  1. Hi!

    It's been a while since I've been on here and I started the I-751 today. Got most of the evidence collected today, but I'm at a loss here for this fingerprint card thing.

    Is this a part of the biometrics process that is done later after we receive our appointment date? It says initial evidence that is required, #2, in the instructions is "two completed fingerprint cards (Form FD-258) for applicants."

    If it's initial evidence before the biometrics, I'm at a loss. Help!

  2. I have read and re-read the instructions for form I-693 and if applied to the letter, it means that NO ONE on a K-1 visa needs a TB Test (probably because everyone gets an X-Ray and the doctor would state something regarding TB if that was positive).

    The Civil Surgeon needs to fill out the vaccination section (transcript from the section prior to K-1) and sign the document, put it in a sealed envelop and give it to you.

    I just called a local CS and she quoted me $60 for the transcript and $15 for the TB test (if we want it).

    The important words in the new instructions are:

    If you were admitted as a K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e),

    you received a medical examination prior to admission, then:

    You are not required to have another medical

    examination as long as your Form I-485,

    Application to Register Permanent Residence or

    overseas medical examination

    You will, however, be required to complete Part

    1, Information about you, and submit the

    vaccination section of Part 2 with your

    civil surgeon must complete the vaccination

    The correct answer is that you are SUPPOSED to turn in an I-693, with just the vaccine transcriptions, as long as the physical has been completed within the last year. (Note below in regards to the TST.)

    Do not let the doctor try to get you to do more than you need, a new medical is not needed if you've had your medical in the last year. It says so clearly in the instructions for the I-693. David and I paid $25 for the transcription. Call around to different Civil Surgeons or use Dr. Arnold on the first page of the I-693 info (see link below). (I've also read that she won't transcribe the TST though.)

    Please read the instructions in regards to what you are supposed to do. It also explains clearly that any K-1 visa holders do NOT have to redo the physical; that you only need to have your vaccine transcriptions transcribed. Go to the CS with copies of all the printed documents. The I-693 instructions and the print out of the website below.

    My husband is also Latino. He's kept both last names and I added his first last name when we got married.

    No doubt it has been sort of a pain in the butt. Everyone has a hard time figuring out what his name or my name is exactly. I often do have to explain that it is two last names (made more confusing by the "De" in his and my last names). I just have to explain it, no big deal. We get the doctors calling us by the wrong names all the time, but other than that, it's really not a problem.

    (Except when making plane reservations - they can only put one in online; had to call to fix it after I bought the tickets.)

  5. Hi all and happy holidays!

    David recd his EAD back in October and has started working and he received his Permanent Resident Card on Monday, last week, 11/24/08! Whoo Hoo!

    Congrats to all that are receiving their EADs and GCs!

    For those of you that are waiting, good luck in the process! Patience, patience, patience. I feel you. I thought that David might die of boredom before he got his EAD.

    Also, will the fact that she was already given a ssn here at the local office

    cause problems since I heard she wasnt even supposed to have one yet?

    What documents are required at biometrics? The NOA mentions passport, drivers

    license, national ID, or state issued photo ID. Maybe she can use her national ID from

    Peru and that would be all she needs? She also has a learners permit.

    AP is Advance Parole. That allows for leaving the US and reentering. If you don't plan on leaving the country, you don't need to worry about that.

    The temporary SSN will cause no problems. In our state, we couldn't get married without it.

    At the biometrics office, they asked for the appointment letters and passports (with visas and I-94s, of course).

    She has a state ID, but it was expired by the time biometrics were taken. They didn't ask for it.

    Yep, Richard and Li are correct about AP.

    SSN is no big deal. K-1 visa holders are indeed allowed to have SSNs; why did you think that you weren't supposed to have one yet?

    I'm sure that you already have the documents for biometrics. When you get your appt letter, there'll be a list of possible documents to bring. Just follow the directions. Fairly sure though that she can't use her NI from Peru (if I remember correctly). It's got to be like a passport or an American ID...

    Well, in our case we are exhausted and just wanted to send in something to get in the pipeline rather than chasing down a civil surgeon 60 miles away. In 6 wks, I've evacuated my home for a major hurricane, had my town virtually shut down for lack of electricity for 2 weeks, flew to the UK because my fiance had an accident and broke his collarbone and ribs days before the shippers were picking up his household goods, flew back to US with fiance and put together a lovely wedding in 4 days, filed insurance claims for hurricane damages, and are still trying to get roofers and general contractors to have time for us while rain falls down inside the wall in our bedroom and black mold is growing through the walls. Oh yeah, and we got AOS/EAS/AP papers filed somehow. We are together and we are happy and just don't care if we're delayed another few weeks by USCIS. By the time they get around to looking at our case, maybe we will have done the I-693, which I totally agree that we will need. I just feel good that we have a NOA1 and are in the October box.

    What's up with your timeline for AOS? David and I filed in early August for AOS/AP/EAD, had biometrics 9/4/08. Our case was transfered to CA 9/11/08, I think.

    We received AP today. We're still waiting for EAD! The file was touched more recently for AOS than for EAD, which makes no logical sense...

