  1. My understanding is that once you are past your 90 day stamp, you do not have permission to stay as you permit has expired.

You are better off filing your paperwork on time along with Fee waiwer application.

I am not sure what the current requirements are, but when I had filed for my Fiancee a couple of years back, I was required to provide afidavit of support paperwork to establish that I will be able to support her.

I know that the fees have sky-rocketed, but you may want to keep that in mind so that it does not back fire on you.

Simple rule for any INS paperwork: Apply before the deadline and always stay current on visa. It gets difficult in future otherwise.

  2. We mailed our AOS papers on the 4th through US Postal Service. Certified with tracking and the postoffice had no tracking on it and still showed as not delivered.

However the check was cleared by USCIS on 16th so I feel a bit more comfortable now. Waiting for the NOA from USCIS.

My advice based on recent US POstoffice experience is. Go with Fed Ex or UPS with proper Tracking at every step.

I-94 replacement fees are around $350 is US post office looses it.

I was also told by US post office that they will not investigate untill 30 days past the date the mail was sent.

  3. Hello ,

My fiance jus got thru the interview...whew!! But am not very clear on what to do next?Just wondering what are the things needed to take care of at this point b4 my fiance leaves for US? Was he supposed get a sealed envelope everyone talks about that needs to b shown at the port of entry? and does the port of entry have to b JFK.....since he needs to fly to lax?? any input is gr8ly appreciated!!

At the interview the consulate should have given her paperwork in a sealed envelope. Including her X-ray and health records.

These need to remain sealed and not be temperred with. At point of entry. ( First Airport that the International flight lands at is always your poing of entry reguardless of your destination. ) If that happens to be LAX then so be it.

Once she Arrives to US you have to get married within 90 days. Now I am not clear on if it is once Visa is issues or once she enteres the US. I believe it is after Arrival.

Then you have to apply for change of status etc.

Please see the detailed flow chart on http://www.visajourney.com/forums/index.ph...amp;page=k1flow.

    Best wishes.
