It is little surprising that some with extra oridinary skill did not catch that his employeer had not filed for his GC.

Being an extraordinary athlete does not necessarily come along with extraordinary English or people skills.

If I m not wrong than on O visa you have 10 days of grace period.

Thankfully he has another month before his last day at his 'previous' job. So that plus 10 days will hopefully be enough time to get another O-1 visa.

Why has he not gone the GC route before?

Sadly, he was naive and when his previous job said that they were getting him a green card, he believed them.

It looks like the best plan is find a job quickly that allows him to get another O-1 visa so he can stay and then apply for an EB-1 visa so hopefully he'll never be in this situation again.

What do you mean by 'get sponsored by employer'? What visa type is that?

Thanks. Next question: I've spent three hours reading the Internet and I'm even more confused. Can you adjust status just from an O visa to get a green card and eventually citizenship? I keep seeing references to adjusting status but I thought an O visa was a non-immigrant visa.

I have a friend who has been in the US legally for six years on an O-1 visa. He has been let go from the job that sponsored him and does not want to leave the US. What are his options? He is married to a foreign national (O-2 visa?) but has 3 American-born children if those facts make a difference.

After turning down a same-day oath ceremony last week I checked my phone yesterday and saw a voicemail message from immigration asking me to call them about my oath ceremony. It turns out that as they were entering my information into the system a flag popped up that my fingerprints were going to expire before my oath ceremony. They gave me two options, do my oath ceremony the following day or come in and redo my fingerprints and then get back in line for an oath ceremony. So, tada, I'm now an American! I'm really happy that they called to give me the option even if it involved some last minute scrambling with my and D's work.

The oath ceremony took longer than I expected - mostly because they wanted the applicants in a particular order and since there were 36 of us (from 21 different countries) that took a while. I was expecting it to start more promptly. My favourite part was that near the beginning of the ceremony we all stood up one at a time and said what country we were from, which was neat as it gave an introvert like me a chance to know where everyone else was coming from. In my ceremony Russia was the clear winner especially if you include the former parts of the USSR. There were four other Canadians there besides me. All in all, I'm thrilled to be done this stage of paperwork. Next up - passport application!

In my news, I PASSED!!! Portland has same-day oath ceremonies but sadly D and I had work-things we couldn't miss this afternoon, so I'm in the queue for a new oath time. I'm so close to being done, I can't wait for all of the paperwork to be over. For anyone who wants to play the at home game, here are the questions I was asked:

I hope everyone isn't too jealous but this is what I saw when I checked my status online: "Your N400, APPLICATION FOR NATURALIZATION is now scheduled for interview."!!!!!! Apparently I'm one of the lucky ones who gets to skip biometrics (I last had them done about a year ago) and go straight to the interview. I had been obsessively checking my mailbox thinking I had been forgotten and didn't bother to check online so I don't know when or if my status online had changed to the 'placed in line for a interview' status. Time to start studying and may everyone else get their interview soon!

Also, from earlier in this thread, my three-year eligibility was mid-January so before I sent in my N400 application.

Ree, Fixed it! Buffalo was from my K-1 visa. I lived in Toronto and D lived in Rochester but since I hated winter we're now in Portland, Oregon.

You need employment authorization to get the SSN not vice versa

You still get a number before you have employment authorization. How do they link the two (your employment authorization and your SSN) if you don't give them a SSN when you apply?

How is a SSN not required? It is the only thing I'm currently waiting on. They ask for it on almost all of the forms... can I submit them without it?

I showed up at the airport very early in case I ran into trouble, which turned out to be a good thing because it took me forever to get my boarding pass from United!

Then I got into the US line.

CBP Lady: Why are you going to the US?

Kathryn: To visit my fiance for the weekend.

CBP Lady: How do you have a fiance in the US? (Starts flipping through my passport) Oh, you have a K1 visa.

Kathryn: Yes, but I don't want to use it at this time.

CBP Lady: Why not?

Kathryn: Because I'm not ready to move yet. I just want to visit for the weekend.

CBP Lady: Do you have your package?

Kathryn: No, it's at home. I didn't bring it since I don't want to use my K1 visa today.

(CBP Lady starts typing but since she's typing a lot and only using two fingers this is taking forever.)

Kathryn: That's the most anyone has ever written.

(CBP Lady ignores me, scribbles on my customs form in red, sticks it and my passport in a yellow folder.)

CBP Lady: Go to secondary.

