  3. Hey there everyone,

    Just wanted to let anyone who let it get down to the wire with the fee rise know that they may get a call from their embassy. Or maybe its just us. We put off filing the I130 with the Dublin embassy because we were waiting for a letter acknowledging our withdrawal of previous I130 with the USCIS. When we had not received such a letter, we mailed our application on July 27th(dublin only accepts applications by mail), since the USCIS said the application only had to be postmarked by the 30th to beat the fee increase. I just received a call this morning from the embassy telling me that they need the rest of the fee. I told her that the i130 was sent on the 27th, before the required post mark date. she said that maybe thats ok in america, but as of the 30th their cash machines have been updated to the increased fee, and they cant process an application for less than $355. she wouldnt put a supervisor on, said there was nothing they could do because the cash machine would not accept it. No where on the embassy's website does it state that the I130 must be RECIEVED before the 30th. which in fact ours was(on saturday the 28th), she said it would have had to have gotten there on the friday before, the 27th. That the fee increase applies to when they put them in to be processed, not when they are received. She wouldnt even tell me where i could file a complaint, jsut said there was nothing we could do about it, and they couldnt process our application until we send in the rest of the fee. she did however tell me that we are lucky to be able to file through the embassy, since it can take several years to process in the us. Since i already knew that, and it is the reason we cancelled our previous i129f and 130, we of course will dutifully send in the extra money. But man this immigration stuff sure seems to be turning into a big money pit. So there we are. hopefully it is just dublin and no one else will have to deal with this. just needed to vent.

    I have a I-130 case pending trought California Service Center since May/2007 and already sent I-129F ( unfortunately to the wrong Service Center (Nebraska) ).

    Reading the DCF Guide realised that we qualify to DCF since we live abroad for more than 6 months.

    The fact is I am very dissapointed after that mistake so I think it will delay our process.

    Is it possibly to change route ?

    Are there someone else who changed route and can give me some guidance what to do ?

    We are in exactly the same boat as you! We filed an I129, then canceled it because of AOS and EAD. Then found out that Ireland was allowing DCF again. We are thinking of canceling our I130 and filing a new one. Since our NOA1 was sent out on April25th, we havent received a single touch, so it seems no one has cast their eyes on our petition again. Meanwhile, those doing DCF are proceeding to NOA2 and packet 3s. All you have to do is write a letter of withdrawal to current location of petition, stating reason for withdrawal and copy of NOA1 for I130 (doesnt need to be notarized). We are planning on calling embassy on Monday to ask if they need proof of withdrawal. I spoke to 2 different USCIS who didnt know. Judging by the last embassy lady I spoke to, I doubt she will either. Im hoping the answer is no, because we sent our withdrawal to I129 2 1/2 weeks ago. We havent received a response, and its not showing on our profile on USCIS website.

    If proof of withdrawal is not needed, we are going to wait until end of July to see if their is any action on our first I130. The filing fees for I130 increase to $355 on July30th. So if you think you might refile, I suggest you do it before then.

    My husband has his PR for 7 months by now I cant see any reason to wait for K-3 also beacuse i have been famous here by sending I-129F to the wrong Service Center. :whistle:

    Hey there!

    My husband and i have not started the DCF yet. we just got back into town, and were hoping to find a response to our withdrawal letter waiting for us. No luck yet.

    For your withdrawal letter . . .

    You do not need any other forms to cancel the I130. Just a simple letter. Tell them that you previously filed an I130, list your receipt number, and the reason you want to withdrawal (in order to pursue direct consulate filing). You do NOT have to get the letter notarized. You DO need to include a copy of your NOA1 for your I130 you are withdrawing. File the letter to the service center your I130 is currently located at. You can call uscis to be sure of its location.

    I also typed the date and signed after my printed name on the letter.

    Just remember that, once withdrawn, there is no way to bring that I130 back to life, so call your embassy to be sure you can file.

    For your proof of withdrawal . . .

    Call your embassy to see what they need for proof. We are filing in Dublin, but they just send the forms on to London. Dublin told us we had to send the application in along with the USCIS response letter to our withdrawal.

