I am conditional permanent resident since Oct 2016 , and my I-751 ( joint) is pending since July 2018. Our marriage is going south, and yesterday my USC wife served me with the divorce summon . I know I can switch to Divorce waiver petition, but my question is , do i need to inform USCIS upfront proactively or shall i just wait to hear from USCIS ( RFE, approval or interview) and stay quite unless the divorce is finalized ?
I am california resident , and our divorce would take minimum of 6 months to be finalized, what if i get approved during this time ? As in , am i still liable to inform USCIS about divorce proceedings ?
Note: I have not applied for citizenship , though i am eligible for it .
