  1. thanks everyone...u r awesome!!!!...that helps to know that there's likely nothing wrong...just government slowness...LOL

CARLAWARLA...i didn't update my timeline in this topic 'cause i had already explained the issue in detail on another forum and got no response...just wanted a quick answer as to other people's experiences...will update our official timeline soon, we have been busy moving and doing renovations...submitted AOS, EAD, & AP on May 30/08...

  2. i'm in MN...i did my test for my DL @ the end of May & and then i went back up to the counter after passing it...the lady tells me that i will likely get my driver's license within 4-6 weeks in the mail but it will most likely be expired by then cause my I-94 expires June 30/08...cause i didn't have my receipt number for my AOS yet...i was sending the forms that day...

LONG STORY SHORT...she told me to go back to an office when i had my AOS receipt number...that that would help and they would re-issue me a license with a longer expiration date...got my numbers and i am going to do it on Monday...will let you know how it goes...

  3. (F)(F)(F)(F)(L)(F)(F)(F)(F)

    WE ARE JUNE FILERS TOO!!!!...

-sent AOS May 30th, 2008...with EAD & AP...

-got NOA on June 10th for AOS & AP

-EAD packet returned & they requested I send payment or an AOS receipt #...even though I specified that I had sent the check with the AOS...duh... :bonk: ...LOL

    -sending EAD back tomorrow.

-received Biometrics appt letter on June 13th...appt for July 2nd @ 8am in St Paul, MN

QUESTION: I have the receipt #'s for my forms and I can't track them on USCIS...how long does it take them get the numbers online generally?...anyone know from experience?...

  4. An uncle is not considered immediate family so you can not get an emergency AP for his death. Sorry, but that's what I have come across before on this forum. If you were so close to him, that you must go then you will be abandoning your visa and will have to start afresh as a K3. Good Luck

thanks...i thought it would be something like that...that's really too bad...i would have like to been there for my parents and my aunt and her family...

  5. :( i just found out that my Uncle died very unexpectedly this morning and was wondering if there was a way to get home to Canada?...got married 2 weeks ago...am just filling out the forms now for AOS...in which i will apply for EAD ad Advance Parole @ the same time...but was just wondering if there's some sort of "emergency" advance parole???...the USCIS doesn' t have much to say about "emergency travel" except that there are "dire consequences" for doing it without a re-entry permit...

you would think there would be something somewhere that says that if you have a death in the family that you could go home for the funeral?????...get an expedited permit???????

any help is welcomed greatly...thank you in advance (F)

  6. Applied for SSN again @ St. Cloud office and they actually put my application through this time...no questions...the lady did make a comment that "if" i get it, it will take longer than usual...4 weeks instead of 2 and that if i didn't get it to take it up with Homeland Security in Bloomington...seemed like they were expecting me...wanted to know who i had e-mailed @ Headquarters...like i had a connection or something...LOL...
  7. it doen't matter whether you get SSN now or after marriage. I didn't get my either coz I've applied for it 2 weeks before my I-94 expired also here in MN. But she said that it won't matter if I get it after marriage. Though I've learned that government employees have no idea of what's going on and what to do! Thay are not really helpful :(

Anyway good luck to you and all the best!

yeah it really doesn't matter when you get it as long as you get it right?...it just makes it easier to get some things done i think, like bank accts, driver's license, getting your name on bills etc...

some government employees have been great...some not so much...LOL...it's the same anywhere...

where in MN are you?...i am about 45 minutes West of Minneapolis/St Paul...nice to talk to someone who immigrated here!!

    take care and good luck!!!

