  1. Hi All, I was a March Filer, and I felt fortunate to have my spouse by me as she landed here on SEP 11 2007. Now if any of you here has the similar situation, could you please share your next steps (ie, applying for I-485 and I-765, I heard they can be filed together and I-765 fee will be waived) some one also suggesting to apply by walking to nearest USCIS office... instead of mailing... just wanted to hear from you if you have watched any other cases like that)..Will walking to USCIS will be faster than mailing it to...(I doubt I can walk into USCIS office and file it there as I read the instruction of I-485 and they said to mail it..)

    My wife finally was scheduled to be interviewed on September 17, 2007. I requested for an early date by email. An email response is received from the consulate saying the earliest date they can take my wife's interview is Aug 27, I had replied right away and agreed with that date. 7 days gone since I wrote them back, yet I didn't received any reply with confirmation.

    I know how exactly you felt.... I had to pass 298 days(Filed on Sept 2007 and approved on Jul 2007) watching other approvals.... with a great deal of frustration!!! for the approval of my I-130 petition, then I gave up and filed I-129F which was approved along with the I-130 on July 3. and prayed that no one should face the same situation.....But please keep your hope up... they have to approve your petition in no time... hang on few more..... it's coming...

  4. Am I missing something here? What we fear the most, that it will take longer, could be partially be our own fault by abusing this process.

    Absolutely right you are, I regret that I used this trick for number of time as my petition was pending for 270 days without any result...yet it didn't help at all...I think what brought my petition under light is my congressman and senator's inquiry....but I am not sure... may be it was just my fate... any way it's over... thanks god... unfortunately it took about 300 days but still I thank god that waiting for approval is ended now I have been waiting for her arrival... :dance:

    I have a good news to share with you Finally got an interview date (By email only...my wife yet didn't receive the packet#4 the very last one!!!!). It will be September 17 2007....still One and Half month. And everything is exceptional for me .... my other Bangladeshi Friend gets interview for K3 cases less than a month...and when it is come to myself....obviously it is not less than a month any more...I thank god for being so kind to me...it could be another 6 months!!!! who knows....as usually everything is coming 6times later.... ha ha ha ha...

  6. my I-130 approved. THANK LORD. my I-129 touched today as well. hopefully will get the approval notice for that one too. guys it is such a wonderful feeling......can't explain it in words. i am more happy than the day i got married. thank god. thank god.

Now waiting for the next letter with interview appointment. I was so disappointed to learn that: eventhough the email from the consulate stated they posted packet 3 on 17th July actually it was posted on July25th.... they took 7 days away from us just for nothing!!! :angry:

  7. How many of us have been approved for the I-130 before getting the I-129F approved? What are we doing to do next, what are our options??

    Please share ideas and pool information! I'm starting this thread so we can get together and do just that.

    I would go for the CR/IR route. If you proceed with the K-3, the fee for adjusting status will be $1010 effective July 30.

    Unless something has changed, it is my understanding that, as of 2006, because you filed the K3, USCIS will hold and not forward your I-130 to VSC, instead they will let your K3 proceed.

    This was done to "help" us because the K3 is faster, so no use in wasting resources on both I-130 and K3 when K3 would generally win.

    Instead they hang onto the I-130 to use it for AOS after your spouse enters the country on the K3.

    To ask them to go ahead and process the I-130 you have to file an I-864 which takes up to 2 months for them to process. (and cost more money).

    That's what I thought is correct but recently I experienced totally different sceanario... my I-130 and I-129F was approved on July3 but both of them went to NVC and assigned to 2 different case One with DHK2007****26(K3) another 27 at the end... and My K3 already went to consulate and I just recieved a letter from NVC asking me to sent Affidevit of Support bill of $70 for CR1 case...

    I forgot to notice the small form to send in with payment. It says VISA TYPE: CR1. ROFL!!!

