  1. My wife is applying for her mother to immigrate to the USA (I-130).  We received a notice stating:

    "The both certificate submitted on behalf of [NAME] shows that the birth was registered in 2014, approximately 29 years after the actual event occurred.  According to the State Departments Reciprocity, Vietnam is permitted late registration with reason.  You provided the birth certificate, but it does not satisfy all the requirements.  You must submit the reason for late registration.

    Submit the oldest available evidence that establishes that [NAME] is the mother of [NAME].  Submit as much evidence as possible.  This evidence may include, but is not limited to:

     

    -Religious Documents

    -Early School Records

    -Medical Records

    -Census Records

    -Affidavits

    -DNA testing (no centers in Vietnam)

     

    Is anyone familiar with this problem in Vietnam and what did you do to correct the issue?  In advance, we greatly appreciate your help and insight!

    Hello all.

    I have a quick i-864 question. I am filing with a joint sponsor, my parents, who have plenty of income and savings to meet the requirements. However, I have been living abroad for the better part of 4 years. In 2007, i filed taxes, and have a return. In 2009 I just (last week) filed taxes on my foreign income because I am well below the 90,000 dollar exception. I will be filing the 2010 taxes as soon as I can. However, in 2008 I really didn't have any taxeable income in any foreign country as I moved from Argentina to Colombia, and was studying spanish, etc... When I called the IRS they said that there was NO NEED to file any tax return for that year.

    For the i864 will it matter at all if i have no tax return for that year, given that my joint sponsor can meet all the requirements?

    or should i just file a tax return that says 0 dollars in income, just to have it?

  3. Thanks for the responses. I'll check more into the K-3, but looks like the tourist visa may be all we can do until we get ready to move back to the US. We'll ask at the Embassy here in Nicaragua.

    I am wondering the same thing. I married a Vietnamese and we will eventually apply for the I-130 (DCF), but we just want to live in Vietnam for now and just visit the USA. We have already applied for her tourist visa once, she went to the interview, and they denied her! They said her job does not pay well enough. They are mainly looking for PROOF that she WILL come back to Vietnam and not immigrate to/live in the USA illegally. This time, we will give supporting documents from BOTH of our employers and show my renewed labor contracts and hopefully that will be enough. Oh yeah, the visa officer also wanted to see my passport, but my wife didn't have with her during her interview. Here it costs $131 USD just to apply for the tourist visa!
