  1. just to update the people who visited this thread:

    I gave birth here in the US last November 25... and my application for emergency medicaid was appoved. It was effective from the time I checked in the hospital up to the day I got out. So that's total of 3 days. My baby's medicaid was approved too since he is a US citizen.

    Hope this helps to those who are in the same situation. Thanks everyone for all your advices and responses.

    thanks for the update ria, im hoping for the same successful outcome, im due this november. i hope idaho has the same medicaid provisions in florida. its so ridiculous how expensive those hospitals charge.

  2. thanks blairwhich, its really cheaper booking through a travel agency...so far the price quote i got was $660 tax inclusive already. a little cheaper than expedia...

    my husband tried booking through a travel agent in the US and they refused. youre right daiana, i guess the rule doesnt apply to online booking/e-ticketing.

  3. i wanna ask for help about booking a flight from mnl to us...

    1. which is better booking w/ a travel agent or online? philippines or us?

    2. if booking online, is it okay if the passenger is not the cardholder?

    sabi kasi ng husband ko di daw legal mag-book ng flight sa US for my trip...it should be purchased dw here in the philippines...i tried online from one website kaya lang sabi dapat daw US/CANADA issued credit card lang.

  4. i just want to seek some enlightenment, anyone here might have the answers to my questions. anyone might be able to give some advice.

    my husband failed to file taxes last 2007 - being self-employed, he did not earn any in hauling as well as early last year. then when he got employed for a couple of months, he got arrested and served time in jail for defending his property (assault). after paying bond, he got out. while waiting for the trial to end he got a job recently, but last month after a jury trial he got convicted of a felony. next week will be his sentencing. :(

    we're almost done w/the process,but we got another checklist yesterday, NVC is asking for his tax receipts...how are we going to produce that when he hasn't filed any for the past 2 or 3 years?

    they are also asking for his W2s when he only worked for a couple of months.

    we have a co-sponsor though - his mom.

    can anyone help me know if there's still a light at the end of the tunnel?

    its been a tough journey for us. tougher than normal. even if he wont be sentence to jail he will surely be on probation which wont allow him to move here in Philippines instead.

    and yes philippine government sucks big time.

    i hope there can be a petition for suzette nicolas to be tried for perjury. she deserves to be punished for taking away precious time from a man who is serving his country.

    to filipinos rallying infront of US embassy dont be hypocrites if you hate US that much then stop drinking COKE or PEPSI...dont go to McDonalds or KFC...lol

  6. Hello guys! what happens if we didnt follow some instructions from NVC? I mean, the DS-230 was submitted before the IV fee was paid. Then NVC sent an e-mail with checklist saying that they already received the required AOS but not the IV fee payment yet. NVC also asked me to complete another DS-230 as they put a note on the part pertaining to All the places I lived since reaching the age of 16 because it is blank/incomplete. Once we submit the needed requirements by NVC, how much time will they need before our case reaches its completion? Will it be possible for me to get my medical and interview schedule on or before December 2009? By the way, I am a CR-1 beneficiary. Thanks in advance for whatever info you can share with me.     nobody knows how much delay it will cause you. even the ones who followed the instructions had some delays too. i guess you just have to follow. don't be too excited about the paperwork. you'll gonna get through it. just relax. and read instructions carefully. one at a time. pay fees first and then they'll send you notice on whats next to do. plus this site has many helpful tips you can search on.

    yes its possible you get interview schedule by December. Nothing is impossible with God so just keep praying.

    most of all do what NVC asks you to do LOL...if you accomplish that the soonest possible time...the soonest you'll get interview sched of course.

  7. If he did not file taxes then he does not have tax returns for the past year - or 3 years, to submit with the I-864. Since he is self-employed - did he have earnings of more than $400.00? If so he probably will need to file them.

    If he is not going to file, he will need to submit a letter, with the I-864, explaining why he did not file, has to be a legitimate reason of course.

    If he thinks he was not required to file - have him call the IRS and verify it and write the letter to go with the I-864. If he is sure he has to file, then have him file the returns - there is no way around it.

    Possibly if he owes money to the IRS, it could affect them granting you a visa (he of course would need to work with the IRS to come up with a payment plan or whatever), however, not filing the returns if he is required to is a guaranteed rejection.

    he paid taxes i think for 2008 and even got a refund...but 2007 has been a really tough year. i think that's when he owed taxes.

  8. hi guys, we are so close accomplishing the paperwork, but my husband has not yet finished the I-864 supporting documents. currently, he does not have a regular job. he was on unemployment benefits recently. prior years he did not pay taxes since his hauling business was not doing well. NVC is now waiting for his I-864 forms. his mom is our co-sponsor. but my husband is still hesitant to mail the form. he is afraid we might get rejected because of his financial problems. its been really tough since he got in jail last year for defending his property from repo men thats why he lost his job.

    i feel like we are on a dead end right now. is there still any way we could get through this?

    i would really appreciate some helpful advice.

    If your husband does not send in the paperwork, your case will be considered abandoned and USCIS/NVC will close your file. So, the chance of you getting a visa is zero.

    If your husband sends in his paperwork and the co-sponsor's paperwork, USCIS/NVC will process your case. Depending on the information, you may get a visa.

    It seems like a simple choice - submit the paperwork.

    so we'll just submit my husband's I-864 forms and whatever documents we have available on hand right now, is that what you are trying to say?