    I got that bill yesterday too. I know CR1 was much better but, it was taking too long for my I-130 approval (298 days!!) I filed for K3 (now I regret I should have file earlier.... and she would be here long time ago, and I didn't have to pay over thousand dollars for Adjustment of Status [starting from July 30]... any way My case went to consulate July 10 and they still didn't respond to my email yet. Hey Consolemaster, what's going on with your k3? did your spouse got interview date yet?? in my country it takes only a few days to schedule the interview... and yet I have no responses from them [ oh yes!!! I am now impatient!!!! can't help ....] I wish I could go to see my wife like you....but my job won't allow me .... wishing you good time... hope you will come back with your wife...

  9. I have been so stuck on getting this approval that I never bothered to research the course of the K-3 visa after it goes to NVC. I understand that it gets forwarded to the local embassy but what happens next... will they contact my husband or will he have to contact them? :unsure:

    i know i am getting ahead of myself but why not use this time to learn more about the K-3 process.

    I have tried to learn about K3 too... After both my K3 and CR-1 approved it went to NVC and both of them were assigned 2 different case#. I found out (After lots of frustrating attempts to speak with live operator of NVC) My I-129F case which left NVC to Bangladesh on 10th July. Till today I didn't receive any reply to my emails to the consulate. They supposed to arrange an interview within 2 weeks. It's been 10 days with no reply. I admit that I am getting little impatient here but you should not forget that I shouldhv my spouse with me by now as I already let 298 days passed patientfully to just get the approval (And I am a US Citizen!!!) I can't be patient no longer....Neel here is a document about K3 process that I got from online... in this document it says there is no fee except 45 dollars which may be paid by the spouse during the interview...However someone from this forrum mentioned about paying non-immigrant visa fee of $100 dollars while interviewing your spouse. The Consulate will contact your spouse with Packet#3&4 (Madicale,Visa application forms and appointment letter for the interview). wishing you all the best

  10. Any one here has there K3 approved and on his/her next step??? I just got a letter from NVC dated 11th July saying my case will be forwarded to NVC within a week to Bangladesh. I am just curious if My spouse has to pay any fee during the interview or I wil be paying for her as I never received any bill from NVC yet. If any one know about it, please let me know.

    Did you ever figure out which petition the NVC has? I remember you saying that when you called, they gave you the same case number for both the I130 and the I129F. If they are processing the I129F and you wife will be applying for the non-immigrant visa, she must pay the non immigrant visa fee at or before the K3 interview. If its the I130, then you can become her choice of agent, and get the Immigrant Visa fee bill sent to you and pay that for her.

    If they are saying it is going to Dhaka in a week, it sounds like they are doing the I129F. This goes through NVC faster, and then she will have to pay the K3 fee.

    yes finally got it cleared , it is I-129F, and I was wrong about the same case# I noticed last two digits are different... how much is the K3 fee?

After numerous tries I finally got chance to speak with a live NVC rep @ 11:35pm(eastern time!!!) and came to know that the case# associated with my I-129F was forwarded to consulate in Bangladesh on 07/10/07, I had sent mails to the consulate but didn't receive any response acknowledging that they have received the case.... still waiting for interview.... can't wait any longer to see my wife....I regret that I didn't file my 129F petition earlier [if I would apply I-129F on september.... my wife would be by me now!!!!..once again I never knew that I-130 approval will take 298 days for me... :( ] Any way, those of you who are still awaiting for the approval....I hope that those approvals will come soon.... wish you all the best..

    P.S: If any of you have ideas about a K3 interview, please tell me if my spouse has to pay anything dureing the interview??? any fee associated with the visa itself... None of my family member or friends had faced K3 Interview. before so I don't have any idea..

  13. Nevertheless, I would call them again. Now that you've given the prefixes, it sounds like you do indeed have both cases at NVC. This is probably because they never got together at the same processing center. Do you recall which processing center your I-129F actually went through?

    Anyway, I found that about 11AM eastern time was good for calling NVC but you definitely need an operator for K3 cases.

    Hi pushbrk, You are absolutely right about the fact that the case number assigned for I-129F and I-130 is different. I have received a letter from NVC on 07/14/07,dated 07/11/07 stating that they have received an approved I-129F and will be sending it to consulate aboard within a week and I notice the last two digit of the case number is different for I-130 I have DHK2007****27,and for I-129F it is 26. Does that mean they assigned case # to I-129F first?? I thought when they get I-129F they don't even bother with I-130... any way I couldn't talk to an operator yet... still trying... my luck is not fevoring me.

