i hope someone could help me ..

i am a K1 and i arrived here last december 29,2008 and got married january 30th.

the situation is my husband hired a lawyer to help us in our paper and to avoid RFE. he hired him from processing K1, AOS and interview. in my K1 ,all the papers that he prepared really look good , organized and actually when we sent it to the USCIS it runs smoothly i mean no RFE, and during my interview at the us embassy i got approved immediately. and thats the reason we trust him.

2nd week of February we met him to pay of what we owed and ask him what are the documents he need for my AOS. in our meeting he told us how much money needed in filing AOS together with the EAD , and he asked if we want to file application for travel document which is I-131 but it is not included in 1010 so we need to pay another 305 dollars , my husband and i decided not to include that cause it is not necessary. last week of february we met him again , we gave the documents that he need and we signed the forms . during signing he told us that he forgot to tell us that we need to file I-130 which is petition for alien relative and it is required not optional and we need 355 dollars for that and i was shocked coz my husband already petition me for alien fiance. we asked him why we need to petition again and he said thats the USCIS law, we better to follow them to avoid problem in the future. we came home very frustrated cause we really want to send the packet that time and we only have 1010 .

1st week of march at the third time we met our lawyer again , we gave him the money order worth 355 for I-130 and 1010 for AOS AND EAD, he asked us if we are sure not to include the I-131 and we told him no if we pay another 305 but if its free we can include that . he said its not included. so we end up not filing it. OUR lawyer sent the packet last march 28th and my k1 visa expired in that date. we received RFE because we dont have I-693 medical examination and vaccination record we end up paying 285 in the civil surgeon.

when I searched AOS here in visajourney i did not find I-130 that is included in filing an AOS on a K1 case and i noticed that mostly of the AOS filers they have I-131 which is the application for travel document or the advance parole. im wondering and confused about that.....

my question is, is I-130 petition for alien relative is included in filing AOS or not?.. and I-131 application for travel document or the advance parole is not inlcuded in AOS i mean if we file that is it true that we will pay 305 dollars for that?...... is my lawyer correct or not ?

i already received an email from CRIS about my EAD telling me that my card is already ordered.. but i have not received the card yet.. i hope soon...

I just called NVC!!!!! The lady said to allow 90 days for them to receive the approval from USCIS!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Are you fuckin kidding me.

Well my petition was approved on the 28th of september. I received the hard copy in the mail today. The hard copy says it has been sent to the NVC. How long am i looking before it gets to the consulate? Am i going to have to pay anymore fees ? Is the NVC going to send me any forms or things i need to send to them before they send it to the consulate. My lawyer including my affadavit in our original package. He said they may possibly ask for updated info or they can send it straight to the consulate. Also how can i check if the NVC is working on my petition to send it to the consulate in Manilla?

Well, I don´t know if Iwant to call....she said it won´t be pulled out till november?????.....they don´t know wha they´re talking about, don´t listen to them cause everybody in customer service has a different opinion....

Like 3 weeks ago or 4 I called and this nice lady told me that I should have an aswer in the next two weeks and if I haven´t heard anything after those 2 weeks to call back and they will try to help me out cause my case was over 4 months....! Anyways, I knew that if I called back I was going to get the 6 months bull but instead this other lady told that they still have 51 days to take a decision.....She said, Oh come on! 51 days is nothing!!!! Hahaha! Yeah right, put yourself in my shoes!!!!

Your right i know. Ive been pretty calm about this but i guess i got my hopes up about this week which i knew i shouldnt have done,but just like everyone else here i miss my SO and emotions run high. What can you do but wait. I think i just needed to get that frustration out. I will stay positive till the end of this journey. thanks

Well i called CSC and talked to an indian woman. Well she said that the case has not been assighned and that it would be pulled by November. I was affraid to call because i would hear this same thing about 6 months. This friggin rediculous. Im so pissed off i could throw this computer across the room. I should have never called. I know that it is not true what she said knowing them it would be approved today but they would still say november. There were by my count 9 new approvals on 9-24-07. All of them were CSC filers. All but one of them were between 140-150 days since sending the I-129f. The one outsider was 134 days. So if you mailed it to CSC 140 days ago I would say it's safe to say to expect it to be looked at in the next 2 weeks.

Yeah i would hope that two weeks is not the case i hope this week will be the magic week. Time will only tell. It seems like everytime we get to the point of everyone else getting approved the time goes up even more. Like the horse going after a carrot. USCIS quit stringing us along and give us what we want!!!!!!!!!!!!!!!!!!!!!!!!!!!! Good Luck everyone!!!!!!!!

Another day passes with no good news. I made a mistake yesterday and said I was at 131 days, well, after my adding error, I am at 139 days! Hopefully the 140 day rule still stands and I hear something today or tomorrow. I am NOT going to check the USCIS website or my email all day. The stress of checking has made my blood pressure sky rocket! I'll cehck at 5 pm to see what happens!

