    On I-30 form on the class admission; petitioner for child over 21yrs is under F32 category (petitioner arrived as derivative of spouse) do we answer Yes or No on the question "Did you gain lawful permanent residence status through marriage to US citizen or lawful permanent residence".  The answer seems Yes but would come to mind that this could be more directly related to those who has been petition directly by their spouse. 

     

     

  2. Thanks. I have follow-up question, not sure if make sense but can both me and my spouse file a petition for my daughter at the same time? I anticipate that i may remain permanent residence for long time while spouse could be US citizen. Or possibility in case anything happened that 1 of us decided to denounce being in the US, we still have one continue on file.  Will this raised red flag to USCIS? will they process it or asked ur for reason?

  3. We arrived couple of months ago and now preparing I-130 form to petition my daughter. Once the petitioner submit I-130 online does he need to stay in US for specific period or can he leave US? Due to some unfinished business we need to go back to PH and plan to stay around 5months and then back to US, we worry if there is impact on filing or we have to stay until we got confirmation.  On I-130 declaration it also mentioned taking biometrics, how long will this be and will this have impact if we are outside US.  Thanks for help.

    I have already requested transfer of processing and interview location when we submitted DS-260, when the case was still at NVC. There were communications to contact HKG but when we reach out HKG Embassy they advised will need to have NVC send the file to them before they can do any action. Fast forward, called HKG and was advised to make the request but there is no timeline how long it takes to transfer case from MNL to HKG. At this point, we would not want to take the risk since we can already make an interview appointment in  MNL. Thanks.

    SLEC sends the results to USEM quickly. You could schedule interview for right after exam. But keep in mind either of you could get flagged for sputum testing and all of your timelines get thrown out the window.

    Daughter is graduating from high school and result of exam is tie up to potentially securing scholarship fund for college (including US). She has maximum 4wks to stay in PH (during study leave) before her scheduled exam. Yes, given the importance of the exam we just decided to schedule her interview after the exam. Thanks!

  5. I have been planning our travel to MNL for SLEC medical and also plan the interview as well but we have limited time since my daughter and I will need to go back to HKG for work and school. Is below plan doable?

     

    1. Can SLEC expedite to release result if we plan USEM interview within the same week?

    2. What is the turn around time to receive/deliver the passport from the time of interview (assume no issue on interview and visa has been approve)?

    3. In case there is additional requirement for submission which increase the wait time,  would it be possible to request to pull out my daughters passport? How will we handle onwards?

    Hearing news that waiting time for passport can take 2 weeks or more, would like to check our options. Should be no issue for me, but need to find alternatives for my daughter.

  6. Those asking for update.

    Have to create profile first and then schedule the interview online.

    I got a problem because we have existing profile at different location where we applied for B1/B2 and cannot set up new one under Philippines. Have called USEM and they fix it by transferring the profile to Phlippines and help set up new profile as well. After that i can proceed to schedule the interview online.

     

  7. My sister on F3 finally received noticed that CEAC status is now In- Transit. During filing last 2020 they initially plan for spouse To Follow so didnt do anything except Pay the visa application. Now, they decided to plan Accompany but unable to change status in CEAC.

    How should they proceed and will this require new application with my sister as the sponsor? Any possibility that they can be interviewed at same time?

    Received email for petition approval on Feb 2020. Yes, he was added as derivative in the CEAC  portal and DQ on Jan2021. Thanks for the review!

    dear VJs, can i assume that my son's age has been freeze when DQ and is covered by CSPA? Now, that we are near the last step it makes me worry for my son. Thanks for the advise.

    Thanks. It will be at HKG consulate, we are permanent residence here. If she does not get student visa, thats fine for us but the worry is if she gets it. She just recently renewed B1/B2 visa for 10yrs and we declare our immigrant status but not sure if they will give for student visa.

  12. Need some thoughts on how we can better plan our approach for my daughter plan to study on School year 2023-2024 while we await immigrant interview (location/MNL).

    My daughter currently on Senior year already applied to US College schools and waiting result in March 2023. I would like to anticipate possible dilemma since we just received notice for our immigrant case now ïn-transit" but no idea when we can get schedule for interview in Manila. My daughter is derivative dependent for F3 visa.

     

    1. In case she gets accepted and successfully applied for F1 visa how would we approach if we suddenly have the scheduled interview this year, she may need to be in the US in Jul/Aug (not yet sure) to be ready for start of school year in Sep. Do you think it will have conflict once we received notice for interview this year as well?  I have no idea on the waiting time for F1 visa processing and also not sure how long the waiting time for getting notice for immigrant visa interview. Assume she is already in US, she needs to come back again to join us on the interview?  By the way, the F1 visa and Immigrant interview location will be in different US embassy. Will this be messy?

     

    2. Would it be better to wait for the immigrant visa interview first? But what happens if we don't receive notice this year? My daughter would really want to start college in US especially if she will be accepted in the preferred school of choice.

     

    Appreciate recommendation on which is best approach on this situation. Thanks in advance.

    Thanks for reply! The visa application status shows "In-transit", so we will have to wait then.

    We did request to transfer interview from MNL to HKG, but the Interview location and case remains MNL. So we assume we can assume we need to book the interview in MNL.

    Yes, he is now 23yrs old. He was born May 2000.

  15. We are on F3 visa and my family has been documentarily complete since Jan-2021. And its a long wait but this month we have been approved  for expedited interview in Manila.

    How long would we need to wait for us to be interviewed or schedule an interview?

     

    I am also worried that my son already aged out, what documents do we need to prepare to bring to embassy to show his CSPA age? Our PD is Sep-1999 and my son was documentarily same as mine last Jan2021 but he turns 21yrs old last May2021. Will we still be able to bring him with us?

     

  16. Relating to transfer of interview location; does anyone know if it matters to wait until submission of DS-260 and requirement so once NVC reviewed they will process at the same time or is it better to request early? Just want to avoid any conflict on processing, if there is.

    Also, will the transfer be just online or documents will still need to be physically move or send through courier from one Consulate to another?

  18. On DS-260 do i need to include all my children including those overage and will not accompany me? If yes, there is a question if the child is immigrating with you and if the child is immigrating to the US at a later date, will my answer be NO even if have intention to petition my overage child once i arrived in the US?

    Also, i am filling up for my derivatives coming me. Will my father (their grandfather) be their petitioner or it should be me?
