  1. Frustrated!

    Just went thru the forms and found out that Form I-864 Question 6, 7 and 18 was not filled out. The packet has sent to Chicago on Monday!!!!

    I know it is sillly that I did not see it before I have sent them off !!! oh well what a dumb!

    Now I dont know what to do...should I send a supplement lettter re. those numbers and explain that I forgot to filled them in, or should I type and re-send the form I-864 again or I just need to wait and getting RFE???

    And also I have attached only one copy of my wife's passport page, K-1 visa and departure card I94. It suppose to be one for each application right..??? ( I-131 and I-765)

    Any input on what I should do???

    I would try to call the national call centre and ask them first although I don't know how competent the people who work there really are. If you wait for an RFE....that would set you back as far as timing goes. You could try to send in a supplement letter with a copy of your original application and then highlight the areas that you missed. I don't see how that would hurt. Yes it is supposed to be one copy for each application (as I think they get separated and each appl goes to a different area). Can you re-submit the entire application again? Make sure the next time you submit anything to them......check, check and then check again before mailing anything to USCIS. Keep asking this question on this site.....alot of people on this site have great advice.

    When I move, I'll be moving with approximately 70-80 boxes and 4 pieces of small furniture. A table, a small armoire, a coffee table and a chair.

    Did anyone else move with this kind of load and how much did it cost you approximately and with who if you don't mind my asking. I'm trying to figure out a cost before calling companies for quotes as I still have boxes to pack of stuff in my grandparents basement.

    I moved from Hamilton Ontario. I sold my house and most of the contents of it. All I had was about two car loads of stuff that was most important to me. I drove back to visit people so in two trips I got my stuff here. I put it in storage for about 4 months. It would have cost too much to bring my stuff. It was cheaper to sell my stuff and buy new stuff here rather than pay for a truck.

  3. Hi, I am new to here and just got married Monday. She is from Thailand and is here on visitor visa, (she has a 10 year visa). She is going back to Thailand in a month to stay until we get her K3. Did we make a mistake getting married? She did not come here on this trip to immigrate, we did not plan to marry but just wanted to. Should we wait until she leaves the US before filing the 130? Did we slow down the process? Any information or suggestions would be appreciated.

    Btw, she will probably come here again in Dec for a few weeks, but then go back and plan our Buddhist wedding in Thailand.

    You didn't make a mistake but I may be wrong but she doesn't have to go back to Thailand to file K-3. If you can prove that she didn't come to the u.s just to marry you and stay here and get her green card then she can stay and file for a AOS.

  4. We got there 1 hour early. We were called into the interview pretty close to our scheduled appointment time. It was a lady. She asked us to sit down, with me (immigrant) had to sit on the right???? She introduced herself and we shock her hand. She swore us in. Then is opened up my file which was about 8 inches thick. My original I-129f, I-130, EAD, 485 applications were all there. She asked for our ID's. She just asked me ALL the same questions that were on the 485 application. With her red pen she would mark things on the 485 as she went along. She also made marks along the right side of the 485 appl where it said "for office use only". She asked my husband (petitioner) what his date of birth and his place of birth. That was all she asked him. Then she asked for something to prove that we live together like bank statements.....I had so much to show her but she said that the bank statements were good enough. Then she said she was going to approve our application. That I would be getting a letter in afew days and then my GC in the mail in about 10 days. She said I could apply for citizenship after 3 years of living in the u.s. She congratulated us and we thanked her and said good bye. It is very professional and smooth. I do think they can tell by the application if there are any questionable items on your application. We were lucky that everything was in order. Hope this helps others. She also kept my EAD card and canceled my K-3 visa in my passport by putting a long line across it with APAC letters on it.

  5. Hi, I'm happy to say that after almost 2 years, we are going for our green card interview today. I have to say that if it weren't for the great people on this site I would have made alot of mistakes and the journey would have been alot longer (after talking to people who went through the process without consulting on this site). Yes, I did have to invest alot of my own time but we saved alot of money on hiring a lawyer. Thanks you VJ for all your help.

