To make a long story short I started this visa process back in 2006 (hired a lawyer), first my husband and I applied for the K3 and was approved and got his visa in May 2007 (we never used it), we'll his contract at his job in Kuwait was not finished yet so we went ahead and decided to get our approved I130 for the IR1 visa going again so we did the necessary paperwork to have USCIS send it to NVC. NVC received our approved I130 on November 18th 2008. I contacted my lawyer again so he can do what is necessary to get our approved I130 to the american embassy in Kuwait. We'll its February 2009 now and my lawyer emailed me finally today and this is what he said......

    "Hello Melissa,

    I’m sorry this has taken so long. But here is the update, the affidavit of support fee bill and the immigrant fee bill have been paid. The cost was $470. We are waiting for correspondence from the NVC with instructions on how to proceed.

    The case right now is at the I-130 stage. Because each consulate handles these cases differently (even within a consulate different officers handle the cases differently), it may be the case that Hassan goes to the consulate and they just approve his I-130 and tell him to go to the U.S. and file his I-485. Our firm has had other cases where the consulate issues the green card within a day or two of the interview (that doesn’t typically happen with family-based cases, but sometimes it can)."

    Ok I thought that since our I130 for IR1 was approved here already at USCIS that they would just send it to NVC and then after all the necessary paperwork and things they would send it to the embassy in Kuwait for an Interview and then if approved Hassan would receive his greencard and then we would be finished. I didn't know we would still have to deal with the I-485 adjustment of status once he gets here to the U.S.A!!!! :wacko: That means more paperwork and having to pay my lawyer more money to do it!! :wacko: I'm wondering if my lawyer is just saying this hoping we will need his assistance again and fork over more money to him!! :crying:

    If anyone can shed some light on this matter I would really appreciate it!!! Thanks for taking time to read this, I know it's kinda long.

    First of all there is no I-485 with a IR1 visa, you are correct..

    Secondly, there is no greencard until the alien enter's the USA... He will be interviewed and when approved, he will get a visa. He will enter the USA and 3-6 weeks later receive the physical greencard... They will put a stamp in his passport when he enters (I-551 stamp) that acts like a temporary greencard for up to one year until the physical card is produced.

    Thanks for your response!! That's what I thought too!!! I wonder what my lawyer is thinking!!! :blink: Our I130 was already approved by USCIS and sent to NVC and my husband and I have already been married for over 2 years now so it is the IR1. This lawyer is making me confused!!

  3. I called NVC today and the automated voice system told me they entered my case into their computer system on November 10th and to allow them 6-8 weeks to process it!! :dance:

    Finally NVC has received my approved I-130!! It took over a year for them to get it but it finally happend!! I'm so excited now I can barely sit still. I'm so happy that I'm crying. :lol:

    The only thing that made me get through this is God and my husband Hassan and the wonderful people here on VJ. I want to thank my mena family for keeping me sane through this process. (F)

    So this is another step closer for my husband and I to finally be reunited as a family. I hope and pray that the interview will go smoothly and they will approve him. Inshallah our dreams will come true soon and I will never have to leave my husbands arms again. :luv:

    I hope to hear some good news from everyone else who is still waiting on their petitions to be approved and to those who has their interview dates already scheduled. My prayers are with you all. (F)

    I got an email today stating that they had resent the letter to me at my new address today and of course I was in shock and couldn't believe it so I had to check mt case status online and sure enough it stated what the email said and also my I-130 was touched today aswell.

    I believe they will send it to my correct home address now because the email I gave them the other day on the phone to tell them once again my new home address is the email they notified me at.

    I hope and pray that it wont be long now and that my approved I-130 is finally on it's way to NVC then onward to Kuwait. :dance:

I checked my case status online this morning to see if there was any new information about my I-824 Application for Action on an Already Approved I-130 Petition being sent to NVC and of course USCIS messed up again and they sent me some kind of notice to my old address after i filed the proper paperwork and called them 3 times with my new change of address months ago. Since of course I was not living at my old address the post office sent it back to USCIS as undeliverable!! :wacko:

    I called USCIS once again and told them my new address for the fourth time!! Now I'm sitting here wondering if that was the letter I have been waiting so long for ever since November 2007 saying that they are finally going to send my approved I-130 to NVC. :crying: I asked USCIS if they had any idea what the letter said and of course they were rude to me and unhelpful and said they don't have access to see what that letter was about. :crying:

    They told me to wait and if I don't hear anything within 45 days to give them a call back. :crying: I don't know how much longer I can take not being with my husband. :( USCIS has messed up so many times on my case and they act like they don't care and keep telling me to call back after 30, 60, 90 days...I'm so sick of hearing that. I'm paying the price dearly for their continued mistakes. :(

    On the bright side that means he can come on the IR1 rather than the CR1. Much better!

    Yes it is still at USCIS but inshallah it will be at NVC soon!! I have also looked at the bright side and he will be able to come here on the IR1 and we wont have to deal with doing the adjustment of status!! :dance:

    Now I just wish Hassan and I could be together for our 2 year anniversary tomorrow but I'm not going to let that get me down because I know we will be reunited soon and all of this will just be a distant memory and we will spend the rest of our anniversaries together. :luv:

    I'm praying for you Sandrila and the rest of you guys who are still waiting to be with your loved ones. Inshallah we will all have good news soon!!

