Curious; even though the daughter was not in his physical custody for more than 6 months for each of the last 3 years, can he still claim the child tax credits?

That is what I am wondering, even though my wife and daughter weren't here physically is it possible for me to claim them as dependents as I did support both of them financially..

  2. Hello Everyone,

I am going to amend my taxes from the past 3 years now that my wife and daughter has immigrated here this past June 27th and I was wondering other than their Social Security number is there anything else I should bring as my wife wasn't employed? Would I be credited for my daughter and wife to potentially receive larger refunds, there are tax people that say yes then others that say no so I am confused?

  3. Hey everyone going through the embassy in the Dominican Republic, I was wondering if anyone has any update of what dates they are processing for IR1, IR2.

My wife and daughter was DQ'd on June 9th 2020 and I still haven't received any info about our case and I even asked my local representatives for help with no luck. I would just like to know the people who have recently had interviews tell me when they were DQ'd and did not have their cases expedited so I can get a general sense how things are moving. I appreciate any help thanks.

  4. Hello everyone,

I recently have had a family death where the husband of my sister has passed away. She has two children (10, 12) and is pregnant with a third and should be giving birth within two months. The wake and funeral is being held this upcoming Thursday and Friday. We would like my wife to attend but also after help my sister tend to her children and newborn as she grieves. She is not currently working and I plan on helping as much as I can financially where I can. My wife being here would be able to ease a lot of hardship on my sister and myself as we both can work to earn money and assist with my sister's needs as well. My question is that does this seem something that the embassy in the Dominican Republic consider approving or does this not meet the need for urgent humanitarian reasons? My wife and step daughter are just waiting for the embassy appointment for IR1, IR2 visas and were denied a few months ago for an expedite for my wife as we wanted to get here for an employment to take care of my mother as a PCA as my mother has numerous illnesses and would need help due to covid. Any thoughts or suggestions would be appreciated.

I think you are over thinking :) Of course the income minimum guidelines are just that- guidelines but you have a decent amount. You can also find someone who is willing to be a joint sponsor in case you get a RFE and then at least have the paperwork/person ready to go. It would be a good idea to bring proof of the health insurance from your HR as well as the details of the plan (personally I think it looks better/more legit/more thought through).

Ok thanks, I also have dental and vision insurance for them as of right now because they didn't require SS#, should I bring that along as well with my company paid life insurance with her as beneficiary or is that excessive?

  6. Hello all,

My wife(of 3 years this December) and step daughter was DQ'd on June 3rd and 10th  and I am just waiting anxiously for the interview at the U.S embassy in the Dominican Republic now. I am starting to get nervous about the income requirements as I keep investigating more and more. I made just over 42k last year for a family household size of three and my health insurance will allow me to add my wife and daughter to my insurance within 30 days. So my wife will come here and will take a cna training class to help take care of my mother as she receives care for about 15 hours a week. While she is taking care of my mother part time she will be also taken english courses to better her english language skills so she can land more opportunities for employment as she has experience as a receptionist. I am not sure if these things are enough to prove that she and my daughter will not be a public charge as I am reading in some places online that with the new public charge rule that embassies would like the income to be around 200% and the beneficiary be highly educated. I would just like people's opinion if they think I will be alright or should I look for a co sponsor, I believe I may be fine but I am just so nervous I am doubting myself.  Also  for the interview when I bring proof of a health care plan from my human resources department should I also bring details of the plan such as deductibles and copayments and other specifics. Any help will be appreciated.

I'd fill out a DS-5540 for her.   It is now being collected at the NVC - started in Feb as I recall.   All the questions relate to her - so yes her income would be zero and if you don't live in a community property state, her debt is zero.

I submitted everything to the NVC and then received a DQ now I am just waiting for a interview appointment at the embassy in Santo Domingo. I didn't see the DS 5540 on the CEAC but I want to make sure it is filled out just in case. I live in Massachusetts so it is not a community property state so I am not really sure how that would work because it says the family courts considers how everything is divided.

