between the US and the Bahamas)until 6 months passes?

    If we marry now in the US (she has been in the US for 3 months) , I read that she can't leave until she receives AP...

    Anything else we can do?

    I'm confused. You might be too after reading this. I'm a US citizen and my girlfriend is Colombian and has been visiting me for 3 months now on a US tourist visa in Florida.(The visa is up on June 15 on this trip ) We also have a child together, that was born in Colombia , but has a US passport. In two weeks we are going to live in the Bahamas. I am starting a new job there and have a resident card and work permit for the Bahamas. My girlfriend is coming along on a 30 day tourist visa(with a possible 30 day extension) We plan to marry in the Bahamas and apply for either a CR1 or DCF or ? She plans to visit her family at the end of June in Colombia with a 3 day stop in the US beforehand

    What are my options filing in the Bahamas?

    Can she fly to the US , then on to Colombia for a visit on her US tourist visa, if she hasnt received the papers to travel, otherwise?

    Any other advice?

  12. My wife and I want to divorce. We got married in Russia and moved to Miami. She lived in Miami with me for a year and 2 months before returning to Russia. This was 3 years ago and I havent bothered to finalize the divorce. We remain friends and would like to finalize the divorce quickly and painlessly. What to do? (Don't want to deal with an attorney)
