  1. So i would have to change existing AOS i130 for wife to consular processing and And also start new i130 petition for the baby parallely? and baby would also come on ESTA during these visits while waiting for consular processing?
  2. Otherwise, i would have to wait for delivery in October and then few more months before the baby can fly to bring them to USA. In that case also wife would have to come in on ESTA and then file i-485.
  3. So based on discussion so far. I feel like best option would be to send her back to austria by july 14 and bring her back in august via ESTA before baby bump is visible, have delivery in USA, so baby has citizenship and also file her i-485 as PD would be current by then and once i485 is filed she can also stay in the usa.
  4. I understand, i would be happy to visit her instead. But we wanted to delivery in the USA so the baby has USA citizenship. Otherwise we will have to do the whole green card process again for baby too for staying in usa.
  5. Oh, I did not know about ESTA. So, is that easier to get approved with i130 pending and she is pregnant as her baby bump would start showing by that time.
  6. She is from austria, so tourist visa appointment wait time wont be an issue. but what reasoning should she give for a visit to USA so that it gets approved.
  7. on i130 i have put Adjustment of status, as i thought our priority date(march 14) would be current before her j1 visa expires(july16). Would that be a problem now since she will have to do consular processing?
  8. i will be eligible for citizenship november 2026. We are okay if she goes back to home country after october and does consular processing. Has anyone got visitor visa approved while i130 is pending?
  9. What are other ways to bring her back to USA? She is pregnant and we wanted her to be in USA in October to have the delivery here.
  10. I am LPR. My wife's j1 visa Au pair work ended June 16. Since she has stay 30 days after that to travel in the usa. I am assuming her visa overstay days would be counted after july 16. Our i130 priority date is march 14. Which i am thinking will become current in august 1st. Which is when i plan to file her i485. But will this 13 days of visa overstay be a problem? Do we need to submit anything extra?
  11. I filed i-130 for my wife on March14. her current J1 visa ends on July 16. and i have green card from previous marriage. I am guessing Priority date will get current by July1. so i will be able to file her i-485 along with advance parole on July1. But she really wants to visit her home country in July. And come back on travel visa maybe. Should i file for her i-485 because i heard chances of getting travel visa when i-130 is pending are better that when i-485 is pending.