  6. I came into u.s. on a k-3 visa. I also have a EAD card. I applied for work authorization right away when I came in and I got the card and 4 weeks ago I applied for a SSN and I'm still waiting. The SSN office said it was at INS and there was nothing they could do to speed it up.

    I cannot tell from your timeline but on what eligibility basis are you applying on as it is not obvious that you have work authorization?

    K-3 is not SSN eligible until EAD card has been approved

    I do have an EAD card.

  7. wow...are you kidding....you mean I could have started a small business while waiting for my work card?

    yes, you could...

    the only thing is if you need a bank account for that, you will need to use your SO's one, and he will need to report any income on his/her 1040..

    in other words it will be his/her business ;)

    I know people who have done it with great success

  8. HI everyone,

    I came into u.s. with k-3. I decided to apply for EAD without the AOS application as my 2 year anniversary will be in April and I plan on filing at the end of the year (so I don't have to remove conditions on the AOS and I can get a 10 year green card). There was no A# on my NOA for EAD (I-765) and when I went to my biometerics apt. today she said that she wasn't going to submit an A# with my biometerics. Will that cause a problem for my EAD to get approved? Hope someone can help. Thanks

  9. Ooooh the joys of just patiently waiting! How often can I actual come home to Canada and go back to the U.S. to visit my hubby?

    Has anyone ever decided to for-go to the whole K3 visa and stay in the U.S. to do AOS?

    OR....

    Has anyone ever attempted to find a job while the K3 is processing....obtained an H1B? Is that legal?

    Sometimes I wish I would've done this differently, but I guess there's not much you can do!

    Hi there,

    I traveled back and forth to canada while I waited for my k-3 to be processed. You might have a hard time at the border and you might not. It's all depends on the officer you get on that day that you cross. If you take along evidence that you plan on returning back to Canada and are just visiting the u.s. for a short visit...they might let you go in or they might not. I got pulled over once and was drilled and other times they just told me not to stay longer than 6 months. Just don't lie when you cross over. That is the only advice I have for you. I also think it is against the law to go into the u.s. and apply for AOS with that intend in mind. If you went into the u.s. for other reasons and then met your spouse and got married and then decided to stay and not return.... then your intend was not to stay when you left Canada. It's all about your INTENT. ONce you start one application I don't think you can abandon it and try another application so decide which way you want to go and stick with it. I went the k-3 way and kept visiting the u.s. till I got my k-3 visa approved. I hope this helps you.

    Hope everyone's journey is going smoothly and quickly!!! I just got my K-3 on April 14, 2008 and now I am in the u.s. and just got my NOA (without the AOS) for my EAD. Now I'm trying to time the AOS application so I don't have to pay the $400.??? dollars to remove the conditions. Can I get someone's opinion of when the best time is to do that? My K-3 expires in April 2010, 08. Thanks alot.

  11. Yes, you can visit the US while your petitions are in process. Just have obvious and strong ties to Canada, like a job, a home, bills to pay etc. There's no guarantee they'll let you in, but lots of people do it all the time. See the Canada forum and have a search for similar topics for more tips.

    And what do you mean have him apply to Canada at the same time? you mean have your husband apply for permanent residency to Canada at the same time as he's petitioning for you to move to the US? You could try it, but if either immigration office finds out somehow, one or both will be rejected outright if they think you're not serious about becoming a permanent resident of either particular country. Pick one and work on that. If it doesn't work out, *then* do the other one.

    Thanks for your input Reba ! That was so nice of you to let me know your thoughts and confirm what we had wondered about doing both processes at the same time. I pray I can get in to see him this summer or I feel like I will go nuts! I live in far northern Ontario, small town.... I don't like feeling like I have no control over anything! Looks like you and your husband had to wait quite a while to be able to live together. Glad it all seems to have worked out for you both!

    I am from the Toronto area and I visited my husband who lived in Iowa quite afew times. I only had a problem once and it wasn't so bad. I don't think you will have a problem visiting him but it is a good idea to have proof that you will be returning to Canada. There were afew times that the border officer just said to me "you can't stay longer than 6 months...o.k.". As far as applying to both countries, it doesn't make sense. You need decide which country you are going to live in. I spent alot of time in the u.s. while waiting for my k-3 interview in Montreal. Good Luck