  8. St. Cloud, MN?

yup...minnesota...all she saw was the stamp & she automatically said "We do not issue SSN for those who are not authorized to work"...and that she had turned away many Canadians with k-1 visas...like she deserved a badge or something...LOL...she did give me a letter saying why i was being denied in case anyone needed to know why...

i even called the office back in St. Cloud to cite what i found on their own website...and THAT lady said the same thing as the lady yesterday...i am not authorized to work due to the stamp on my I-94 and even pointed out that i am not a "citizen" and have no rights...nice huh?...basically you can't prove them wrong even with their own policy...she said that if i had a problem with their decision to call the DHS and have the I-94 changed...sure...right...okay...considering you can't even contact them...does it pay to fight it?...or will it just be me getting stressed out and running here and there and getting nowhere...i'm usually up for a fight but i'm tired of bureaucracy...LOL

oh well...i was mainly concerned that i wouldn't be able to file for AOS without it...but i'm not going to sweat it...i'll concentrate on getting married...YAY!!!!...i should still be able to do the driver's license, bank account, etc without it...

I haven't applied for a SSN yet, but I am wondering if it is even worth it without EAD. Everything I have read, even on the application for a SSN says you need a valid non-work reason. I have been trying to figure out this question on another posting... here's a good link that was passed on... https://secure.ssa.gov/apps10/poms.nsf/lnx/0100203510

the whole point is that a K-1 visa is one of the visas that is exempt from needing a reason to work...the K-1 comes under "Employment Authorization by Class of Admission"...that is in the following link...right from the "POMS" or policy manual of the SSA...

    https://secure.ssa.gov/apps10/poms.nsf/lnx/0100203500

i think that i will try again to get into the office and apply, having to rely on rides from others at this point though...as it is, i won't have it in time to apply for AOS...so if i don't get back to the office it won't be the end of the world...although i would like to see that lady's face when i come in again...hee hee...

  9. HA HA!!!!...somewhat vindicated!!...a guy from SSA Headquarters called me back and he said that the office in St Cloud should not have turned me away..that it's not their job to question the documents, just to file the papers if i have i.d. and my I-94...USCIS will verify whether or not my K-1 is valid and whether or not i am authorized to work...AT THE VERY LEAST THEY SHOULD HAVE FILED MY APPLICATION...he even did a 3-way call between himself, the lady @ St Cloud SSA and myself...so that it was understood that i would get my application filed and that they would not waste my time again...WOW...

hey girls & boys!!!...it pays to stand up for yourself...sometimes things do get attention quickly..even with the Government!!!!

Thank you to everyone who gave me support and advice today!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

good luck and best wishes to you all... (F)(L)(F)(L)(F)(L)

  10.

my fiance tried to apply to get her SSN yesterday and was denied...her I-94 is stamped "EMPLOYMENT UNAUTHORIZED"...now they won't give her a SSN...unfortunately we forgot to take that sheet with us explaining that K-1 visa holders don't require specific permission for employment from DHS:

    https://secure.ssa.gov/apps10/poms.nsf/lnx/0100203500

she tried calling today...but they told her that because of the stamp she would have to contact DHS to have it changed...good luck...how do you contact an office or department that says you have to have an appt from INFOPASS and has no phone number listed?...our closest office is Bloomington, MN & there's no phone number...

ANYONE HAVE A NUMBER TO REACH THE IMMIGRATION DEPT OF DHS??????

HELP!!!!! how much of a setback is this???????????

thanks in advance for any advice!!!

p.s. we are getting married April 25, 2008 and want to file for AOS right away...does the fact that she doesn't have a SSN hurt her?...

How much longer is her I-94 valid? Sometimes if the I-94 is w/in two weeks of expireation, they can and will deny you the SS card, no matter what their policy states. You'll have to wait until she gets her GC to obtain the SS card. Otherwise, I would recommend going to a different SS office, w/ the DHS policy printed out, and trying your luck again.

    Good luck,

    -P

i only got here on April 1st...ha ha April Fools...so it's still good til June 30...it's the darn stamp that's on it...

    thanks though... :)

  11. Might be just as easy to try the St. Paul office of SSA... that is the office we used

did you have that stamp on your I-94 too?...i think that is the stumbling block...the dinkus @ the border should never have stamped it that way...

the other problem is that my fiance took the afternoon off work to go to St Cloud...it's 45min away... and he's taken a lot of time off already as i'm sure you can understand...and i guess it's not as important as i thought?????...

