    AOS of Visiting Spouse on ESTA

    in Adjustment of Status from Work, Student, & Tourist Visas

    Hi Guys,

     

    My spouse is currently visiting me in the US on ESTA and has extended his stay a number of times since entry. He is now nearing the 90 day cut-off for ESTA. Is is possible for him to apply for adjustment of status, we have not filed I-130 yet. He had no intention of doing so initially but due to COVID and with us nearing the end of his visit we are dreading the impending separation. Would USCIS deny us AOS based on the above in your opinion?
