    I am from Brazil I am starting my J1 waiver process I would like to know if you end up receiving the waiver.

    I came to US with a CNPq scholarship my first year in US (I end up paying the money back to CNPq and they gave me the NOL to send to the embassy) my supervisor from US started paying me in my second year. The US University where I work said that what I receive now it's not consider US government fund. Now my sponsor wants me to stay longer to finish my projects and wants to apply to H1B so that's why I am apply for the waiver.

    You mentioned that you received money from CAPES. Do you also received money from the JHU? I would like to know if you have any issue with the waiver in case you received money from JHU.

      Hi,

      My case was very similar to yours, except that I received a scholarship from CAPES instead of CNPq. During the second year, my US supervisor sponsors me at TSRI, and for the rest three years of J1 VISA I was sponsored from the JHU. I did not have any issue with receiving money from either TSRI or JHU. They are not considered US government funds (even though they receive grants from NIH).

      As long as you have the NOL from the Brazilian embassy you should be fine, make sure you include all your DS2019. I would suggest you to also include a letter from your sponsor stating that they are willing to apply for an H1B.

       

      Here is my timeline:

      APR-09-2020 Brazilian embassy in Washington DC sent the No Objection Statement to DOS electronically
      APR-30-2020 DOS updated the website my case was received
      MAY-19-2020 DOS received the No Objection Statement

      JUNE-04-2020 I sent a request by mail to expedite the process because my DS2019 would expire in Sep-14-2020 and I would need to apply for another VISA in order to continue working at JHU.    
      JULY-02-2020 DOS updates with a Favorable recommendation