  8. Good morning everyone, I hope all is well with my mena family. USCIS has finally started working on my case again after I talked to a really sweet woman at USCIS. I know it's shocking to actually have a person over there that actually cares about our feelings :lol: anyways....she put in to have our case expedited since on the approved I-130 it stated it was suppose to be sent to the NVC back in November 2007.

    Since I have had that pleasant conversation with her USCIS has touched my approved I-130 and my I-824 3 times already this week!! :dance: Until recently my approved I-130 has not been touched since November 2007 and my I-824 that I filed and dished out $340.00 for them to fix their mistake and send NVC my approved I-130 petition was touched in September the day they cashed my check....it doesn't take them long to take our money now does it :lol:

    I hope to hear some good news this week or next week. It is going to be mine and Hassan's 2nd year wedding anniversary tomorrow which is October 31st (I know halloween it's crazy....wasn't planned for that certain day...long story :wacko::lol:) and one of these years we would like to spend it together!! This process has been so long and frustrating for us. We started all of this back in 2006 and we hope and pray this will be the year we will finish this and start our lives together inshallah. Please pray for us everyone and my prayers are with everyone here who is waiting to be with their loved ones aswell.

    we are a moroccan american couple who felt in love with eachother , we met online one year ago and been talking

    since then,we developped strong feelings for eachother and we truly believe we do match perfectly together,

    we are around the same age, we are both muslims and we do share the same outlook on life.

    we can see that there are many moroccan american couples on here and we would like to get a little advice on what is best to allow us to be together. Is it easier to file for a K1 visa or Marry in morocco and then file for a K3 visa...?

    we would apprecate any advice you have...

    Hello and welcome to VJ. Reading your post has made me a little confused....which one of you is the USC? Do you both live here now in the U.S.A since you stated you both are moroccan american or does one of you still live in Morocco? I don't know alot about the embassy in Morocco but If you would post this in the MENA (Middle East North Africa) forum I know you will get alot of helpful information from the wonderful Mena family we have here on VJ.

  10. Just stopping in to say hi and good morning to everyone. I hope to hear good news this week from my mena family inshallah. (F)

    I'm still waiting on the California service center to transfer my already approved I-130 to NVC.(It was approved back in November 2007). It took them only a day to cash my $340.00 check after receiving the I-824 but its been almost 2 months and still haven't heard anything about them transfering my approved petition yet. USCIS say they are trying their hardest to get all of us reunited with our loved ones quickly as they can when in fact they are just trying their hardest to take our money for all the fees and the new fee increases as quickly as they can. :whistle:

    I call the NVC everyday and I keep hearing "We have no record of that case number blah blah blah....." You guys don't know how many times I have almost thrown my cell phone after hearing that same annoying message :angry:

    Anyways I'm hoping this week will be the week I hear some good news but I'm not going to hold my breathe (the shade of purple and blue does not look good on me) :lol:

    that's not right.... have you asked if they lost it yet??? mine was gone for 21 days

    Everytime I talk to an operator they say wait 30 days then now wait 60 days and I know they will say ok you have to wait 90 days then they will look into the matter. :angry: I even emailed them a copy of my approved I-130 and a copy of my $340.00 check they cashed after receiving my I-824. It's frustrating that nobody there seems to care or want to help....I will put this in gods hands now and inshallah I will hear some good news soon.

  12. Hi everyone. I hope all is well with my mena family. I just wanted to let everyone know that Hassan and I decided to go ahead and have his approved I130 sent to the embassy in Kuwait and have that interview instead of him using his K3 visa he was already approved on in May or June...sorry I cant remember the month. :blink: We decided this is best for us since he is under contract with his company and is not able to take off a few months to come to the U.S.A and do the AOS. Once he is finished with his contract then he will come to the U.S.A :dance: We will be pursuing the IR1 since we will be married already for 2 years very soon. Our lawyer will be sending the I824 for them to send Hassan's I-130 to the embassy later this month. We need all the prayers we can get. This has been a long and hard process for Hassan and I, we started all of this immigration stuff back in November of 2006 so I hope soon we can have closure to this long hard road and be reunited again as husband and wife and live in the same household!! :wacko: I have to run now I need to take my sons to my sisters house...she is gonna watch them for the night and I will finally get a chance to have some time to myself!! :dance: Take care everyone.   13. Oh wow Jackie!! Congrats!! I just got back from being with Hassan in Kuwait and I'm happy to see this wonderful news!! :dance:

    I think Hassan and I are frozen also on our next steps in the process. As you know he is already approved for his k3 visa but we have decided to go ahead and have them transfer his approved I130 to the embassy in Kuwait and go ahead and try for the IR1 visa since Hassan and I will be married for 2 years already in October. It is just hard for him to get away from his work right now to do the AOS in the United States. He wants to finish out his contract with the company he works for now. He just got a promotion and a pay raise!! :dance:

  14. Hi everyone, I haven't been around lately because I am spending time with Hassan here in Kuwait. As you all know yes he did get his visa but his job has been so hectic and busy so we decided for me to come and visit him here in Kuwait for a little while. We have missed eachother so much and we are loving every minute together. :luv: I hope everyone is doing well and I will post more when I have time. Take care everyone and talk to you soon!!