Yes i totally agree i am so anxious to hear just something!!!!! I am at 140 today and I hope i atleast get something a touch or an approval something. This wait has been long and me and my fiancee have been very patient and positive. Even if we have an RFE for any reason we will stay patient and go thru the steps to get our approval but just not hearing anything is a constant wonder. To all that have not been approved I hope the best for today and i hope that we all have our approvals by the end of the week.

As of this morning i checked and I am APPROVED!!!!

Have you had any touches...I was just on the USCIS website and they have touched my case again today...yesterday too but I figured that was the call I made.

Does anyone know how many touches does USCIS record after a phone call? I got touched on the 19th cause I called CSC but I also got a touch today. Just wondering if I should get excited yet or is it a false alarm?

Its is usually two touches sometimes it is one. Most likely it is due to phone call if you have two in a row. But it could be good news.

Well I called CSC today ive been waiting 131 days. Still no new news on the case. They said it is on the shelf to be looked at. The lady was nice and happened to be from the philippines so she gave me all the info she could but nothing new. Its just waiting in a pile on a shelf it could today or two more weeks who knows. I guess at this point its more and more patience. I hope that Noa2 is here soon i would like to have my fiancee here before Christmas. SUCKY SUCKY SUCKY DAY!!!!!!!!!!

We sent both wrong...(and without our names on the back), we discovered all this tricks here weeks later from our sent to Vermont so.... RFE ¿?

If you got a RFE Bluesalmon I´m even more sad now..., but on monday I opened a post writing about this and some people told me that sometimes they don´t play so much attention to the size in this part of the journey (some people sent wrong size and they were approved), but they do when you go to the embassy where you´ve to take the correct size when it´s imperative for getting your visa. That´s why we still pray for that...

But whatever, if you sent your RFE on september 5, and I suppose to a specific USCIS person who is on your packet...., it should be done in the next week, because the only thing he has to do is check the new sizes and if are correct (sure they are), then approve your petition. I think it will take longer the RFE to arrives to the USCIS than they to approve it. Good luck body!!!

My guess is its because you did not write your names and sign on the back. very few people send the correct size with I-129f as its difficult to get that size in most countries. If its close and the face is the correct size its not normally a problem.

It looks like it is avaraging around 110 day at the moment for NOA2, but its creeping up more towards 120 for the may folks. i predict most people will be looking at 120 + days soon.

Im not sure if my lawyer wrote our names on the back but he did put them in a zip lock bag with our names and social printed on the front attached to the file. Im sure that is his standard way im not sure. Now all the pics that we took when we were together we labeled and wrote the dates on the back.

Justin, I had the same thing happen to me too. I called Friday, got a touch on Friday, and then a touch today. I do hope we all hear something good this week. It's certainly about time

Happy Monday May Filers! So, I have a question...I called CSC on Friday and got the usual touch later that afternoon. BUT I got another touch today, three days later. Anyone else call on Friday and get a touch today? I don't want to get my hopes up yet again, but it seems weird to get a touch that many days later. Oh please let it be NOA2!!!!

Well i did call friday and i got a touch the same day on the 7th, three days latter today i did get another touch. Whether or not that was from the call i dont know. Usually if that happens it still updates on the weekend. I hope for the both of us that it is a good sighn .

Well were comming to the end of the wait hopefully, we are alot further in the process than we were 4 months ago. I hope that either this week or next will be the week of good news. No matter what though we will be with our loved ones. Whether the US goverment sees it fit or whether i move to a third world country, i will be with the one i love.

Both of us are in the wrong size because by the time we sent it we were together in Spain, and there, and usually in all the European Union photograph´s sizes are a little bit smaller than 5x5cm...

We think that the RFE is unavoidable because we suppose that on the NOA2 they will put at least the beneficiary´s one right??

Yeah, I think so, but even if you get and RFE i feel confident it will not take to long to get your approval if you send it back UPS express or something. Atleast at that point you know the only thing that was wrong was your pic size. So I shouldnt be that bad. Good luck to you and im sure everything will be ok.

Well with the I-129f the photo of the fiancee is not so important i dont think as to when you actually go to the interview, which one was the wrong size the person filing the petition or the benificiary? In my case i dont think that my fiancees is the right size. Its not 2x2 but everything else is the right size and position.Its a little smaller than 2x2

Well today makes the 120 day mark for me so far CSC has not touched my app except for me calling alot.LOL

Well originally me and my fiancee met on cherry blossoms.com. At first i wasnt really sure that if it was a marriage broker or not being that they had there own chat room. I paid a fee for a membership she did not. They advised us not to give out any personal info. Well we did not use that website long and went to yahoo messenger. Well we stated this under the advise of my lawyer which just to comply with Imbra i sent her my criminal back ground and also had it stated in the intent to marry that she has seen it and understood it, because we were not sure that cherryblossoms complied or not . Now cherry blossoms is one of the biggest sites like that out there and they are credited. So im wondering since she has my criminal record and it has been stated in the intent to marry will I have any delays because of that.?My lawyer said that it shouldnt. He said that it is better to be completely honest how we met even though we did not use the site for long at all.
