What name was used on:
1. I-129F
2. DS-160
3. The K-1 visa
4. I-485
5. I-864
?
IOW which of these have “jr” and which don’t?
What evidence of USA citizenship was used on I-129F?For the i129f and ds160 Jr was used. The visa just shows my name without Jr. The i485 and i864 don't have Jr.
For the i129f I used the same long form birth certificate, as well as my passport (which is now expired).

First of all I 864 is for spouse and profile and your timeline says K1 fiancee visa petition so I 134 would be needed at embassy interview
submit copy of birth certificate as indicated
should have given all names used on the petition
Thanks for the reminder, I just updated my profile. We got married and are going through aos now.
Is there any risk they will reject my birth certificate as evidence of citizenship because my birth certificate has Jr but the I 864 does not?

Hello,
I, the sponsor, received an RFE for the I864 affadavit of support, for proof of citizenship. Proof can be valid passport or birth certificate. I currently don't have a valid passport as it just expired.
I realize that I submitted the I864 and didn't include the Jr on the form. However my birth certificate includes a Jr. Is this a problem?
I tried calling Uscis but when I ask for a representative they hang up on me. The form says that we will only get one opportunity to submit evidence.

The group is saying at least 4 cases have left the NVC. Let's hope we're all soon.
-
Per a whatsapp group I'm in, cases have begun leaving the NVC. The case that left was not an emergency case and they had not written their congressperson. The message was from a very active member of the whatsapp group.

So far today, 2 ppl who have DQ for May 2020 got and email to schedule their interview appt for May
So their cases were already at the embassy before the embassy stopped processing cases?

I had a question for the NVC so I called them, and they confirmed that my case WAS expedited. This tells me that my congresswoman DID push my case through. So, I don't think the embassy is skipping anyone and I bet you will hear from them soon @HBundle 💗
Do you think you could have gotten your case expedited if you had tried through the formal process?

WE HAVE AN INTERVIEW!!
I have no idea how this is possible. My case shows at NVC but 5 minutes later I checked my email and the embassy emailed to inform me that our interview is April 8th.
I had reached out to my congresswoman and I know she contacted the NVC about my case, I am really wondering now if she made this thing move for me.
Anyways, we now have A TON to do in the next couple of weeks and have to figure out how to get both of us to Colombia. Just wanted to give you all a little update on that, I hope this means that the end is in sight for everyone!!
Congrats and good luck! You're the first case I've heard of here or in whatsapp groups that has had their case leave the NVC.

I don't want to read too far into it but I checked CEAC today and my case was "touched" yesterday 3/5. Could be in response to an email I sent a week ago or maybe they are getting ready to email me. My case had not been "touched" since October 2020. Fingers crossed.
Congrats! Did you fill out the DS-160 when your case first arrived at the embassy, and will you have to fill it out again?

You should check your messages in CEAC and see when the NVC sent you a note that you were documentarily qualified. Not sure if they do K1s the same way they do CR1/IR1s, but if so then this is how you check the DQ date. You can also find when the NVC sent your DQ notice.
When I login to the CEAC website I now get the below message, whereas I didn't before :
K visas are nonimmigrant visas that assist spouses or future spouses of American citizens in entering the United States. As with all nonimmigrant visa applicants, a DS-160 must be filled out in order for a consular section to process the case.
Should I start filling out the DS-160 now, or wait until my status is Ready?

If you do it yourself the filing fee is right over $400. The cost of service of process on the various defendants (U.S. officials and agencies) can also get expensive. An attorney would probably do it for around $3,500 or so.
Can any attorney do it, or is there an advantage of Siskind's firm doing it?

Even if you are not from those countries you can still apply as individual mandamus
You can contact your lawyer and try to apply
Do you know how much it costs to apply as an individual mandamus?

Good idea. I'm going to write the congressmen and senators from my state as well.

Has anyone from a country that doesn't currently have travel bans joined this lawsuit, or joined an individual lawsuit with the same law firm, and had success?
I ask because the Bogotá embassy website mentions presidential proclamation 10014 as one of the reasons they're not processing some Immigrant visas.
Meanwhile Bogotá is processing visas for appointments that had been canceled early last year, but no non-emergency cases have been sent from the NVC.

I totally agree. Their lack of transparency is what is most frustrating. And I believe you’re correct, the lockdown in Bogota is probably the major factor. The problem is they keep extending it. But the embassy’s actions and lack of transparency is not sustainable. They are going to have to resume routine processing of visas sooner rather than later. Or they’ll have to come clean at some point and tell us what the hold up is. I wonder what kind of impact Biden’s executive order to the state department that all embassies are to resume routine visa processing will have.
What’s your situation?
What executive order from Biden are you referring to?

Is it possible to request that our case not be sent to Bogotá, but to some other embassy instead?
I saw on someone's timeline (from Europe) that they had gotten their case transfered to a nearby country because their embassy was closed.

It was posted in the local paper in Bogota and it was in the news there.
Would you happen to have the name of the paper, or better yet a link to an article?

You are always welcome to do whatever is not needed
I understand and agree that it may not be needed. But if that's so, I'd like to understand why that's the case. Is it outlined somewhere in official guidelines?

If not the I-134 instructions on the USCIS website, which instructions should we follow when filling out the I-134?
I'd be inclined to follow those instructions to the letter unless I can find other instructions given by the consulate.
1 hour ago, payxibka said:You are not submitting this form to the USCIS but to the consulate, so much of the instructions are not relevant. You only need to prove your current income, not that you have any money in the bank (i.e. assets).

Honestly, not really. And since it is so up in the air when K1s will actually start being scheduled for interviews at many embassies/consulates even some that have received NOA2 already are not really in a hurry to prepare anything.
Mostly all you have to do is time sensitive so right now all we do is wait. When the embassy sends you something finally that says they've received your petition and they tell you what to do next, that's when you can start gathering documents.
By the way welcome to the website 😊 and the waiting for NOA2! My NOA1 was in mid July
So even after we've recieved our NOA2 and it's arrived at the NVC, we should not request the letter from our employer or bank?

Pre-Covid it was 9+ months to interview and now there is an additional several months of backlog in front of you. Simple math.
Are you referring to only Juarez?
And where did you get the 9 month figure? I'd like to see if I can find the same information for Bogotá.
I-864 RFE - citizenship
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

Are you suggesting I include another i-864 in my RFE response, or that I start from scratch and submit all documents?
What would happen if I submit my birth certificate as the only RFE evidence and they reject it? Could I just refile the i-864 again? Or would I have to submit all documents (AOS etc) again?
