  1. Hello guys: I need help so I am sponsoring my mom and dad, my dad is in the US he couldnt leave because the covid 19 so I am doing his adjustment of status and is in process, with my mom since she is outside of the US I am in NVC stage upload all the documents, so my confusion is:

     

    1. on the I864 in part 5 household size I dont know where to listed my dad because he lives with me but he is no lawfull permanent resident so I cant list him on item 6 and item 7 I am no using his income and item  Number 5. Type or print the number of any other dependents. You must include each and every person whom you have claimed as a dependent on your most recent Federal income tax return, even if that person is not related to you. Even if you are not legally obligated to support that person, you must include the person if, in fact, you did support that person and claimed the person as a dependent. I have not claim my dad in our taxes so I am so confuse where should I list him? please help me !

     

    2 on part 2 information about the principal immigrant>>> so in that part i will listed my mom and dad on each form correct ? so each one is a principal

    immigrant? 

     

    3. On part 3 i have to check number 1 YES option correct ?

  2. Good afternoon, I am almost ready with my dads adjustment of status, I have a question may silly one, I just exhausted so please i appreciate your help :)

     

    So in part part 2.family status (your household) 

     

    Beforel he came to US he use to live in Colombia with my mom and brothers.... Here now he is living with me, my husband and my son, So if I understand correctly I will list my dad first (his is the applicant of the I-485 green card) and second myself, then my husband and my son.... correct? 

     

    PArt 3. your household resources and assets 

     

    So in this part because we are part of the household I was thinking to add the checking account current balance that we have ? and same with the savings??

     

    And after they ask for debts.... thats for the debst that my dad has??

    Thank you for your help yes make sense what you mention about the employee situation, I dont have the transcript ( Do i need the transcript)... what i have is the w2 (from my husband), 1040, and schedule C from my job.

     

    So my job is a company contractor of the county they are the one that does my deposit to my account.. today I just got great news of new job in a bank, i know how much i will be making should i listed that and calculate the totatl income year or better no? i havent started until next week...

I need some help please! so just for information I filed for that the I-130 form on 2019, he came to visit us in january 2020 and because the covid the aiport is closed so while waiting we got the I-130 approved so now I am filing the adjustment of status and of course I have to add the I-944 form which i am helping my dad, I am the sponsor and my husband will filed the I-864A since we files taxes together plus with his income we will be able to meet the income requirement.... so here is the questions for the form I-944 once again thank you:

     

    Maybe silly questions and please forgive me i just tired i been working a lot and plus helping dad...

     

    - Part 2.>>> list the individuals in your household that means the member living here in the US or in his foreign house?, so I start listing my dad first, then next on B. my self as a daughter, C. my husband and D. my son.... we all 4 live together... is that correct?

     

    -Part 3.household income, so in A, i guess i will list my dad, what i should respond for the question>. did you or your household members, whose income is being included, file a federal tax return? yes or no >>>. my dad just came in january and of course he haven't file taxes he just started living here so, and also what to choose in the boxes like other and what i should explain i am so confused :( 

     

    In the same part part 3 i am going to list me and husband so because we filed taxes together where it says total income from tax return or item 1 in w2, so because we filed together is the same total income listed in our 1040 so should I put the same amount for him and myself?

  5. i need help too please:

    in the form I-864 they ask for employment info, I am a contractor, I a  driver for the school district here in my county so I listed as a self employment, correct?

    also they ask for the current income? so far this year i worked from january until march because the covid, I still active in the system for the school district so when they reopen I go back to my job, so for the current income should i list the total that i got from january to march? or should I calculate how much i will make to the end of the year? 

     

    and last question, they ask for the last three years taxes amount, where i can find that amount on the form 1040? which line?

    Note: This is a adjusment of status for my dad, I am the sponsor and my husband will fill out the I864A because i filed taxes with him so as a household member, and also to have enough income to support my dad ..

    For the diplomas she does have some copies back home but we didnt have time with her I94 expiring and didnt want her to be out of status so we listed them without including copies.

     

    For the money part, we listed just her available balance from her checking, she got a copy of her bank statement and her retirement pension, Showing she is receiving monthly income. She owns her home but didnt have the paperwork with her so we didnt list it.

     

    You do not need to list yourself, remember we are talking about her household back home, she is not a PR yet so if she has to list whoever is living "officially" back home with her.

     

    Her file was accepted and we got copies of her receipt by mail.

    hello! I just writing because I am in the same situation I am so stress out because my dads I94 will expired on july 23, so as long if i sent everything before that date its ok? I have some questions about the forms if you can please help me I appreciate that: 

     

    So I filed I130 on october 2019 for my dad and mom, but dad came alone with his tourist visa  on january 2020 (mom stay back home because has some stuff to get done) ... so american airlines cancel my dads ticket like three times because covid 19, on june 09/2020 we have the surprise of the I130 was approved.... so I was looking for option and of course adjustment of the status was the answer at this point.

     

    Sorry if is to much to ask, is just the forms sometimes little confuse.

     

    1. So i am going to file I864 for my dad, but because my income is not enough and also I always file taxes with my husband so with his income we will have enough to support my dad, so if I am correct i filed I864 and husband I864a? 

     

    Questions form I864:

     

    - On part 1. the box I have to choose will be 1a. I am the petitioner. I filed or I am filing for the immigration of my relative

    - When they ask my income from the last three years, where and what line on my 1040 is the income that I have to listed?

    -part 3. so I choose on 1. I am sponsoring the principal immigrant named in part 2. (which i listed my dad) and i put a X on yes...its correct? 

    -part 3, 29.enter the total i just put 1 which is for my dad 

    - part 6, on 7. they ask for my current individual annual income... that means my income so far for this year or what i make last year?

