  1. I have no personal experience of this, but it appears that USCIS made an error.

    "If the sponsor did not file tax returns for any reason other than their gross income was below the IRS filing requirements, include a copy of the provisions of any statue, treaty, or regulation that supports the claim that he or she had no duty to file an income tax return with respect to that income."

    A required reference to a statute is only needed if you "did not file tax returns for any reason other than their gross income was below the IRS filing requirements" You did not file any taxes because your income was under IRS filing requirements and no reference should be needed. I would include a copy of your earlier explanation, and then describe even more in detail why you did not file taxes. Maybe make a reference to Publication 501 stating that you are under the limit. http://www.irs.gov/publications/p501/ar02.html#d0e490

    I don't know much about taxes, and maybe you were required to file taxes if someone claimed you on their return or if you received any grants - funding for your studies

  2. ...Telling them you were unemployed or a student isn't clear enough for them. You need to say "I am not required by law to file tax returns because my gross income was below the IRS filing requiresments"

    So, do you think that is all I need to write and send back to USCIS? Sorry if it's an obvious question, it's just that I find it funny that the RFE is such a tedious letter and all that they are asking from me is to say basically, I don't have to file, because the law says so and such, the end. I guess that is bureaucrazy for you.

    I just went to the mailbox and I saw the dreaded yellow paper peeking through the window of the envelope from USCIS.

    My husband and I got three requests altogether.

    Okay,

    The first piece of evidence they want is my tax returns, BUT I had clearly explained (I attached a letter of explanation to the I-864) saying that I did not file taxes for the most recent year - 2006 - because I was unemployed, here is what I actually wrote:

    "I did not file taxes for 2006 and 2005 because I was unemployed both years. At the time, I was attending Purchase College full-time during the 2005-06 academic year."

    I also included an unofficial transcript from my college to show my attendance.

    I had thought that what I had sent was going to be sufficient evidence :-(

    In the RFE it states:

    So does this mean I have to find some "statute, treaty, or regulation" to send to them? Where would I find this crazy piece of evidence? What do I do?

    I included my parents as household members and they filled out the I-864A forms, and they need to send things according to the RFE's, too. I have questions about that too, but I will post that at another time.

    Has anyone else out there ever gotten an RFE like mine - requesting evidence from someone unemployed and having to send a "statute or treaty" supporting the 'claim'?

    Appreciate any one's help, please!

    My husband had his biometrics done on 8/18/07 in New Rochelle, NY. I wrote about his experience and posted it in the AOS forums if anyone is interested. It's posted under "New Rochelle, NY biometrics experience" Basically, all went very well.

    Also, we got RFE's in the mail today! :wacko::unsure:

  5. HEY THANKS FOR THE INFO! I AM TALKING MY BIOMETRICS TOMORROW, HERE IN ORLANDO! I HOPE EVRYTHING GO AS GOOD AS WITH YOUR HUSBAND!

    I HAVE A QUESTION FOR YOU, DID YOUR HASBAND HAD ALREADY A SSN? CAUSE I DONT HAVE ONE YET!

    Hiya,

    No my husband doesn't have his SSN# yet. I guess he will be able to apply for one when he hopefully gets either his EAD or green card. If you don't have an SSN# now, I wouldn't worry about it, especially for the biometrics. At the biometrics, you will need to write in your USCIS A#(this number is on your appointment letter) on the form they will give you to fill out when you are there.

    Just remember to bring your ID and your appointment letter. That's all my husband needed at least. Perhaps get there a little earlier just in case. Maybe you will get as lucky as Leo and they may take you in earlier.

    Much luck to you tomorrow, most likely, it'll be really quick and painless, so don't worry too much :-)

  6. Hi all,

    Just thought I would share my husbands experience getting his biometrics done in New Rochelle, NY.

    His appointment was on 8/18/07 on Sat at 12pm. We live only 15-20 minutes away from the location fortunately, but to be safe we went earlier. The location of the biometrics in New Rochelle is in the downtown area and it's quite busy around there. Parking is available on the street - parking meters of course. You might have to look for parking a little but, it's not too bad - at least it's not Manhattan. I didn't end up parking though, I just dropped my husband off at around 11:15am. We expected the biometrics office to be in a building similar to a post office or other big federal looking building, but it was just a small place next to some regular shops. So my husband, Leo, goes in and shows his appointment letter, and they gave him a form to fill out. He had to write in his A# (which is found on your appointment letter) and his name and place of birth, stuff like that. He was then directed to a table to get a number. Leo says the place was just like one big room (the size of a deli or something) with a wall separating half of it. One half of the room was where the fingerprinting/photographing took place. And the other half of the room was where Leo sat and waited for just practically a minute. There weren't many other people around. He was called up right away. He says the man/officer was pleasant, did his thing - prints and photo and then Leo was given an evaluation card to fill out about his experience there. The whole thing took about 10-15 minutes total. Not too shabby I must say :-)

  8. If a parent is supplementing your income, then if you live in the same household as them your parent should be submitting an I-864A contract between household member and sponsor. Did they do an I-864 Joint sponsor, or I-864A?

    yes, I know. I should've mentioned both my parents each submitted a I-864A form, I submitted the I-864. We all live together.

    But the problem isn't about the forms, it's about change of income for all of us.

    It's really my parents income that is helping us. I just don't make enough. Again, my parents will be retiring/have retired so their income will change (and I don't know what their new incomes will be yet) and I will be quitting my current job. I'm just hoping this won't be causing too many problems with the process of the paperwork and all. Basically, I'm wondering if I need to contact USCIS now or wait until the interview to submit new evidence? And if so, would I need to fill out new I-864 and I-864A forms?

  9. Hi all,

    My husband and I have submitted our AOS package just recently. Actually, we got the NOA's today.

    My questions/problems (this may be a bit lengthy):

    But first some background info:

    On the I-864, I am the main and only sponsor. I am using my parents income to supplement my own. Actually I could have used just one of my parents, but since they filed taxes jointly, I just included them both.

    I have a part-time job and I just started it this February. On the I-864 it asks for annual income - I just estimated about how much I would earn in a year.

    So here's my first problem: Now, I will be leaving my current job to find another or I'm thinking of concentrating on going back to school, so I guess I MAY be unemployed for some time. Will I need to contact USCIS? Should I send something in, or just call and inform someone of the change?

    Second problem: My mom has retired this month, so obviously her income has changed. And my dad will be retiring in about 6 to 8 months time (perhaps when my husband and I will (hopefully) get our interview before or by that time) Do I have to contact USCIS or just wait until the interview and bring in the new evidence and maybe fill out a new I-864/864a's?

    I hope that I made sense.

  10. If you are adjusting status why does your profile show applying for naturalization? I would think you would show AOS pending.

    I-134 is only used for K-1, or K-3 visa interview at the embassy or consulate, if you are fileing for AOS you use I-864.

    Whoops, I didn't realize about the naturalization thing, I just made a mistake, that's all... I'm not sure how to change that...I'll figure it out...

    I just found this site, I'm glad there's a place like this to help others with this crazy paperwork!

    My husband and I got married in January 2007 and we are now in the process of applying for his AOS. Some background: my husband is from Brazil and I am a US citizen, he had been living in the US for the past 6 years, his tourist visa expired in 1999. We met and got married here in the US. This is our first time filling out any kind of USCIS paperwork.

    I'm confused about the I-134 form (isn't it just for K1 or K3 visas or something?) Do I need to fill the I-134 along with the I-864 form? I just want to make sure.