So I go into secondary processing. I wander in and there are two people sitting down and two CBP guys. I go up to the first CBP guy.

CBP Guy #1: Are you applying for a TN visa?

Kathryn: No, I have a K1 visa but I don't want to use it at this time so I was sent in here.

CBP Guy #1: We need to get your fingerprints.

Kathryn: Okay

(Fingerprinting insues.)

CBP Guy #1: And a picture.

(Poses for that camera.)

CBP Guy #1: Okay, go sit down. We'll try to get you out of here as quickly as possible.

(This sounds promising, he's not saying I can't go.)

CBP Guy #2: Kathryn?

Kathryn: Yes.

CBP Guy #2: Do you have your visa form filled out?

Kathryn: What visa form, I didn't think I needed anything special since I'm just trying to go as a visitor.

CBP Guy #2: You're not using your K1 visa?

Kathryn: No, I'm just trying to go for the weekend.

Kathryn: I'm a software engineer.

Kathryn: I work for XXX in XXX.

Kathryn: I have a letter from my work that they expect me back on Monday if that helps.

CBP Guy #2: Okay, go sit down. We'll try to get you out of here as quickly as possible.

CBP Guy #2: Kathryn?

Kathryn: Yes.

CBP Guy #2: I've stamped your passport. When you come home get a courtesy stamp from Canada so that when you do come in with your K1 visa we'll know that you went home on this trip when you said you were going to go home.

Kathryn: Okay. Thanks.

CBP Guy #2: Have a nice day.

This took about half an hour from getting into the first line. The border guards were really nice but I can see it taking a lot longer if there are a lot of other people they have to deal with.

Darius just got out of the shower so I'm now off to find breakfast and then go visit the aquarium!

We're getting married 4 days after I move so that won't be an issue. At least the timelines are looking good for EAD, hopefully I'm not one of the outliers in a bad way.

Thanks Gypsyangel. I'll report in, though not until Monday because if we meet in Chicago or meet in Windsor I won't be spending much time online! I really wish it was Darius doing this though, he's so much better at dealing with stress than I am. I'm terrified that they'll say no and he's confident they'll say yes.

Texanadian, why didn't you get EAD for 6 months? I thought they had to give it to you within 3. I promise, I know money-wise what I'm getting into and a weekend away will not mean we can't buy groceries when I'm in the States.

Personally if it's April now and you're heading across permanently on the K1 in May, I'd just skip the visit. You're going to need to save up as much money as you can after you cross due to the non working part, wedding bills, daily cost of living bills.

Money isn't the issue. A weekend together will not come close to jepordizing our budgets. But thanks for worrying about us. I'd be willing to pay a lot more than I'm spending to see him before May.

Why doesn´t Darius just fly out to see you? Would save you lotsa hassle

While money isn't the issue, time is. He lives on the west coast and I live on the east coast with no direct flights in between and he's just started a new job and with time off for the wedding, time together when I get there, he doesn't have that many vacation days. If we meet 'in the middle' we'll get to spend more time together which is why we picked Chicago. Cheap flights for both of us and not too much of a time change for either of us.

I really need to work on making myself understood on this forum. When I said "negative responses" I didn't mean that in a bad way, I was just using it as a shorthand for the people who were warning me that there was a chance I wouldn't be allowed into the US.

I've read all of the other threads I could find, once I had some names I could search for (ex. zyggy). You guys are also reading my previous post a lot more snarkily than I was intending it to be when I was writing it. I was actually curious why zyggy thought his was the right interpretation when other people, in the same position as him, are interpreting it differently. Shouldn't this all be standardized?

And I am listening to what you're saying... I have a backup plan now that doesn't involve me leaving the country. Obviously you didn't read my last post before posting.

Well... if I get through that would be great (and regardless what zyggy is saying, given who else I've talked to and even from some other people on this forum there is a good chance I can go) and if not I've come up with a backup plan. He flies into Chicago and then drives and crosses the border in Detroit and meets me in Canada there. No border crossings for me and we still can see each other. So, at least all of the negative responses have led me to come up with something.

2.5 months is way too long. I'm stressed and cranky.

So again, don't be surprised if you aren't allowed to get back on that plane... if I was the supervisor on duty, I would send you packing...

I finally got through and talked to someone from Toronto and they said it was okay to not activate it and if the agent had a problem with that - ask to speak to a supervisor. I'll let you guys know how it goes.
