    if the embassy grant k3 visa what is the time frame to use it (activate it ) .

    does k3 allows to visit home country and re-enter usa.

    how is the entry at the airoport .how long time it can take.

    what if change the address in usa on ds -156;ds-230 ;is it a problem or it is okay

    what papers needed for adjustment of status.

    Validity of K3 status itself is 2 years and good for multiple entries. But you have to enter within 6 months after the visa is issued.

    Is anyone aware of NVC putting the case on Administrative Processing before sending it off to the embassy? I called to inquire about my case today and was told that it is on AP and they have not timeframe when they will send it to the embassy. I'd heard of cases going AP after the interview but not at this level. The lady on the phone also mentioned that this is a new procedure now. I wanted to share this info with everyone here and find out if anyone else was also told that their case is going through AP at this early stage?

    Hi Rainbow, sorry I don't have any interview related information for you but a question. The first packet that your wife received from the embassy (after the case was transferred from NVC), did it have the interview date already? Can you please share the timeline when NVC received the case, when they forwarded it to the embassy?

  4. Hello everyone!

    NVC says that my case is in Administrative Processing because they have changed some rules. I thought AP usually started AFTER the interview and for a select few. Has anyone else ever told that their case is undergoing AP after USCIS has forwarded the case to NVC and before it is sent to the embassy?

    I am hoping it is the same AP that is done after the interview and hope they won't do another AP after the interview because I've seen people's cases have been delayed for months because of AP for no reason.

    Sky2k, my timeline is already updated. My case is currently at NVC. They say they should be forwarding it to the embassy anywhere from 1 to 4 weeks. At one point they said it's in Admin Processing. I am just waiting for them to tell me that they have forwarded my case to the embassy.

    Was anyone else here told by NVC (before the case even got to the embassy) that their case is undergoing Administrative Processing? I thought this was done AFTER the interview.

  7. Yes you need to mail all the forms and other required documents including pictures/old passport/bank statements/police clearance etc. There is a big list of things needed to be sent (both orignal and one copy of each).

    Also make 2 copies of each document that you are sending (one for you and one for your spouse)

    Can you please include the complete list of documents that they asked you to send with packet 3.5? I just want to make sure if they have changed or added something that I should get ready for. Also, did they ask for an I-134 Form or an I-864 for Affidavit of Support? I am fairly sure that for a K3 (non-immigrant visa), they need I-134 only but want to check to make sure since they keep changing policies.

    Rainbow, since you don't have any timeline in your signature, can I please ask you how long it took NVC to forward the case to the embassy and once the embassy received it, how long it took for them to send the first packet.

    I am trying to get a rough estimate of when my wife's interview will be. Today when I called the NVC, they said that they have received the case from the USCIS. The lady on the phone told me that it takes 4 weeks for them to forward it to the embassy. Based on my timeline, do you think my wife should get an interview date for March or April?

    It will be valid for 6 years regardless of visa validity. A friend of mine who is not even a PR yet (has an EAD) got his 6-year valid TX drivers license.

    Hey, same here....I am going for two months in December and was hopeful my husband would come with my daughter and I now that his case is in ISB.....but it looks now that it's not even close. Best of luck.....and hang in there!

    Actually, Kim, I think Infinit meant Crown Palace...........NOT Crown Plaza. I spoke to someone on another forum and they stated that its a reasonable cheap place to stay. Thanks to InfinitBoy for the heads up.

  12. Is there any way to find out the status of either I-130 or I-129F? My I-130 was last touched on 06/03/2007 and I-129F was last touched on 07/14/2007. I am usually not very impatient but it is now beginning to worry me. What will be the next step? Will I get something through postal mail or will they provide an update through case status site?

    Also, I remember there used to be I-129F (Spouse) processing times posted for California Service Center but I don't see it there any more. Is there any way to check processing times for spousal I-129F applications (K-3)?