    We emailed London and they said to just send a copy of the letter(which is why i made sure to type the date). Once they received our application, they would call USCIS to verify we canceled the other I130. So that's two different responses from 2 different embassies. I would call yours to be sure. We are going to wait until closer to the end of july to refile with DCF to give the response letter some time to come in. If it hasnt, im going to send in our I130 with a copy of the withdrawal letter and a copy of the email from the embassy stating we dont need a response letter. Emailing your embassy also might be the best action so you have written proof of their response. Looking through the forums here as to whether a proof of response is needed i saw both yes and no. so it may depend on the embassy and on who you talk to at the embassy. Thats why i think having them email you there response is best, so you can include it in your package.

    But just another reminder, the filing fees are going up at the end of this month. We are going to hold off for the response letter, but are getting all our papers together now. There are a few more things you have to have to do the DCF filing. Our embassies website had a checklist. We need a copy of my photo page on my passport and the stamps that show I am allowed extended stay in ireland. We also have to send in a copy of the photopage of my husbands passport. I130 D.2 asks if you have ever filed a petition for your spouse before, and if yes one line for dates and results. We are going to attach an addendum to that with the details of when withdrawal letter was sent, and then include the copy of the withdrawal letter.

  5. Aw, that makes for a nice, very international story! :) Good luck with filing - I'm sure you'll be very happy you're going this route.

    No kidding! Happens a lot in VJ - I was born in Mexico, my husband is a USC, we both came to Canada for graduate schooling (which was not a first choice for either of us but our professors got transferred here), met online, and got married. Talk about international relations at its best!!!

    Yeah, we thought we had a pretty amazing history together when around our regular old friends. But just looking at this website, you realize there are so many extraordinary love stories out there. (btw, hope you both are enjoying canada) Its great to be a part of the group. I do think we have our own unique bit- we lived in a two person tent in an orange grove for 3 months after we met. The orange grove part was pretty cool. As for the tent, we know after that challenge we can survive marriage.

    They're filing in London actually and they're currently living in Ireland. It's just that he's German. She hasn't said why they're in Ireland, but as you probably know it's easy for EU citizens to move around to different EU countries.

    Did I mention we met in Spain? And i speak neither spanish nor german? That's why we are in Ireland. Between english and beer, we speak the same language.

    Thank you so much for those posts! That answers the questions perfectly. I was getting stuck because of the recission option, wondering if that was what i had done with the withdrawal. But you have all cleared it up and we will be able to send it out on Monday. YaaaY!

  7. We are planning to cancel our I130 filed with USCIS to file through DCF. We meet the criteria. It seems like there are other people who have done this.

    For those who have, on your I130 when you refiled, C.16 asks if you have been though immigration proceedings before. Did you put yes or no?

    I am not sure - but I would recommend you contact the consulate that would process your DCF and ask them directly- they will be the best source of info. Though I'm sure one of our wiser members will have more to say.

    Ireland sends the I130 on to London and the woman I spoke to there didnt know the answer. We cant call the London embassy because their visa line can only be called from within the UK. USCIS told us they caouldnt give us an answer on how to fill out the form and to seek legal advise. :wacko:

    I was just reading the forum and someone stated that You have to fill out a I-864 form for your US Citizen children. Im (USC) filing for my husband my children are both USC, joint sponsor is my dad . So do I file a I-864 (Petitioner) and my dad for joint sponsor and one for each child??

    The I864 instructions say

    "Often a spouse or minor children obtain visas or adjust statusas dependents of a relative, based on the same visa petition. Ifyou are sponsoring such dependents, you only need to providea photocopy of the original Form I-864, as long as thesedependents are immigrating at the same time as the principalimmigrant or within six months of the time he or sheimmigrates to the United States. You do not need to providecopies of the supporting documents for each of thephotocopied Forms I-864."

    It says you only need different affidavits of support if they are filed under different I130s. Are they all on the same one? Because the form says you only need photocopies. It seems like this is a question that USCIS should be able to answer to be sure.

  10. My husband and I already filed our I-130 with the USCIS in March when Dublin Embassy was closed to DCF. We are now planning on withdrawing our I130 and refiling with Dublin Embassy because DCF seems to be so very much faster. We have received our NOA1, and no further touches or anything. A fellow VJer from Ireland who also filed in March, but with DCF, has already received Packet 3.