    - part 5. sponsors household size I am attaching the picture what i answer, so i listed my dad fisrt and myself my husband and my son that will be total of 4.. on 7 OPTIONAL If you have siblings, parents or adults children with the same principal residence who are combining their income with yours submitting form I864A, enter the number here.... so as I mention before my husband will filed I864A, so I dont have to put one since i will be accounting my husband twice correct? 

     

    I know is a lot and thank you so much for taking your time I just very stress getting everything ready.

    hello! so we are in the same situation, I am doing the adjustment of status for my dad he came with tourist visa and because the covid airport is close in our country , I did a petition last year I filed the I130 form him and was approved on june 2020, so anyways i guess we can help each other, here is what i found on uscis, So we the petitioner has to file that form and your mom is the applicant she has to attach that form with the I485 and the other forms :) hopefully this helps, I found it on page 1 on instructions form I864 :) 

     

    Who Needs to Submit Form I-864? The following immigrants are required by law to submit Form I-864 completed by the petitioner to obtain an immigrant visa overseas or to adjust status to that of a lawful permanent resident in the United States: 1. All immediate relatives of U.S. citizens (spouses, unmarried children under 21 years of age, and parents of U.S. citizens 21 years of age and older); 2. All family-based preference immigrants (unmarried sons and daughters of U.S. citizens, spouses and unmarried sons and daughters of lawful permanent residents, married sons and daughters of U.S. citizens, and brothers and sisters of U.S. citizens 21 years of age and older); and 3. Employment-based preference immigrants in cases only when a U.S. citizen, lawful permanent resident, or U.S. national relative filed the immigrant visa petition or such relative has a significant ownership interest (five percent or more) in the entity that filed the petition

  9. Hello, so I have some questions if somebody has a similar situation or any info on this:

     

    I applied for my dad with the form I-130 back in october 2019.... in january 2020 he came to visit me with his tourist visa his intentions never was to stay actually he had a return ticket for may 2020, but was cancelled by american airlines because the airport in Colombia is Closed and will remain closed for long time due to COVID 19, so I was so stress out because I dont want dad to have any problems with immigration..... surprise on june 9 the I-130 was approved and was sent to NVC (national Visa center, which I already spoke with them and since dad is here i have go on their website and file a inquiry informing that he is here and I am going to do Adjustment of status).

     

    When I saw his approved online I called USCIS and told them the situation that i mention before and they told e since he is here i can filed adjustment of status all i have to do is add a copy of the I-797 action of notice of his approved with the package of the Adjustment.

     

    I just want to see if anybody has a similar situation, I am little bit worry because I dont want to get a denial because he came in a tourist visa because the intention never was to stay?

    I have questions about the form I-485 if u can help me:

     

    1. in page 3 they ask for current immigration status? that will be tourist or b2 temporary tourist ?

    2. in part 2, page 3... two options applicant or derivate? dad will be applicant? 

    3. part 2 page 3, Family based, for my dad should i choose the first box: Immediate relative ...parent of a US citizen..., form I-130 ?

    4. we haven't receive the A number yet, shoud I put None or N/A or leave it blank?

    5. in the last part where they ask for the interpreter and the prepare, Me the daughter I filed all the form and translate everything for him because he doesn't speak to much english... so can i put my name under interpreter and prepare ??

    So I have to add the form I864 and here is my question: I always filed taxes with my husband and both incomes are enough to support my dad, just to make sure i have to filed I864 in my name and my husband has to filed I864A?

    Hey, I dont have that answer but I just want to say congratulations!!!! your case was super fast thats awesome!!!!!! I filed for mom and dad last year the I-130, my dad came to visit with his tourist visa on january 2020 and now he cant return to Colombia because the aiport is closed due to covid 19, so i am doing all the paperwork to adjust his status, you may me ask you what did you sent with your parents like documents, forms...I appreciate that..

  11. Hello guys, I need some help please! 

     

    So I file the I-130 for my mom and dad back in October 08/2019, to the date i receive the notice saying my case is on process...

     

    My dad came in january 23/2020 with his tourist visa and he had a flight back to Colombia in may 25/2020 but the flight was cancelled by american airlines because the airport in Colombia is closed due to COVID 19 and looks like is going to be closed for a while unfortunately...yes is a difficult situation and super stress since is nothing we can do about it.

     

    So I did a lot of research to see what was the best option, either apply for:

     

    A. extension I-539, which can take months to get approve or if it get denied that will be a problem because his tourist visa will be cancelled and etc.

    B. since I applied for I-130 last year, and is not approved yet but is on process was thinking about adjustment of status I-485 which i know takes time but at least doing the legal way.

    I called USCIS two times and they told me he can apply for adjustment status since he came with a legal visa and was here already in the USA...

    My question is, I am working on the forms that i have to send which is form I485, Form I944, Form I864 ...etc, so me and my husband will sponsor my dad financially, what documents we need to attach to the application.

    i have a situation i need a guide, so I filed I-130 for my mom and dad on October 2019, as today I haven't receive anything beside the paper saying that they receive the documents and working on my cases; my dad came to visit me (he has a tourist visa) on January 2020 and he still here with me, he has a return ticket on may 23 but we just got a call from american airlines and inform us that the ticket is cancelled because the airport in Colombia still close due to the COVID 19, ok so my concern is that as a tourist visa he is allow to be here six months which that will be july 23/2020, We dont want hi to overstay so my question is what is the best way to handle this knowing that we have a case open with uscis (I-130),  should be apply for I-539 visa Extension or should I apply for I-485 adjustment of status? please i need some help and thank you.
