I cannot add much to that has been posted already other than this...
A paternity test is not something that can be done same day. The OTC tests from the likes of CVS are little more than swabs you mail off for processing. A proper test takes several days AND that is in an ideal location/facility.
If you wish to, you could ask him how long he had to wait at the hospital after the test was done. If he indicates he had to go back another day then it is possible that the test is genuine. If however he indicates it was a same day result I would be VERY wary. Also, if he does not ask for money then you can ignore most of the posts in here. IF however he does ask for a 'loan' you need to step back and REALLY think this through. Don't be a statistic.
Finally, Morocco is in no way some backward country. They have laws and regulations like anywhere else. Think for a moment about how likely it sounds that a mother with infant makes an accusation, has a DNA test and has the father's passport confiscated all in a matter of days. She is asking for him to pay (pay what?) and as he doesn't have money the Police take his passport. Think about that, does it make sense? Who are the Police to take a passport without some trial or judgment against this man? Ask him to send you some paperwork in relation to the DNA test and/or the police action and see what response you get.
I truly hope we are all being overly cynical and he is a genuine guy in a predicament but the world we live in requires a healthy dose of cynicism.
You probably don't have a very good perspective on this right now being in the middle of it all. Try to remember that as you make decisions.

I think the OP is more contemplating a potential future scenario where he might return to the UK and IF he does so then he wants to preclude IRS issues. This is as opposed to moving there purely to avoid US taxes.
As for why people do things, remember we are all different and have vastly different situations so there is, as long as legal, rarely a right and wrong. Tax avoidance is legal and undertaken by thousands of people annually. Tax evasion is a different matter.
If someone elects to live as a USC and pay the IRS that is fine. If instead they elect to move abroad and renounce citizenship then surely that is also fine.
I myself spent time looking at the tax ramifications of both living in the US and becoming a USC. In the end I opted to stay a UKC but not for tax reasons.

Yes, congrats on receiving your NOA1 but as TracyTN pointed out this is not an approval but merely a receipt to show they have received your petition.
Extending status for one year is the standard step prior to them actually looking at the case.

Either way, people are right. We don't know what is going on behind closed doors.

This is bigger than a pure immigration issue. Try to find a local group that cares for abused spouses, as that is what it sounds like you are. Your husband is bullying you into boarding a flight against your will. He cannot do this, legally or morally, and you have no need to board that flight unless you want to.
Get some advice and don't let him push you into a situation you neither want nor need.
As others have posted your husband has no involvement in a decision for you to be deported. The reason he is likely trying to move you out of the country is that he knows he will potentially have to provide financial support int he event you are without income.
If you want to stay in the US with your children ignore his request for you to leave and get someone on your side to help you understand your options.

I am fairly sure most posters in this site have indicated that the divorce decree must be final prior to submitting the I-751 petition.

Actually you don't have to have the divorce decree in order to file the I 751 on time. -

You are asking a question a bit like "will the examiner prefer blue or green paper". It all depends on the examiner, on the other evidence you submit and a myriad of other factors. Submit the best evidence you can and sit back and wait.
Having said that, personally I think submitting one return would simply raise the question as to where the other one is but that is just me.

Hi Everyone. thanks for your help thus far. Well my plan is to submit taxes as married but to file them seperately.as a hypothetical.... what would would happen if we did do this (married but fled seperately), and as part of the evidence only me submitted my tax transcript as evidence but not my husband. Is one better then none?

To answer the original question, IMHO no you do not 'need' to submit tax returns.
Tax returns are simply one form of evidence, albeit a listed form of evidence in the I-751 instructions. They might be viewed as a preferred piece of evidence but if you have other evidence then I wouldnt worry unduly unless you have some reason to avoid sending them in that you don't want uncovered.
The I-751 instructions do indicate that you need to cover the topic of joint assets and liabilities and lists state and federal tax returns as sample evidence but as long as you have other evidence in this area you should be fine.
As for 'you could receive an RFE', you could receive an RFE for any of a thousand reasons, or not. It is like me not wanting to go outdoors today because I 'could' get hit by a plane.

I just wanted to make a final post in here to say thanks to those that run this site as well as those that contribute information to the community.
I FINALLY received my I-751 approval letter this afternoon and as I have no intention of applying for citizenship this is my last leg on the journey.
Good luck to those still on the journey, I wish you well.
