  1. yes dear, you go get your SSN now, it's a simple procedure and you just have to bring your passport. There was i file i brought to the SSN office regarding K-1 visa holders being allowed to work, its at the SSN website but i think you can search for it here at the VJ site. Its a good thing to bring to the office because even SSN personnel didnt know that you can apply for SSN already. i showed her the copy of the file and she thanked me for giving her new information. I got my SSN card a few days later with the mark "not valid without INS authorization"

i didnt need my EAD when i applied for a job because K-1 visa holders HAVE PERMISSION TO WORK FROM INS. it is just not in our passport or visa. i have a little bit of problem with our human resources here and they have to forward my job application to somebody in our university who had experience with our situation. then this person processing my application just read a handbook and said im allowed to work as long as i get married within 90 days and that i should tell them if my AOS has already been received by the INS because they took note of my I-94 expiration date. So, you dont actually need your EAD to get a job.

i know its hard to be jobless here in your first few months but you dont have to be. you can work as long as the people in your human resource department know what they are doing and that they are reading their handbooks very well..

  2. Hi there,

we(me and my son) will be going to America very soon, am just still processing for my retirement/resignation papers here in the Philippines . And this mid of May is our schedule of joining my fiance. We will be having our wedding this end of May. (L)

I have a concerns, hope you can share me your ideas . As a rule, after the wedding we have to file for Adjustment of Status. and all other application like Travel Parole or Reentry Permit, Authority to Work and others as the case may be. My concern is about the Reentry permit. With my son as a K2 we will also file for an adjustment of status and would also file for a Reentry Permit because he will be going back to the Philippines to pursue his college education. My question is this :

Can he go out from the STates right after the filing the of the Adjustment of Status, without yet the approval of the Reentry Permit and the the approval also of the Adjustment of Status? Is his presense needed in the interview for this adjustment status considering that he is still minor? I am so confused :help: on this process, pls do share me your experiences and ideas, its very much appreciated. Thanks so much and may God richly bless us....... :)

DO NOT TRAVEL OUTSIDE THE US without the advance parole! you will have a problem going back to the states if you do this.

it will take a couple more months for you to receive the advance parole document after you mail in your adjustment of status paper. re-entry permit is needed after you get your greencard, so you dont need re-entry if you dont have your greencard yet.

I also suggest you apply for the adjustment of status, employment authorization and advance parole TOGETHER so you wont have to mail them separately and you wont have to pay additional fees. if you file them together, you will only pay for the adjustment of status fee.

    Good luck!

  3. You dont need to use your husband's name in your application. It depends on which name you would like to carry after marriage. I continued using my maiden name for professional reasons, so i put my maiden name in my AOS application. However, if you want to change your name after marriage then, use that when you apply for your AOS. Have fun on your wedding!

i put none under my A# and wrote my I-94 # at the back of my photos.

no, you did not use public assitance when you got your Td shot. I think they listed something like food coupons and social security benefits under this "public assistance" thing. so, you're good...

Read the following post only if you dont have a job yet or if you're interested to read it....

Regarding your EAD, if dont have a job yet but plan on getting one, you dont have to wait for your EAD, as long as the people who handle your job application know what they're supposed to be doing :) i was able to get a university position a month after my arrival even without EAD. if you read the SSN website, it says there that we dont actually need an EAD because we are actually entering the US with the assumption that we will be living here. K1 visa holders have authority to work from INS, its just not put on our passport or visas, but it is in their handbook(i think). however... when you get your SSN, they will print "valid only with INS authorization"

when i filed for my documents at work, they have to send me to the international students office in my university (which was mind-boggling because i am not a student, i am an employee). i was quite lucky because the person who entertained me was quick minded and told me that even if the SSN website stated that we dont need an EAD, the INS is a completely different entity and that they have different rules. then he said the handbook from INS actually allowed us to work too (phew!). The only hindrance for your being accepted at work is actually the personnel handling your employment application. a lot of them are not familiar with immigration rules and will actually give you a hard time. The human resources at our department didnt know what they were doing so they have to refer me to someone who is more familiar with my case, but i was lucky to be forwarded to a knowledgeable person. I dont have my EAD on paper yet but im already working and will just be forwarding the adjustment papers to our human resources when i get them because they have a record of my I-94 expiration.

  4. I was planning on arriving through POE Anchorage in Alaska, where I cannot get the EAD stamp... So I won't be able to work before I apply for AOS and receive my 1 year EAD. And I'd like to work right after my arrival!!

So, we have been thinking that maybe as soon as I get my visa, we should get married, then apply for AOS and EAD right after, and we could win a few months in the process.. I could go to the US around june with K1 and get married. And then, I would go back to France to work, while my baby is gone for his field season and I would wait for EAD there. Is this possible to leave the USA after marriage and while AOS and EAD are processing??? Or is this the worst idea ever? Does that make any sense?

YES YOU CAN WORK AS SOON AS YOU ARRIVE IN THE US

Regarding your EAD, i was able to get a university position a month after my arrival even without EAD. if you read the SSN website, it says there that we dont actually need an EAD because we are actually entering the US with the assumption that we will be living here. I understand your concern about being idle and jobless when you arrive here, but you can actually work, as long as the people who handle your job application know what they're supposed to be doing :)

I got married 2 months after i arrived because as much as i loved my husband, i wanted to make sure that i am amenable to living the another country. remember you are migrating not because of the greencard but because of the life you would be living here. take your time, dont rush things and prepare for a wedding you deserve.

you may not leave the US for any reason without the EAD & AP because you might be denied entry when you come back. so, i suggest you dont go back to france to work.

    p.s.

i heard that the people at the san francisco POE are actually nicer than those in the east coast. i dont know anything about the POE in alaska though. but yeah, you are actually closer to the east coast than the west, so, good luck.