    Questions. . .

    1. Do we have to wait for a response to the withdrawal for I130 before proceeding with DCF filing? Can we wait till we receive receipt of I130 from London before withdrawing previous I130?

    USCIS guy says, well there will be a response to the withdrawal, you can wait for that. We dont know if you have to.

    2. The checklist, regarding the G325A says this

    "Only one form to be completed by the petitioner and one form by his/her spouse. Do not submit multiple copies (even though you might see instructions elsewhere to do so)"

    The G325A form automatically fills four sheets. Are we supposed to only send 1 of these 4? Did anyone else only send one?

    3. The checklist, regarding photos, it says to only send one of petitioner and one of spouse. While filing with USCIS they ask for 2. Did anyone else only send one?

    4. I130 C.16 Has your relative ever been under immigration proceeding? Do we count the I130 we are withdrawing, and the I129 we have already sent a letter to withdraw. If you check yes, you have to then check deportation, removal, recission, judicial proceedings.

    I called USCIS and spoke to 2 different people. One said put no cuz none of those options apply to us (even though recission means to void). the other one said they cannot assist us in filling out the form and to seek the advise of a legal representative. huh.

    I would not at all be surprised to be refused for not having 2 photos each, even though the checklist says 1. I just wanted to make sure others have had success following the checklist. I would hate to be refused since the only progress we seem to be making is withdrawals.

    And we have tried calling the Embassy. The woman at the embassy knew NOTHING, other than they receive petitions in the mail and send them to London. For the ? re photo and G325 she said to just do whatever it says. Just wanted to check with you guys before mailing.

    Any help would be greatly appreciated.

    i know a co sponsor has to complete I-864 as the petitioner does. my question is this: does the co-sponsor have

    to complete all the parts the petitioner does in the form I-864 or what ? In other wors can you tel me the parts of i864 the cosponsor has to complete?

    We have been preparing our I-864 and our joint sponsor's in aniticipation. From what Ive seen, the joint sponsor would have to fill out all parts that arent listed as optional. I filled out my parents for them, except the income info, and didnt come across anything that didnt seem like they should have to answer. The optional bits say so in parentheses and have to do with assets, and on one part whether you attached 3 years of tax transcripts. Everything else looks like it would need to be filled out. It seems the only difference with a joint sponsor is the addition of a copy of their birth certificate, passport, or certificate of naturalization.

    As for the DCF, we are going to call the embassy tomorrow and find out it anything can be done to change the processing to them, although, judging by the hassle involved in every other step of this process, I cant begin to imagine the hoops we will have to jump through.

    Good to know that a letter from potential employer helps a lot. Im planning to just go back to my old job and tell them Ill be returning sometime in the future, and im sure my manager will have no qualms over writing a letter.

    Entering the US while processing- we'll have a return flight, based on your response we will probably also bring some other proof, employer-wise or something to show he does have ties, so thanks for that.

    I see from your timeline that you are near the end of the line, Congratulations! Good luck to you in your upcoming interview.

    Have you checked if you can now file for DCF? Maybe you can change? Not sure but worth a call to the consulate, eh?

    Back to your questions: Only US income or income that will continue in the US is to be included in the Affidavit of Support. Great that you already have a cosponsor. As per domicile, if you can establish that your stay in Ireland is temporary (i.e. student visa or the like), there is no problem. And yes, a letter from a potential employer counts a lot. The bank account I'm not so sure, but still have copies of statements available.

    Can he enter the US while processing? If he can prove enough ties to Ireland and the dude/dudette at the port of entry is on a good mood, yes. Some people have done it no problem, others have been sent back. It all depends, mostly on the POE officer.

  13. My husband and I have filed the I-130 and we are both living in Ireland. We have also filed the I-129F, but have decided to cancel it so we dont have to mess with adjustment or EAD. Plus, my husband can transfer with his company to the States and they will pay for our moving costs, but not if we tell them he cant start until whenever the EAD is approved. We are now looking at the Affidavit of Support and have a few questions. And no, we didnt do DCF filing because they stopped it, at least in ireland, from jan to march 2007, which is when we filed our paperwork. I've been looking at the dcf filing timelines and am absolutely sick that we missed out on it. :crying:

    I only have an irish income, meager savings, no assets, so we already have are using my Dad as joint sponsors.

