  1. My wife and I met in the U.K., travelled, moved back to the U.S., and decided to stay. It became obvious that in order for me to stay, we should get married. We were happily married for a time, until she drastically changed her lifestyle and became a person I could no longer relate to or spend time with. I tried for a year, to coexist with her despite the new conditions of our marriage. Eventually though, I became unhappy and lonely. I ultimately met, and began seeing a woman that I work with. My wife is unhappy but I can no longer stay in my depressing marriage. I care about her and don't want to hurt her, but the situation is so unhealthy. I certainly entered into the marriage in good faith, but now my wife and relationship bear no resemblence to what I signed-on for. I am up to apply for my 10-yr. green card in March. My question is: Can I still apply, even though my wife may not sign and is demanding money if she does? She has consistently threatened my status and has kept me financially vulnerable because she has always demanded that I pay my full salary in rent while she maintains savings and a disposable income. I feel like she is holding my hostage.

  2. Filed AOS+ EAD but need to work fast!lol..

    Any ideas on how long it takes?

    I was told at USCIS ,up to 90 days...but was looking for a better answer.

    I think it is very random, some are approved in as little as 4 weeks, other 5-6 months! I was just approved today after 98 days, no RFEs, an infopass and a congressional inquiry (which is what I think did the trick). After 90 days you can start with infopass, etc which is what helped me. Good luck and think positively! :)

    i mean EAD not the AOS..i just want to work NOW!!lol

  3. You cannot file Form I-765 (EAD) before the AOS. You have to file the EAD either with the AOS or after the AOS.

    The $1,010 fee for AOS covers EAD and AP (Advance Parole, Form I-131), so you may as well apply for them at the same time as the AOS (Form I-485).

    I'm not sure why you can't file for EAD before AOS. At least K3 folks can and we did under the old fee structure. However, it seems silly to shell out an extry $340 to do so. It's not like you get to reduce the AOS fee because you already paid $340.

    How long can i work on the EAD?

    I was thinking of paying $340(EAD) get a job,then apply for the AOS ($1010)...

    You file for AOS, look in the guides for what forms you need to fill out.

    You will pay for the vaccination supplement, which may be cheap if you don't need anymore vaccines.

    AOS costs $1010, but it will eventually result in your green card. You wont be able to work until you at least receive your EAD which you can file for when you file for AOS. The eception is getting the work auth stamp at JFK, but some employers wont take that as it only allows you to work for 90 days.

    I didnt know i had to pay $1010...

    what about I-765 form EAD,,,can i fill that before AOS...so i can start working and save the 1010$?

    You have posted this question 3 times now, and in NONE of them did you even acknowledge that you read the information provided to you.

    The answer that you got in this post was given to you in the previous two...it's not like new information is being given here.

    Julez was simply directing you to those threads, which was super helpful IMO.

    You can drive and re-enter.

  6. Of course you can drive! As soon as you approach the US boarder, the agent will ask you your citizenship and for your passport. They will then direct your vehicle to another building where they will process you. This would happen whether or not you have a K1 visa in your passport. Unless you have a valid I-94 in your passport. Which you do, but in telling them that you wish to validate your K1, they will accomodate you. I do wonder though how the 90 day clock is affected since they typically will not issue another I-94 if you have one with time still left on it?

    My fiance has visited me in the US via Canada several times and that's how it always works. He came to the US with me driving over the Peace Bridge from Ft. Erie, CA to Buffalo, NY. I assume that the other POEs would be the same.

    I do have an I-94 until jan 14,,but i have my chest X-ray and the 'yellow' envelope to hand in...thats my problem see!!

    If you are not satified with these answers, perhaps its time to invest some money in consulting with an immigration attorney, or make an Infopass with the local USCIS office for advice.

    and anyway,,,all the questions ive asked on this site before have resulted in WRONG information so its a waste of time ..

    i just thought id try again,.........as different pplmight be online.

    and INFOPASS??ive been there before with another issue and they didnt have a clue..!

    USCIS doesn't deal with visas. What you need is the Customs and Border Patrol. You're on your own though. Pissing in everybody's cornflakes is not the kind of foreplay that gets them eager to help you.

    The visa is printed on one of the visa pages in your passport. Where is your passport?? How did you get into the US without a passpot, or with passport?? If with passport...how are they going to issue a visa??

    went to London,got interview but they needed more details...

    I flew to the US with passport.

    Got the necessary docs and send them with passport to US Embassy London.

    Got visa to parents house today.

    Im in the US...

    Could always drive to Mexico (or Canada) and turn around and (re)enter.... Otherwise I'm at a loss (as you might be having to explain the David Copperfield appearance trick.) :huh:

    i doubt that i could too.im only 4hr drive from Canada,,,does driving count or do i have to fly?

    i went to Canada before and didnt even take my I-94 out

  11. By God's grace, got my visa approved yesterday!!!

    Am getting very stressed though here since I was expecting to receive my visa the today. I called the Consulate a couple of times, but still havent issued the visa :( I hope I hear by tomorrow!

    Please share your experiences. Has it taken more than 1 day to receive the Passport? Thanks.

    US Embassy in London received my passport on Monday,,and i got my visa through a courier from London today(Thursday).

  12. visa is in my passport from today,an i had a yellow envelope from them too hand into immigration

    The thing is,im IN the states already on a I-94.(I sent my passport to US Embassy in the UK as they needed more docs after the interview)

    I can get my package/passprt sent to me here in the US,,but HOw will i activate the K-1 without coming in through an airport??

    I cant afford to fly to Uk and back again......

  13. You cannot apply for EAD without the AOS.
    K-1 can apply for EAD before, but it is an expensive $340 mistake to do so.

    Why do you think it's a mistake?

    I want to work as soon as possble

    Because USCIS takes just short of 90 days to process and send out the card, and it will expire the same date as the I-94 card (90 days from entry)

    I have read of many people making that mistake, and getting denied the EAD card due to I-94 expiring before USCIS can mail out the card.

    The K-1 is not a work visa, it is a fiancee visa with the solo purpose of allowing a couple to marry in the USA and adjust status.

    If you want to work ASAP, as I said an IMMIGRANT CR-1 visa is the better one for this.

    One of advantages of a K-1 visa as listed on USCIS website is that I can be employed!!

    Im confused!

    And if i come in to USA on a K-1 visa,,,why do you mention I-94??
