  1. Hi, every one! Happy new year!! Can anyone answer my question? My question is, is it OK to deny previous marriage and children on a K1 Visa application? My friend in the Philippines just got engaged. She has 4 children and was married. Now, since there is no divorce in the Philippines, Annulment papers hard to get. But, according to her, their civil marriage is not legit because her ex's birth date is not even right. She is confident that it will not matter. she was able to get a philippine passport with a single status and no problem. My concern is though is not she is not going to disclosed on the application that she has children and married before. I am worry about her and I told to find a legal advice. she said sought one and told her to go for it. Even told her to just adopt her kids later on. I don't think this is right either. So, please anybody I need some help here. It would be a great appreciation if anyone could help me here. Thank you

  2. Addition to that when, you file for your I-485 Adjustment of status, you might need to include your medical exam and immunization. I just received a letter from the USCIS regarding my I-485 application that they need my medical exam and my husbands W-2 1099 copy-this is a tax info copy from his job I think not sure about this one really. I file my I-485 last July 24 and I got the Biometrics Schedules last Aug. 21 without any NOA letter or receipt. Although, check has been cashed.

  3. Hi, We are going to send our AOS and EAD today. I have all the forms and documents gathered. check and double check. I hope this will go through. By the way, I got my tourist visa in Guangzhou, China also. It was a very beautiful place and hope to go back there sometimes.

    Anyway, thank you for your advice and let you know the updates soon hopefully!!!!

    P.S. Until now, I have not received my NOA2 yet. :crying:

I am a bit confused, you say you filed just I-130, that is for a CR-1 or IR-1 visa, and you will be interviewing for the Visa in the foreign country, you only file I-485 not long after you enter the country on a K-3 or K-1 visa. You should be filing I-129F for the K-3, if that is what your plans are.

    I don't have to file the I-129 because I am already here in the State. My status is overstayed B1-B2 visa and recently got married. My husband went to an immigration clinic in town and this is what he advice him to do. File I-130 petition for alien relative first.

    You need to file I-130 AND I-485 at the same time in the same envelope, if the I-130 is filed alone, this will result in USCIS sending the I-130 petition to NVC and on to the Embassy in Manila for a CR-1 visa interview.

    You may try filing I-485 with a copy of the I-130 NOA1 receipt letter.

    Sending the I-485 and the NOA1 receipt this week is what we have in mind too and hope that this will work rather than the other way around. Thank you for your advice and help. This really helps us decide to what to do next. Additional info on NOA1 says that my case has been forwarded to California service center. So, is it good idea to send the I-485 application form there? Since the USCIS forwarded my case over to CSC. I file my I-130 in Nebraska.

    Additional advice would be a great help and appreciate it a lot!

  6. Hi, anybody could give me some idea on my case? My I-130 case is pending and I received a receipt last week and an email says that my case is received and pending. I wonder if I could file my I-485 and I-765 now while my I-130 petition case is pending or should I wait for the second I-130 notice or approval before I can move on. Any help on this matter would be so much appreciated.

  7. That is a good buy! I also recommend newegg.com. A friend of mine just bought 2x512 PC3200 DDR for 70plus buck. The 2gig'r you got is a good deal.   8. Thank you, and hopefully will keep going. I am already here in the state and married. My problem now if we should send both forms (I-485 & I-765) together. I wonder if I can get a work permit before my status is change. We don't have to hurry the process just to get the lower fees because we might not get it properly. Until now, since the last I received the receipt I have not yet heard or received any additional notice on my I-130 case. We were waiting for that notice before we can send the other application because it says on the email that they mailed the instructions. So, I wonder if there is another mail from the USCIS besides the receipt (NOA1) we received.

    These are in your timeline, are these the same? you received these with in 5days time frame, I wonder on how you got the notice, mail or email?

  9. Hi, I received my notice of action or receipt yesterday for my I-130 and look at my case on line, it says that, my petition is received and they mail a notice (which I have not yet receive) -describing how they will process my case.

    Any one with similar situation? Please share, I could used some help

  10. I have the same situation, I filed the I-130 first because that's people advice me to do. It won't hurt to one at a time maybe. Today, we received the receipt and look on line for my case. It say there that my case is received and pending. I mailed the I-130 last July 5, '07. The receipt is not an approval there more to it. Maybe you should try the petition for alien relative first like I do. I hope hoping that me and my husband is on the right track since we did not hire a lawyer. I based this process from on line research for the same status. Good luck to you!!