    The one catch that most of our questions hinge on is how long it takes between the NOA2 and the interview. According to the timelines, its about 230 days. Thats a pretty big window in which to secure a job or lease an apartment. From the NVC timeline, the I864 packet is sent to NVC before the interview. Will I need my proof of intent to reestablish domicile when we send the I864, or just by the interview?

    I am aware that my husband can use his income if it is continuing from the same source, but he still has to apply for a position, and he can only do that so far ahead of time, and definitely not 230 days ahead of time. We know that when he transfers, he will definitely continue on at least the same salary, no matter what position he gets. So do I include that income on the I864?

    When a sponsor has clearly not maintained a domicile in the United States, he/she will need to re-establish a U.S.
    domicile in order for him/her to be a sponsor. The sponsor may make a number of steps to show that he/she

    I have maintained a US bank account, but it has ireland as my mailing address. I think I can have a job lined up with a start date for whenever we move back. But once again, with 230 day window, it's difficult. (Is it really that long?!) Would a letter from a manager saying there is a job waiting for me as soon as i return be enough to show securing a job? I'd like to do anything I can to re-establish without having to go back.

    One more question. My husband and I are flying back to the states for one week in september for a visit. Are there any kinds of restrictions on him entering the US when his visa is being processed?

    I know there were loads of questions in there, but any help would be greatly appreciated.

  14. This is about to be really long, but it answers the questions asked in the previous posts and adds a bit more info and a few more questions.

    As far as the dcf filing, they stopped it, at least for Ireland, in January, and reinstated it in march right after we sent off our paperwork. I dont know if we can switch back to the dcf filing now, or if it would be any benefit. I asked USCIS today and they didnt know. He referred me to the State Department and Im going to call them tomorrow. One annoying thing about not doing the DCF is that, the way mail is in Ireland, it often takes up to 3 weeks to receive anything from the states, so everything gets slowed down even more.

    As far as our financial situation, both our savings are meager. However, Alex works for an American company and can easily get a position in the States with the same company. However, he wouldnt be able to apply for a postition in the States with an indefinite start date, which is what we would have using the I-129, and then the EAD. in fact he wouldnt be able to do it with the I-130 because until we received final approval, a start date would still be indefinite. which means i cant use his income as an addition to my sponsorship. which i dont mind because i can still use my parents to cosponsor.

    I understand now that no matter what we file, or if we use a cosponsor, i have to establish a domicile. i found this

    I can have a job and an apartment lined up. and i have maintained a us bank account, but it has ireland as my mailing address. should i change the mailing address now to my sisters address in austin? And would a letter from a manager saying there is a job waiting for me as soon as i return be enough to show finding a job?

    I assume all this info would have to be shown at the interview. How long is it usually after the interview that we receive the visa, say if i want to secure an apartment while we are still here to establish domicile. i guess i would have to just set the date for job and the apartment sometime inthe future and hope we have received final approval by then?

    regardless of whatever we figure out, i think we are going to scrap the I129, since we are together already anyway. I think it would financially be better to just wait for the I130 and avoid the AOS and the wait time for the EAD.

    I spoke to uscis today and they said I just need to write a request for withdrawal. Does that have to be notarized (sorry, i forgot to ask uscis)?

    I again apologize also for this ridiculously long post, but i would really appreciate any advise you could offer.

  15. My wife, the USC, and myself, the confused german, are living together in Ireland at the moment, both legal registered residents working full time and living together. We got married in Texas over a year ago, and have just started the process to move us back to her home town of Austin, TX.

    But we have a question regarding the I-129F and the Affidavit of Support. Do we need one? We realise the answer is sometimes, but under what conditions?

    The instructions for the I-864 mention that the sponsor has to have a US domicile address, which my wife, living permanently in Ireland, does not have. The instructions for the I-134 does not mention this requirement; can we submit the I-134 from Ireland, if necessary? If the I-134 does need a US domicile for the USC, should we begin preparing our Co-sponsor paperwork?
