  1. Does anybody know if petitioner lost job right before beneficiary's interview, is it workable for petitioner only sumbitting bank statements and house deed as financial support?

    Is it helpful if beneficiary also has bank account in USA? Should petitioner to fill partial dependent on I-134?

    i only have the document of when i submitted the application for the visa. Didn't save affidivate submission document. Never think about i will use it in the future

     

    By the way, do you have answer for my question #3?

    Thanks. One more question--since i submitted affidavit support for my parents many years ago. really don't remember the exact affidivait support submission date. what should i do ?

    4. Yes you have to list your parents. Even if they died you need to list them because you previously submitted affidavits for them. 

    5. Yes list your parents information as well as your sister.

     

    Don't forgot you have to now have to show income to support 4 people and not 2 unless your parents officially relinquished their green card. Just because they "left and aren't coming back" doesn't cut it. Also when your sisters petition is approved you will then need to show income for 5 people (or more if you have kids)

     

    Thanks for your reply. Regarding application for  my sister's family, i submitted 6 years ago and is still waiting on the line. It normally need another 4-5 years to know if it's approved or not. so i didn't submit any affidivate support for her family yet. Based on my understanding, i only need to fill in my parents' information for affidivate support. But for visa application, I should fill in both my parents and my sister's family's information. Correct?

  5. i have some questions about filling I-134. Can anybody help me on it?

     

    1. Part 2/Information about the Beneficiary A-number: Is this the number on right upper corner of 797 Notice?

    2. Part 3/Income and Assets Information: If i have enough income, do i have to fill real estate(i have my own house)?

    3. Part 3/Dependant's Information: If my finace also has income in China, should i fill  "wholly depend on me" or "partially depend on me"?

    4. Part 3/Other Information about sponsor/Previously submitted affidavit support for the persons: I applied PR for my parents 6 years ago and they have been PR for many years. But they went back to China a year ago and don't have plan to come back. Do i still have to fill their information?

    5. Part 3/Other information about sponsor/visa petition submitted to USCIS on behalf of the persons: Should i fill my parents' information? it's already a done case. I also submitted visa application for my sister 6 years ago and still waiting on the line because it will normally take 10-11 years. should i fill in all her family member names?

  6. Another month passed. it has been 2 months since i sent the RFE. And i sent inquiry to USCIS again today and got the same answer as last time. It still says it's delayed because of virus. And they are still waiting for security check result. And the weird point is i sent inquiry in the morning and got answer in the afternoon which never been so quick before. Does anybody have the same experience? Does USCIS stop working on K1 pending approved case because of the document Trump signed?

    understand. we never had fraud before. But nobody knows what the USCIS officer thinks about. Seems like the only thing we can do is to wait. But it really a torture as it takes 8 months already

    That doesn't mean it's not accurate, though. Most often when a case is taking longer than normal, especially post-RFE, security checks would be the only item to hold it up. The next closest would be verification of documents (i.e. if the RFE was for a divorce certificate or criminal records or something).

    I have no evidence to suggest that they are saying it's stuck on security checks when it is actually something else.

     

    Since there is nothing either you or they can do to make security checks go faster, it has the impact of getting people to stop asking questions.

    yes, you are right. divorce certificate from china is one of documents required in RFE. We sent the single declaration notarized document when we filed application and forgot to send divorce certificate notarization. USCIS needs to verify with china notarization place? It might take little bit of longer time if they need to. But i doubt USCIS will do it though.

    Security checks are run through various agencies. One of the most common ones to get held up are criminal background checks and/or FBI checks. These checks are essentially a black box - USCIS requests them and then awaits for a response from the appropriate agencies.

    Normally this is instant or minutes, but all sorts of factors can cause it to take longer. Even people with high security clearance levels get caught in them sometimes (not just with USCIS).

    It could be as simple as somebody with the same or similar name with a criminal history, so they have to manually investigate to verify it's not the same individual as the petitioner. Or if the petitioner did have a criminal history, to ensure it matches what was on the petition and/or retrieve and review the details of those cases to ensure eligibility.

    It could be national security checks as well, but absolutely no way for anybody here to know that (or for him/her really). I only say because that's possible...criminal checks tend to be more often the delay.

     

    The checks at this stage are with the petitioner to ensure they are eligible.

    thanks for your reply. so can i say that my RFE documents look fine with USCIS. And USCIS is only waiting to get result from security check, correct? Once they get the result, most likely the case can be approved. No?

    security check is on the applicant, no? because the case is still in california center and we are still waiting for P2.

  11. I'm still waiting for P2 for I-129F case. I filed application in July of 2019. My RFE was sent in Feb. which is over a month ago. I sent an online inquiry to USCIS and asked the status.

     

    And i got the answer on the next day which was very quick than usual. I was told the case was delayed because they still didn't get the result of a security check.

     

    Is it possible this is an automatic reply generated in USCIS system? Does anybody have same experience as me?

    They got my RFE on 2/24 which is over a month ago. And i sent inquiry to USCIS yesterday and they replied me TODAY that required security check result is not coming back yet. I'm so confused. The security check was supposed to be done before RFE sent. And i have never seen USCIS replied application so quick. Someone told me this is all the same reply as long as the case is still in process. I don't know if it's true.

    You're on the cusp of getting an approval and during times like this it's just going to be delayed and you cannot, nor can anyone else change that. There is nothing to worry about getting approved. They wouldn't have asked for additional information (RFE) if they were not going to approve you. Be safe out there.

    i saw some people still got rejected after RFE was submitted.

    Thanks for your reply. I just feel like my case is not in normal time frame from the beginning. I filed in July and got RFE in Feb. which took longer time than majority of the cases in China. And i was requested to send engagement ceremony pictures which i don't have because my dad was very sick by that time. I didn't know if USCIS would consider my relationship not real or not. They also asked me to send financial support which is normally required later on. All these seems not normal. I don't understand what USCIS is exactly looking for. That's why i am so worried now