  15. An I-129F and I-130 would not have the same case number. You reached NVC at 11PM Eastern time. Really?

    That's sound unbelieveable right?? I was shocked when the automated system keep coming back on saying due to heavy calls it was routed to the Automated system again and it said call back after 6PM to till midnight Eastern Time to reach an operator so I started trying again from 10pm and finally reach one of them at 11!!! and surprised too...(I was so desparate to see the end.. ha ha ha). I already knew the Case No for I-130 when I checked the system with my EAC receipt. So when I reach operator I just gave her the info of my I-129F(MSC #) to see what went on with this... and she read me back the same number as I heard from automated system while provided the EAC#(I-130). Looking at the 1010 dollars of AOS bill and 3 months wait for green card I am now confused whether I should be more patient and continue with I-130 so that after she comes in we don't have to dill with all this fillings... and she needs to go to University as soon as possible too.... now could you please tell me if I choice to continue with IR-1, what should I do?? and if I just let you to decide (may sound funny...but just wondering about your suggestion) what you would do??

I am already screwed by USCIS once with my I-130 it took them 298 days to aprove my I-130 after a lot of influence by my senators, congressman and USCIS local office (Please note that I am a citizen since 2004). While the I-130 had taken so much time I filed for I-129F on March 2007... First I never tried to do any inquiry for my I-129F.... till I got the approval email on July 7. I prefered I-130 as I always want less trouble. I came to know about my I-130 approval through an email and since then constantly check the NVC system with that EAC# and on July 6 at night the automated system finally acknowledged the receipt. When I got the Approval email on July 7 I tried to check the automated system but it needs operator assistance for MSC# therefore I waited waited ...tried tried...and finally got them on 10th July at night.. and she gave me the case number ... but since you said it can't be same I am little confuse as I didn't note it just because it sounded like same numbers...therefore I am now not sure... and calling them again is a nightmare... I don't understand why don't they respond my email???

    In think you should call NVC again and address the issue of case numbers. Ask specifically if your I-130 and I-129F would have the same case number. I've never heard of this. Let's verify first that you have two files at NVC and take the next steps from there.

  17. The full NVC process using the shortcuts takes 60 to 90 days if there are no hitches. You won't have to do any switching if the I-129F is approved. It will continue at its own speed independant of your I-130.

    My I-129F is approved and it seems like they had approved my I-129F on the same day they did I-130 but until July 6 I had no email nor even the Web portfolio registered any update date. As of July 6 I knew my I-130 was approved and in the NVC with a case #. After I got the approval email on July 7, I tried to contact the NVC live person, it took me a while to get the live person. I had been trying from 7AM till 11PM(EASTERN TIME).. finally at 11PM after a 12 min wait(which was not bad) I spoke to a live person who gave me the same case # when asked about I-129F and said it still in the NVC and didn't leave for consulate. Other VJ members reported their case(I-129F) has left NVC just the next day after receiving at NVC. Now My question is I-485 bill will be increased from July 30 as over Thousand dollars.. Would you please tell me if I still have to pay this I-485 bill while continuing with I-130 (IR-1) process... sorry if I sounded Stupid!!!

    I hope your I-130 in the NVC is going smoothly... eventhough my I-129F is also approved, it didn't departed NVC yet. While asking for Case number, They have given me the same case # that I have associated with my I-130. Note that, until July 6 I knew that they have only approved my I-130 and it went to NVC and assigned a Case #. July 7 I got an email stating my I-129F approval letter was sent on July 3(The very same day,when the I-130 was approved). From other VJ member experience,I knew that they only hold your I-130 if both I-130 and I-129F are approved same day. My case became little unusal again. I am still trying to be happy with the fact that atleast they are approved. Same time wondering, if I-129F is approved why isn't it leaving NVC like other I-129F filers(SoldierStory, ConsoleMaster...). Unfortunately I never could reach NVC operator, I have tried different time...7am to 11PM(EASTERN TIME) but no luck on talking to a live person. Emailed them twice but no responses other than the automated acknowledgement. Could you please share the NVC process of your I-130 case.. what state you are on now?