  8. Hello everyone, I was wondering if any one can help me out as I have a few questions with the DS- 5540 for my CR-1 visa

1.Do I even need to fill it out as my priority date is Dec 20, 2018 .

    2. If so, is this questionnaire based solely on my wife (beneficiary) information or does that include me (petitioner). Such as question 9 regarding income, my wife doesn't officially have a job in the Dominican Republic she did work as a secretary before she gave birth to my step daughter 4 years ago but they terminated her as she couldn't work after giving birth. So can I include my income or should I just $0?

    3. Likewise with question 10 regarding debt. She has no debt either here in the U.S or in the Dominican Republic should I say $0 or should I include mine which is significant as I owe student loans and for a car but my payment history for all my debt has been 100% for a very long time.

I have a few other questions but I believe I maybe be able to answer them once/if  I get advice on any of the questions above.

    Thanks for any help given.

    Thanks

  9. In regards to the DS-5560 does the petitioner counts towards the public charge? I have medial insurance through the ACA but when my wife and daughter arrive I'll will be switching my insurance to a family plan through my employer so neither of them will be  considered a public charge but will it negatively affect their case. It also asks about debt, is that the benificiary's debt or do I list my own debt because I have a large debt from college? Thanks for any help

  10. Hey everyone, had just uploaded all the documents for my wife and step daughter this past Saturday and this morning I received an email from NVC stating that my step daughters case was Documentarily Qualified so I logged into her case on ceac and her case status is accepted. Should I worry that her case documents have already been accepted after two days since the normal timeline of the NVC states they are reviewing cases submitted from February 14 2020 because of the pandemic? I am worried that they made their decision already and it means no. If anyone has had experience with this or has any clue why so fast I would appreciate it. Thanks.

I don't see anywhere on the State Department website where it says to do that. Just passport style photos taken in the last 6 months. Maybe its a option under "other documents" you want to submit?

    Here's instructions for Scanning

    https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-8-scan-collected-documents.html

Here's the NVC Guide from the State Department to help.

    Best of Luck

Thank you very much for taking the time and clarifying that. I appreciate it.

I just scanned the current passport photos I had. If you have newer passport photos scan them. I think mostly they want to see photos of the two of you together. As for the documents for the AOS, I am assuming you mean Adjustment of Status. Google NVC Adjustment of Status documents or if you know where to go on the NVC website, do what it says to do there. In most cases, yes some documents may be repetitive. If AOS is Affidavit of Support, those documents are your financial statements, ie. IRS transcripts, W-2's, 1099's, any other proof of income. The ceac page is pretty much self explanatory. You can also go to ASK NVC or call NVC and they will answer your questions there. NVC will tell you what documents you need on the summary page of the ceac page at the top right where it says to view messages(if you have any). Also you will get an email telling you to log in to ceac and view your messages. As for the compression issue go to wecompress.com it's free. And no, I would not separate the documents. Be aware that due to COVID-19, offices dealing with immigration are operating with limited staff.

So they want me to upload photos of us as well as the passport photos for the DS-260?

  13. Hello,

    • On the ceac page it is asking for me to upload photos , are these supposed to be newer passport photos and if so, do I scan them being placed dead center of the scanner or can the be placed elsewhere?
    • Do I submit some of the same documents that I did for the DS-260 for the AOS such as marriage certificate? I don't want to be repetitive and annoy the NVC by repeating the same documents.
    • Lastly I have my wife's police record and it is two pages then a translation. I put them all together and the file size is around 5 mb, I tried to compress it but it is still over 2 mb. Would it be okay to separate the document and just add a note in the comments why I did that or would create a problem?

Thanks for any help that is given

  14. Hello,

I have an issue with my most recent tax filing that was done via paper mail before everything shut down. It still hasn't been processed by the IRS so I can't retrieve a copy of my tax transcript and so I only have a copy of what I filed from H&R block the 1040 form. Would it be an issue if I submitted that along with my W2 and pay stubs as my previous years I didn't make enough and this year I made double the amount needed above the poverty level. Thanks for any help.
