CSC being behind never surprises me My card expired yesterday, so now I'm carrying my piece of paper everywhere with me. If they are only halfway done with April, who knows when we'll see our approvals. I think they should ship some cases to VSC

I definitely learned patience after the K3 nightmare we both had back in '07, YG and MAT It's kinda sad that I don't see any other names that went along that journey with us For removal of conditions I am not stressing it. It doesn't have the hardship and emotional stress of being away from my husband so compared to the K3, this feels like a breeze

Thank you for the input so far To answer a couple of questions, my mother-in-law is the joint sponsor on both the K3 and AOS applications.

As I came across on the K3, the wedding pictures etc were all used at the K3 interview, so none of those were taken within the time since i arrived in the US. I was under the impression that things for the AOS interview should be dated after the arrival in the US... are we able to use evidence that is older than that?

We are due to have our interview in just under 2 weeks and are fussing over the evidence to include. We have a joint bank account and I am on my husbands health insurance policy. The problem we have is that we are still living with his parents until I am able to find a job of my own (his wage alone is not sufficient for us to have a place of our own). This means that we have no joint bills or rent proof etc as his parents deal with all their household finances.

I am hoping to have both my mother-in-law and father-in-law write letters stating that both my husband and I have been living with them since my arrival in February.. what other points could/should they include in their letters to further show that our relationship is valid and true?

To me, even with the letters, it seems like minimal evidence for our relationship, so I am worried that the AoS interviewer will deem it as such. I just don't know what else we could include that would further show our commitment to each other

I have a K3 visa which is valid until Feb 2010 and applied for my AOS and EAD in April. Yesterday, I received my Employment Authorisation Card but... it is only valid for 1 year (until June 09).

Is this correct or should it expire when my K3 expires? I'm puzzled that they have only authorised me to work for 12 months of the 18 months remaining on my K3 Are they that confident that I will have my green card within a year?

Firstly, I'm sorry if this is in the wrong section but, I have absolutely no idea where to post this.

My husband is currently working on his 2007 tax return and we have encountered problems.

My husband and I married in February 2007 but, during all of 2007 we lived separately. I resided in the UK while I waited for the K3 visa to be issued and only arrived in the US on 20th Feb 2008. We did not co-mingle any finances at any point in 2007, as we continued to support ourselves in our on countries. I am in the US on a K3 visa, so have no permanent resident status until our AOS is filed and approved.

He can't file as single because he isn't, but I don't see why my UK income should require a US tax return to be filed. Does it? If It does, I know I have to apply for an ITIN number.. but is that really necessary?

Any help or guidance would be hugely appreciated.

my hypothesis is that it is for document verification. The USEM strongly suggests a document verification fee be paid at least two weeks before the interview and then to text DELBROS with the reciept number. The man at Window 37 asked Meryll to pay the visa document fee a second time and the top of the form is written fee paid. The fee was paid on January 7 and DELBROS was texted. This was a month before the February 6 interview.

It makes more sense to believe the process is working poorly and petitioners are punished as a result than to believe the US Embassy is deliberately trying to collect the fee twice.

Ed, I am truly sorry you are both stuck in this process At least you have some idea why though. Are you going to continue trying to contact the USEM? I am still sending positive thoughts your way until this is resolved

USCIS will catch up eventually, what we do not know is how many months it will take.

Bare in mind they were hiring more staff due to the backlog so. once the main part of the backlog is over with, the extra staff should continue to work through the petitions and catch up a bit at a time.

The logic about the potatoes would have been spot-on, except the fact that they bought in an extra person to assist They still wouldn't catch up by the 4th hour but they would catch up a lot faster with 2 instead of 1

Person A gives you 20 potatoes to peel in one hour.

1 hour later Person A gives you 200 potatoes to peel in the same amount of time.

In the 3rd hour Person A gives you 20 potatoes to peel.

Do you think you will catch up by the 4th hour?

Was your wife given any sheets of paper after the interview? If she wasn't, then that is a good sign. Some embassy's do not tell the applicant whether they are approved or not on the day. 4-5 weeks is a long time but it may be normal for your embassy. You might want to check the regional forum for the embassy and ask if this is a normal response to the interview.

I finally sent off the I-130 today! Now what do I actually have to wait for to file I-129 and what do I need to send with it? Do I have to prove support while hes there or is that done once hes here? Now Im really getting nervouse.

You are meant to wait for the I130 receipt notice (NOA1) and file the I129F with a copy of it. However, some people actually mail both petitions together or mail the I129F with a copy of the cashed cheque for the I130.

I would suggest you read a few of the recent topics regarding the K3 visa (specifically those that say it is no longer valid) before you decide to take the K3 route. It seems to be a very grey area at the moment.

As for the affidavit of support, you will need to provide that for your husband to take to his K3 interview. So once you receive your approval (NOA2) and are told your case is being forwarded to the NVC you should begin compiling all the required documents for the affidavit.