    Are you a legal resident or a US citizen? I am just curious to see if it matters wether a member is a legal resident or a US citizen for the time processing for a relative. Thank you. :wacko: Im getting frustrated with the California Service Center in the way they are handling business. They are not customer oriented at all. I wish I knew the head honcho of this program so I can complain about the service and the run around I have received from their customer service line. Its always the same excuse. I would at least appreciate an honest answer. Any how, congratulations. I could not imagine the long wait you had to go through with your family. I wish yall luck :blush:

    I am a US Citizen since 2004. And for your information only US Citizen can file I-129F. K3 is not allowed for Parmanent Residents. And yes I think I made a record on waiting for an approval on I-130 for spouse (298 days!!!! just to be approved, where my sister had to wait only 24 days for her husband's approval). I called NVC, I have started trying since morning but it kicked me back to automated system....after the 12th time I got connected to the operator (11PM!!! can you imagine it?) after 20 mins of waiting. She told me it still in NVC and has not been sent to the consulate yet. After waiting these many days... I am so frustrated that I think I need to prepare for extra waiting for every where.....I am not expecting any thing soon....finally stopped comparing my self with other fortunate people who gets everything on time!!! :unsure:

  21. did any march filers receive their approval for either of their petitions this week??????

    Finally I got my I-129F approved too. I got an email saying approval letter was sent on July 3, but they didn't email me until satureday!!! Before reading this email I thought My I-130 was forwarded to National visa center as since Friday night the ASR saying the EAC# is entered in to the system and a case number DHK200768**** was assigned. Now that I know that my I-129F was also approved on the same day I am confused whether they will send only I-129F helding the I-130 or not. I really don't care, all I want is: "Her to be here, as soon as possible". If I-129F is forwarded then it should go to Bangladesh today.... I called the NVC this morning but it is so crowded and telling me call back after 6pm eastern time...Consolemaster... if you are still reading this post while travelling....What's going on with your K3 process... what else you had to do after you got approved??? is there any shortcut like James' shortcut for K3???

    no consolemaster..i haven't gotten my approval. i wish I did though. Its been more than 4 months... i am scared. do you have any suggestions on what i should do. :crying:

    No one else will understand your pain better than me, I was patient for 9 months(September 2006 to Jun 2006) and have seen all of my fellow applicant along with most of the 2006 applicant got approved...and wrote so many letters to the USCIS, senators, congressman..... USCIS at Vermont never listen to any of these as long as the processing date was showing March 12 2006, June 18 it changed to directly November 02 2006, and I started begging again....then they have realized ####### they did....and finally approved my I-130 on July 3... Now The NVC is one more obstacle to pass...I regret I didn't file I-129F at the beginning (September 2006). However, I never thought it would take 296 days in order to be approved....any way neel I still think your case will not be like mine and you will be approved soon...keep hope... but do not delay to take necessary steps...like seeking help of congressman and senators while it's going beyond the processing date... I am happy for people who get approval quicker than anybody else, but hate the job of service Center as they acted unfairly with the applicants who filed earlier...this is intolerable...

    05/28/07 - Form DS-3032 (choice of agent) & AOS bill generated.

    05/30/07 - E-mailed choice of agent & mailed AOS bill (as per shortcuts).

    06/04/07 - NVC e-mails back acknowledging receipt of DS-3032 & enters AOS bill payment in system.

    06/11/07 - I-864 & IV bill generated.

    06/11/07 - Mailed I-864 Priority Mail (used James' shortcuts).

    06/22/07 - Received and mailed back IV bill (via overnight delivery).

    06/28/07 - NVC is done reviewing I-864 (automated system says I'm missing info).

    Hi MononoKe28,

    I have a question from your NVC time line. On 6/28/07 NVC automated system says you are missing/incomplete info.... what was that??