  12. St. Cloud, MN?

  13. Are you sure the I-94 is stamped "Work Unauthorized"? There is absolutely no need for them to do this.

    yup...that's what it says..."EMPLOYMENT UNAUTHORIZED"...LOL

it all depends on where you cross...i crossed in Sault Ste Marie in northern Ontario...the guy even told me i wouldn't have a problem applying for a SSN...LOL

one hand doesn't know what the other is doing...that's the government anywhere for ya...LOL

  14. Some states require a SSN for a marriage license; make sure to check if MN is one of them.

nope it's not...got it already...thank god...they ask for SSN but don't need it...in MN anyway...apparently it's that way for a lot of things...driver's license, bank accounts, health insurance...so they say anyway...guess i'll be finding that out...

    thanks & take care!

    Angelyn

  15. hey Kathryn!!!

    fingers and toes crossed!!!

hope the visit goes well...or went well...couldn't tell when you were going from the post...

    hope you are less stressed...

hang in there kiddo...Scott and I are getting married on the 25th!!!...having a reception in the summer after the house is bought...LOL

    take care!!!

  17. Hey everyone....just had a quick question that has been driving me crazy.....my fiance got her packet from montreal....she proceded to complete the online and the written forms....and mailed it back to Montreal...which we tracked and was received just after x-mas....

here is the question part....she just had her medical this tuesday...1-15...she did what the checklist requested completing everything on the list...the medical was the last item....so she mailed the checklist back today(once again...what the checklist said to do)....so when do we enter the waiting list....from when we sent the packet of forms back?...or now that we have mailed the checklist back?....does everyone just jump then gun and mail it back right away?...did we lose out on about a month becasue we did what was requested of us?....just ranting a bit...but I am also really curious....will we get anything back right away?...or will we have to wait a couple weeks just to get the interview date?....I have seen that wait times are down a bit from what they once were...lets keep our fingers crossed this holds true....Thank you for any info....

    Frustrated and STILL WAITING..lol...

  18. Hello all....

Finally at the embassy stage of this wonderful journey and I just had a few questions...

    1. My fiance got her packet from her embassy....in the packet it instructs her to send back a few forms that she needs to fill in online....it then goes on to say that once all items on the checklist have been completed to mail it back.....so the question is...do people actually do that..do they wait until after the medical..or do people just send the checklist back right away??? I guess what it seems like is that we are in a dead spot now with nothing really happening....we have to wait for the medical...do we get on the waiting list for an interview only after the checklist is sent back?...or after she mails the first couple of forms back??

    2. second....I know that I have to complete the affidavit of support...so does this go with her to the embassy on her interview date?...or do I have to mail it in prior to the interview?....

    3. Finally on the Affidavit of support...they ask for the amount of mortgages or encumrances...does this mean every student loan, bank loan, and so on or are they mostly interested in just mortgages??

Thank you all for responses......hope most of you are in a country other than Canada like us....so you don't have to put up with a 4-6 month wait for an interview date....oh well....

  19. My fiance and I filed in June and have recently gone through a pretty good last month....we got our NOA2...NVC has forwarded our case to the Montreal embassy and tonight I discovered that they had received it on the 26th of November...so here is my problem....I thought we were through the last of the long waits.....Tonight I thought I would check to see how long the interviews were being scheduled out....and to my horror it looks like that at the Montreal embassy it is taking 4-6 MONTHS TO GET AN INTERVIEW date.....WHAT!!!!...I was thinking at the most it would be a month and a half...but FOUR TO SIX MONTHS!!!!!!!!!!!!!! Anyone out there had any experience with this latedly...could it be true???? Any one out there have any idea on this subject??...Please respond...my fiance and I are a bit frustrated tonight and would love any responses....

    Thank you....

    Scott & Angelyn....