  13. Hey Tareq,

    Just to give you a heads up, they sent my I-129F from Chicago to California for "quicker processing". Just be prepared. If you look in USCIS site under the press room, you will see that the filing instructions will change eventually. If you are closer to the East Coast, Im assuming they will send your I-129F to Vermont, but if you are West Coast, expect it to go to California. Mine is pending in California and I received a notice from Chicago about the transfer. I called USCIS on Friday about my I-130 I-797, and the immigration officer pretty much told me that they never sent anything in the mail cause CSC is doing catch up, which should have been done by the 15th but they are still catching up. She told me to call the first week of July if I dont receive anything. I am so dissapointed in them. I have called probably 4 times before, and the customer service reps pretty much lied to me. They said they sent the receipts and the immigration officer pretty much tells me they did not send me anything. I wonder who I can file a complaint about their system cause it is not right. I would be fine if they said it would take 6 months to get a receipt. Dont lie on the case status online and state that a receipt is mailed. Anyhow, I am happy to hear that you initiated the K-3 process. Its hard not having your partner with you. Let us know how things go. I will keep you and all posted on anything that comes about :whistle:

    Thanks for the update. Today I got an email from USCIS case status system saying that my case was updated. When I checked, it says the same thing you already told me: My case was transferred from Chicago to California.

    I am not surprised to hear about your experience with USCIS phone-based customer service. Those reps have really not a clue what they are doing - they are simply outsourced customer service reps who have not been given any training whatsoever. Whenever I call, I try to speak to an immigration officer and skip the customer service reps. They will not transfer your call to an immigration officer if you give them your case number. The best way I have found to speak directly to an immigration officer is to let the rep who answer the call know that you do not know your case number (yes, I have to lie to get past this in-effective beaucratic system that they have put in place). Once I tell them that I don't know the case number that they will have to look it up, they transfer me over to immigration officer because these reps no access to a system from where they can pull up my case number. One of the reps also told me that they have ZERO access to any personal information and all they can give me is "general information". If you give them the case number, all they do is pull it up on USCIS website and just read the information that the case status website reads - which you can do it yourself if you have to a computer and the Internet (which most of us do) so it makes it pointless to even talk to these customer service reps.

    Plz if anybody can help me . My husband sent the I-129F (spouse) to Vermont not to Chicago! What should I do now. He got confused and he sent without checking with me. I'm afraid to have more delay on the process now. Plz if anybody can tell me what can I do? Should I call them??? Thanks :help:

    I'm sure others with give their expert advice but if I were in your shoes, I would just forget about what I sent to Vermont and instead send the same application to correct Chicago address. I hope you have made copies and have duplicates of any originals that you may have sent.

    Instead of waiting for them to either send it back to you or forward it to Chicago, in my opinion, it's best to just send another application with fee and everything to the correct address. By sending duplicate application you can't confuse USCIS any more because they are already too confused. The only downside I see is that you will lose the application fee.

  15. Hello, I'm working on my I-129, I'll file without the NOA1 by tomorrow or friday. I have seen many members who have been filed and have already rcvd the N OA1 for the I-129....

    Make sure you have the I-130 case number before you file I-129F. It should be on the back of the check. Looking at your timeline, you should have filed I-129F long time ago. I regreted why I waited so long but it was worthless - if it does not arrive in 45 days, it will never arrive. The only NOA1 that I received for my I-130 is one that I requested by calling them and they said that they mailed a duplicate - that was received after waiting for another month. They are extremely backlogged over at California Service Center.

    On my I-129F, I included these proofs that applied for I-130:

    1. Print out of case status from USCIS.gov site (This case only be done if you know your I-130 case number)

    2. Request your bank to send you official print out (or original) check for I-130 fee.

    Is CR-1 requirement different from K-3? I thought the documents they ask are to be brought with you for interview. If you send the originals, do they give it back during the interview?

    The letter I posted earlier was from a good friend (not my wife's) and it does not ask to "send" those documents but instead asks to "bring with you" for the interview.

    Just out of curiosity, how much trouble to you think it might have been for the file clerk to get the photos out of those plastic things? Not a whole lot, I'm sure, but probably more than it takes to drop them out of a baggie. My guess is that my way (not mine actually, I copied it from someone else) was easier and cheaper for me and easier on the file clerk. But it's no big deal in any case.

    I just used a paperclip and attached the photos and the check (application fee) to the cover letter. Simple and easy. It was tight enough and should have stayed attached until it got there.