  10. I called NVC about Ds-230 and what document needed.

    Following is the list

    1. DS-230 Part1 (Signed) and Part 2 (Not signed)

    2. 2 Pictures of 2X2 size(write case number behind picture)

    3. Passport bio-graphic page(Copy)

    4. Birth Certificate (Original)

    5. Marriage Certificate(Original)

    6. PCC from District Police Station(Original)

    7. PCC from Passport Office(Original)

    Write case number on each page of documents. Put barcode page (page sent by NVC) on top of all this.

    NVC operator told me that I will get all original documents at the time of interview at Bombay, India

    And he also told me that we don’t need to resubmit all this document again to embassy or VFS (VFs is

    Accepting all the documents on behalf of embassy before interview)

    So after sending DS-230 to NVC we just need to wait for interview latter. And complete Medical.

    And go for interview……that’s a procedure right now for CR/IR category

    I sent the documents without writing the case number in each page :crying: I called NVC the operator told me is OK, they do that in case they misplace the documents. I don't know how come I miss that :bonk:

    youre not alone, i forgot to put my case number per page too....now i feel better...hehehehe

  11. Hello, I just mailed in my AOS processing fee for $70.00. They received it and emailed me back a PETITIONER PACKET, Affidavit of Support (AOS) Processing Fee Bill Invoice for $70.00, and a IV FEE AGENT bill for $400.00. I am confused here. Do they also send a hard copy thru the mail with all the necessary documents for AOS processing or is it all online now? I thought I read that they were going totally online, but I am not sure if that has taken place yet. Also in the IV FEE AGENT bill, they only listed my wife and not her child. Do I just pay the $400.00 that covers them both or is it $400.00 a piece?

  12. you just have to wait maybe in a couple of days...if you get too anxious you can call NVC hotline 16033340700 to check your status...there's an AVR that tells your case status... if its already received or if they had already assigned NVC case number and after a few days it will also tell you if AOS Bill & DS3032 has been generated and sent...it will not take so long i believe...;)

  14. you really dont need an attorney to do the paperwork for you...most of them are just after your money...and in PI immigration lawyers are not cheap.

    my uscis journey had some complications, we got RFE but it only took us more or less 5 months to get the approval.

    there are so many helpful guidelines here in doing your paperwork, instead of paying a s**p*d lawyer, just save your money for your future needs.

    one more thing you and your fiance just needs to work on this together and you wont need a liar, i mean a lawyer.

    May i ask where did u dubmit your I130? at the California Service Center? or at Chicago? We read that all filers of I130 must send in the papers in Chicago. My husband submit ours in California.

    we sent ours to Chicago lockbox...based on the instructions written on the I-130 form...and then they will forward it to CSC i think.

    The case has strained U.S.-Philippine military relations amid calls for the scrapping of a pact allowing U.S. troops to train Filipino soldiers, and has become a rallying point for anti-American protests.

    Three years after Lance Cpl. Daniel Smith was convicted of rape and sentenced to 40 years in jail, his accuser submitted a five-page affidavit to an appeals court Tuesday saying she now doubts her own version of events.

    "My conscience continues to bother me realizing that I may have in fact been so friendly and intimate with Daniel Smith ... that he was led to believe that I was amenable to having sex or that we simply just got carried away,'' the woman said in the statement.

    She described the two were drinking, kissing and dancing at a bar at the former U.S. Naval base at Subic Bay before moving to a van, where she originally told the court she was raped while she passed out. Smith had insisted the sex was consensual.

    The turnabout has shocked her supporters, including lawyer Evalyn Ursua, who said her client terminated her services this week then moved to the U.S. to start a new life and was no longer willing to talk.

    Justice Secretary Raul Gonzalez said the woman could be charged with perjury and her affidavit may not be admitted as new evidence because it should have been introduced during the 2006 trial.

    "I am not happy with her because her accusations divided the nation, then she turns her back on everything,'' he said, adding the case had affected the country's foreign policy.

    The U.S. Embassy in Manila is consulting with American government legal experts in Washington on the case, embassy spokeswoman Rebecca Thompson said, without elaborating. She refused to comment on reports that the woman had gone to the United States.

    Smith, 23, from St. Louis, Missouri, has been detained at the U.S. Embassy while his case is on appeal. Last month, the Philippine Supreme Court ruled he should be serving his sentence in a Philippine jail but left it to the government to negotiate his transfer with Washington. Smith is appealing his conviction.

    she led people to believe she was the victim but i think she really is not. if she was really raped it would have been very traumatizing for her, but hearing the news that she made it to the US (on what type of visa?) and has a new american boyfriend, makes me question was it a traumatic experience for her that she even wanted Daniel Smith to get death penalty....

    she should be tried for perjury and get deported back in the Philippines...you cannot just ruin a guy's life and enjoy yours.

    she doesnt have the right to step on US soil!

  19. ITS TOO EARLY TO SAY THAT THE MARRIAGE IS NOT WORKING SWEETY, MAYBE BOTH OF YOU HAVE EXPECTATIONS THAT IS NOT MET. YOU GUYS ARE STILL ON ADJUSTMENT PERIOD. AND YES GOING TO A MARRIAGE COUNSELOR MIGHT HELP. IF YOU LOVE EACH OTHER BOTH OF YOU WILL DO EVERYTHING TO SAVE IT...DO YOU REALLY LOVE HIM? OR DID YOU JUST MARRIED HIM TO BE IN THE USA?