  9. Received AP in the mail today. Finally registered our info into the USCIS system. Figured it wasn't worth it til now. Didn't want to freak out and check it every damn day. No touch on EAD since 9/5/08! WHAT??? Our AOS was touched more recently, 10/2. Ugh! Hopefully soon.

  10. We actually got away with just sending in a copy of the DS 3025. That's a form that the doctor fills out when you have your K1 examination.

    Yes, or you can have them do the test to see which vaccines you already have. I think it's called a "titer test" or something like that. It's cheaper and less shots than getting the vaccines again.

    So that IS possible?

    I vaguely remembered reading about such a test so I asked the nurse I talked to this afternoon, and she kept repeating you need to have the vaccinations again, there is no other way. I can't believe they would actually advise getting the same shots again when there is an alternative.

    Yes, it is indeed possible to go and get tested for your current immunities. David, my husband, did. No big deal! It can be dangerous as well (according to my family doctor) to get some of them again if they've already been done.

  12. Hi kid brooklyn!

    Thank you so much for your reply. According to the link you gave me, it doesn't really said that I would need the Hep A & B but I would need the HPV. Do you think I should get the Hep A & B and the HPV just to be on the safe side?

    After I posted the earlier post, I actually called up another 10 CSs in Omaha. They all required me to go through physical as the doctors wouldn't sign my I-693. So right now, I am thinking of just determining what shots I would need and then call Dr Arnold to transcribe it for me.

    Apart from that, would I need a TB skin test? I did my medical exam back in my country in May 2008. If I understand that regulations correctly, it said that those that are done after June 2008 would need to meet that requirement. So does that mean that the doctor will just need to transcribe the report from my previous medical exam?

    Anyway, it is really frustrating to call doctor after doctor and none of them would sign or transcribe my DS-3025 to I-693 and one place told me that they are charging USD500 for all the shots including the physical.

    It would be of great help if someone from Omaha could shed some light on some good ethical CS. Thanks!

    Hi everyone,

    After I entered the US end of August on a K3 visa, and after not focusing on any immigration red-tape for a while, we are now getting back up to speed for Adjustment of Status.

    Problem: info about my medical and vaccinations is missing. I had the medical exam for the K3 visa in July, and at the same time got the vaccinations I still needed, but (stupid, I know) cannot find the copy of this examination. I called the doctor's office and they told me they do not keep any records of those files (!).

    I called USCIS, and they told me we didn't need to worry about this at present, when filing the I-485 because, since I arrived on K3, the medical info would have been included in the brown envelop that I gave to the POE officer, so USCIS should already have it. I would be contacted lateron by CIS should any problem about the medical arise. (However, since USCIS people on the infoline are not always that accurate, I am not sure if this info is correct.)

    I also called a civil surgeon that is on the USCIS list here where we live, and they told me that if I have no proof of vaccinations, I have to get them all redone (the ones that are age appropriate). Since we are trying to get a baby, I am not looking forward to that.

    So I am now not sure what would be the best at present:

    - just file the AOS package without any reference to the medical (not even the vaccinations, which I got but which I cannot prove): if they send us an RFE for this (which seems likely, when I read the previous posts), will there still be enough time to get a new medical? And what are the negative consequences of getting such an RFE, apart from extra delays?

    - OR wait a few weeks longer before filing AOS and just get a new medical and update the vaccinations again here: Unless I am mistaken, we would be okay legally if we postpone filing for AOS, as long as we file for AOS before expiry of the K3-visa, right?

    Any advise would be greatly appreciated.

    Hi,

    You can go to a doctor and get immunity tests done to see what you do not need. A CS should be able to tell you exactly which ones you need. I did this for David over the phone...

    You've got to call around to get someone good! We paid $25 for the transcription and for the above information.

    RFEs = time delays.

  13. My wife is Peruvian. Right now were hung up on if we should change her name now or wait until she gets to the states. Also because of the latin' herritage she has four names. All of which are important to her and have meaning withen the family so she doesn't want to give them up. I'm the only son to pass my family name. I would prefer not to hyphonate our last names or combine them. With all the traveling and signing I do It's just impractical. We were married in Peru and we are working on the K3 right now if that makes any difference.

    Can she have four names?

    Should we change it now or wait until she comes to the US?

    Any suggestions?

    It sounds like the names are important to her. There really isn't a problem with her keeping as many names as she wants. She could just add your last name to her other two last names, and then she'd still have 3 last names.

    My husband has two last names. I wouldn't think of asking him to get rid of one just to make it more American. I added my husband's last name to mine. No hyphenation needed. So now I have two last names.

    What does your traveling and signing things have to do with her signing her name? How is it impractical?

    If and when you all have children, they can be your last name and her first last name. For example, you're Smith. She's, for example, after marriage, Rodriguez Garcia Smith. Your kids would be Smith Rodriguez. Totally cool! Your name would be carried on.

    Not trying to be mean, but isn't it a lot to ask her to give up her cultural traditions just because she's coming here? The transition of just moving here is going to be huge...
